Although not precedent it would be most helpful to other Caggers if your case could be cited as part of their skeleton as it may just be enough to sway an undecided judge

 

& with that in mind will you post the judgement asking other victims to contact you for the full case citation

MandM congrats well done. A good well written post as well that will put people at ease who have up and coming court cases.

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.

Well done M&M. Our trial is 9 April with BOS:eek: Defective DN doesn't come into it.... its a totally blank template supplied and verified as such in their W/S:roll: Think we'll be on much stronger ground pushing this angle rather than the T/Cs and "agreement" which is not available. At the end of the day, it really is getting a judge who knows his onions:p

They are all very important issues and none is 'de minimis' - just make sure EVERY element of your argument is as solid as M&M's!

echo Donkey - your Judge may not be hot on the DN and focus on the agreement - M carefully allowed himself to be steered. You soon realise when you are heading down a dead end, stop, turn round and try a different route.

 

Rightly or wrongly a Judge may dismiss one or more of your arguments.

Make sure, in the summing up that you are clear (and it is clear for the tape) why any argument was allowed or rejected.

The allowed ones are great for CAG the rejected ones you need to understand in case you need to appeal.

Thank you all. At work :rolleyes: so popped on for a speed read. Some familiar names and I can't thank you all enough.

 

Now the serious bit - If my judgement helps anyone then of course i'll share it. What am I likely to get through the post from the court now? Do I need to get hold of the transcript and how would I go about that?

 

If anyone knows anything about this i'll gladly post the info up.

IF you need a transcript you need a form EX107 and put down the name of a transcriber, the judgment will need to be approved by the judge before you can have the script.

 

If you need a name of the transcriber I used just pm and I will give you the details

the transcript will cost you therefore if i were you i would find out how much and then i think it reasonable that caggers who want a copy ( i wouldn't post it up on the forum with your ID on it) can pay towards the costs of it (myself included) .

You have given me hope for my case in 3 weeks time where they say but have never actualy produced a Default Notice

 

I have other things to go on but will be using parts of your defense as well if I may be so bold!

i do beleive that the site team should make a sticky out of post number 268 in the following thread for the attention of those with DN issues and Restons

without even having to produce it to the judge (but making sure that Restons lawyer can see it on the desk) any argument that Restons attempt to make to a court (and against the lawyers code of practice) as to the lack of 14 clear days being a de minimus issue - can be shot down with a few well framed questions

 

as it can be found "on the internet" by googling - it can hardly be described as not being in the public domain

It wasn't actually the scanning which caused the hold-up, I went off to grab a quick sandwich, came back and found I had a computer mal-function, took a while to close it down and re-boot. :Cry:
