    • Write to the IPC complaining that UKPC have not observed the requirements of PoFA . IPC  Waterside House, Macclesfield SK10 9NR Dear IPC, I am writing to complain about a serious breach of the Protection of Freedoms Act 2012 by UKPCM. I feel that as it is more a breach of the Act rather than not just  complying with your Code of Practice which is why I am bypassing your operator. Should you decide to insist that I first complain to your operator, I will instead pass over my complaint to the ICO and the DVLA . My story starts with being issued a windscreen PCN on 8/3/24 which was almost immediately removed and a second  PCN was then  sent by post on 13/3/24  [deemed delivered 15/3/24] which I did not receive and had to send an sar to have that particular mess revealed later  but that is not the reason for my complaint. UKPC then sent a Keeper Liability Notice dated 12/4/24 warning me that as 28 days have now elapsed, I as keeper am now liable for the charge.  This is in direct contravention of PoFA since the keeper does not become liable to pay until the day after the original PCN is deemed to have been given which would have been 13/4/24 -a Saturday ]. Not only does it not comply with PoFA but it fails to adhere to your Code of Practice and is in breach of their agreement with the DVLA. You will be aware that this is not the first time that UKPC have fallen foul of the DVLA and presumably yourselves. I have included copies of both Notices for information. You will realise the seriousness of this situation if this is standard practice from the UKPC to all motorists or just those where windscreen tickets are involved since the Law regarding PoFA is being abused and is unfair to misguide motorists. I await your  response which I understand will usually be within a week. -------------------------------------------------------------------------------------------------------------------------------------------------------I would think that should be sufficient for the IPC to cancel your PCN though  you should await comments from the Site team before sending your complaint. Don't forget to include both PCNs.  
    • Hi DX, Sorry, fell asleep as I was up all night last night writing that statement. Yes, I attached the rest of the witness statement on post 50, bottom of webpage 2. That's the important part.  It looks like the lawyer who wrote Erudio's Witness statement does not work for them any more. So, I'll have another lawyer representing instead. Not sure if I can use Andy's hearsay argument verbally if that happens.... I did not put it in writing. Apart from not sending deferral forms, my main argument is that in 2014 Erudio fixed some arrears mistake that SLC made and then in 2018 they did the same mistake, sent me confusing letters. What is the legal defence when they send you confusing material?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Surprise surprise. I got a call from NCO Europe to day. All they did is call my number and start asking 'whats your name and date of birth'. I asked where he was calling from and he said NCO Europe. He said he was a Bailiff and is coming to my house to collect some money from me. I asked his name and he refused to give me his name so I hung up.

They are surely not allowed to threaten people like that, after all I already have an arrangement with them for a monthly payment.

I have called their office asking to speak to their manage, all they say is 'whats your reference number'

Damn!! these people. What do I do..They keep calling!!

Nationwide preliminary letter sent 14/06/06 replied 22/06/06

LBA sent 23/06/06 no reply.

Moneyclaim 07/07/06

Acknowledged 13/07/06 with intend to defend.

£400.12 refunded today now awaiting for the rest!

Phone your local Trading Standards and tell them what happened. No, thye cant pretend to be a bailiff and say they are coming to take money off you. (Unless they have a court judgement)- that is illegal.

 

If NCO ring again, do not confirm your name, address or post code.

Did you give them your name and date of birth. You should have refused these security details. Without them confirming that they are talking to the alleged debtor the should terminate the call as it is wrong to discuss your alleged debt with anyone else.

 

He is not a Baliff. This is typical sh!te talk from NCO. A Balliff is appointed by a court ONLY after a judgement is made by the Court.

 

Tape all calls from these mongrels or else refuse point blank to speak to them.

 

Why are you paying them. Have they actually produced a CCA to prove you owe them money or indeed if they are entitled to demand money from you. I would make an official complaint to Trading Standards about the activities of this bunch of bullying ****

Well well well, Ive just had a phone call from NCO!

