  3. I have already raised this issue with the FOS. My angle was that if you put a cheque in the bank they say weekends are not banking days, however, when they apply charges and the date falls on a Sunday, which it did in my case, it was ok because the date had been pre-notified. So as long as you are told that the date of the charges and they fall on a Saturday or a Sunday its ok. I did actually say to th FOS they make their rules and regs up as they go along and a customer will never win with them.
  4. Strange, but I've received a letter today Vicki Blackwood, Adjudicator. I actually sent copies of emails to the FOS that were sent to my MP and John McFall in which I criticised the FOS quite severely and said that by they got around to looking at the complaint the interest on my o/d would be in the region of £1,500. I wonder if they are sifting out all the complaints regarding the Halifax overdraft charges I suspect there will be quite a few.
  5. I think you should tell us the answer as you are obviously brighter than the rest of us and I would dearly love to claim my charges back from the Halifax in this life! The robbers are already getting away with too much with their new charges regime.
  6. My grandson and myself both fell into this trap last year. We were both told they were discontinuing the Cardcash account and made appointments to set up new accounts. Now look at the interest they are now charging! As my grandson was 18 at the time and an apprentice they gave him the Ultimate Award Account when he was on £90 per week. I'm still awaiting for the FOS to investigate.

  11. Received a letter today from 1st Credit. Firstly they have read this thread as no where have I stated in any correspondence to them that the account was made up of charges, which is in their letter attached. Secondly, the Agreement is in fact an application form, and thirdly Connaught didn't defend the Stat Demand on the basis that they couldn't provide statements.   12. At least you will be on your guard for your next appearance and I would stick to your guns this time and if they do want to postpone for any reason you should have your speech prepared for the Judge so as they don't get away with any further delays.
  13. When you write to them head your letter OFFICIAL COMPLAINT they will then have to go down their complaints route and at the end if you're not happy they will give you the option of going to the FOS. Address all the issues in your letter and see what they come back with.
  14. When did you actually receive it? if they have been given 14 days clear notice than this is correct, however, I did think that the sum to be what is outstanding excluding any fees. I would also challenge this is in your letter. Send them a copy of the default notice and ask them why the agreement was terminated prior to the date on the default notice.
  15. Did they give you 14 days notice of the default in which to settle. Your letter is fine with the exception of the last paragraph I would add the offer of £50 a month with no added charges .....
  16. You should write back to them and reiterate your offer and say that you cannot agree to to the contents of their letter. Unfortunately, there are a lot of us in similar positions with the Halifax at the moment as for reasons better known to themselves they are not accommodating their customers and complaints are ultimately ending up with the FOS. Don't just accept what they say though, keep on to them, at least if it did finish up with court then you can show that you have made every attempt to come to an amicable settlement.
  17. Hi Welcome and do not worry you have come to the right place for help. You need to send them a CCA letter with a £1 postal order, do not sign letter. Some recommend sending by recorded post but I stopped using Recorded when so many of my items didn't either get delivered or never signed for and now always send by 1st class post and getting proof of posting from the post office, free. Do not divuldge any personal information to them. Under no circumstances let them have a copy of your signature. They have 12 + 2 days to reply to let you have a copy of the agreement. If they send you one get it scanned and put up, deleting all personal info. In the meantime, do lots of reading by searching 1st Credit Threads - loads of them, you will also see the tactics they use. You can find the letter in the letter templates.
  18. Go down the Official Complaints route - once you've exhausted this procedure and they give you their final response, if you are not happy with this, the complain to the FOS. The more complaints that they receive on the ethics of HBOS the better. I have never seen so many customers complaining about the Halifax as there are at the moment I cannot believe that they are still playing hardball with their customers. It seems as if they are deliberately trying to drive customers away.
  19. But I don't have the Ultimate Reward Account and I am having nothing paid into this account at all. I have left my overdraft which I am being charged £5 a day for, and actually don't care a toss, as I've made my mind up that I shall make them take me to court for the interest, every intention of paying the overdraft back and offered them a repayment plan together with the interest that I agreed to which they didn't accept and was told to go to the FOS which I have done. I also emailed John McFall and he said couldn't intervene so did my MP. Yes I've seen the news about the Scottish case so shall await the outcome of that.
  20. Did you notice whether they have credited your account with £4? I have reported this to the FOS for when they start investigating my account. I use to have the old Electron card and as you say never a charge. What infuriated me about the Halifax was they told me that they were phasing these out but I have discovered that they have not phased these out at all and they are still being used. Someone on GAG quite recently said they were offered one, and I've also seen customers using them.
  21. Really strange. My complaint is with the FOS so I shall print the statement out and ask them to query why they've credited this amount. It did cross my mind that because their charges are so high and they've just woken up to how much it is going to cost their customers that they are trying to keep them down a bit. My charges were £39 - £4 = £35 which is what they were charging for going over the unauthorised overdraft previously used.
  22. I've just received another document from the Halifax so checked it out and found out that they have credited my account with £4 cash and debited the charges for the month of £39.00. Has anyone else had this happen? I can't fathom out what their game is to credit £4!
  23. They've not yet defaulted me but I have been receiving a reminder each week advising me they are charging £5 a day. Please themselves because they will have to take me to court to recover it. My complaint is with the FOS as well. I would forward the default notice to the FOS to add to your file.
  24. If you have had a final response from the Halifax then you can complain to the FOS, however, this takes months as they have such a backlog. If they haven't given you a final response have another go at them. There are a lot of us in the same situation with our hands tied at the moment.
  25. I have had this happen to me on 3 occasions with the Halifax. Each time the Halifax said it was the recipient and that I had to wait 7 days for the transaction to go back on to my account. The third time it happened it was for £399.00 I phoned Halifax Complaints Dept and they refunded immediately yet the previous twice they said they couldn't do it. I asked them why on the previous two occasions they said they couldn't answer why they hadn't as they do have the powers to do this.