 

No, the usual type! :eek: this was a very scared sounding executive lady called Janet Walmsley, desperate to give me a large cheque and all my Paypal data

 

If you havent read the whole of this thread- I'll recap:

 

1) Hassled by NCO for months for a non-existant Paypal debt.

 

2) Paypal eventually called the NCO dogs off.

 

3) I sent NCO a S.A.R - (Subject Access Request) for log of all calls- they failed to supply the Paypal ones, but did send my Student Loans ones.

 

4) Started a small claim against them for failing to comply with S.A.R - (Subject Access Request) and claimed £200 damages.They have until 3 September to dispute my claim.

 

5)Recieved call from them today (31 August) admitting liabillity and desparate to give me cheque for £200 plus court fee plus interest.

 

6) I have told them that the claim will remain active until cheque clears and they send the data requested.

 

The lady who rang me sounded very, very scared. :eek: I think she would have delivered this personally, had I asked!

 

It was such a damn good feeling listening to this person's discomfort and to have NCO squirming and wanting to jump through hoops for me for a change!:cool:

 

She said she had spoken to their solicitor who had taken a look at at my POC and said "Settle, petal. ASAP. NCO will lose"

Assuming NCO comply, I will use their call log to nail them for further damages under the Protection from Harrassment Act 1998.

 

They had ignored all my letters and failed to investigate my complaints and continued to hassle me by phone, dispite the s. 40 Admin of Justice Act 1970 letter I sent them,

 

It is very true what they say- "revenge is a dish best served cold"

 

I'll start a thread outlining my adventures with this gang of bandits.

Smith Lawson are simply Student Loans in a slightly better suit!

 

SLC use a Glasgow firm of solicitors called Harper McCleod.

 

If want to throw a spanner in their works to get a bit of peace for a while, you can start a small claim to force them to remove all the £20 penalty charges (and interest on these charges @8%) from your account.

 

(Which they will, I've proved it)

 

You could also use the opportunity to ask the judge for a Judicial Review into the way SLC have fkd you about.

"The Office of Leatham-Locke" is just NCO in a sharp suit. Probably gets them from the same tailor as Smith Lawson and Co!.

Youre not out of the woods yet, not by a long shot...Look forward to an LBA for damages under Protection from Harrasment Act 1998.

 

This little mix up was sorted out by an "internal correction" by Paypal. This "internal correction" (basically Paypal was trying for a double reimbursement and I obtained proof of this) could quite easily happened months earlier if NCO had followed OFT debt collection guidelines and investigated my complaint.

I'm not the only one having problems with NCO then?

 

They were calling me several times at home each day, but I work and my fiance kept answering the phone. Almost every time they hung up as soon as she answered (probably so that they can say they're trying but we're ignoring their calls).

 

I phoned them up a few weeks ago and told them to take my number off their computers, which they did, and I didn't get a call after that.

 

Well, until this morning that is, when I got a call on my mobile. I've not given them this mobile number, so wondered how they got it. But then I remembered that someone called my parents house asking for me last week (I've not lived their for 6ish years), and they gave them my mobile number. So I'll be expecting a call every morning and afternoon now.

 

I'm actually dealing with a debt management company who are dealing with my finances, and have been for several months, but NCO seem to be the only company rejecting their offers of repayment. All the cards I've received threatening to call at the house have been sent to the debt management company, so they can see how much they are harrassing us.

 

I did find previously with another company (First Credit I believe) that threatening to sue them for harrassment if they called again worked, they went from threatening me with court action on a daily basis (each time I told them to go ahead and take me to court, but they'd just phone again a few days later with the same threat) to accepting my much reduced offer of repayment. The only time I've heard from them since was to ask for the number of the debt management company, which I gave them and that was the end of the calls from them. So maybe I'll try it again, though from reading some of the messages on here I'm not sure it will work with NCO.

Just refuse to confirm who you are - they can't talk to you if you're not the account holder. If I don't recognise the number calling my mobile I simply answer "Hello?" - and if they identify themselves I inform them I do not discuss personal matters over the telephone, and if they don't I refuse to confirm who I am. It keeps them employed without any conflict and it keeps them from harrassing me about money.
