    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't think any of them will ever learn DW my bf died of cancer a year ago and she had a letter sent to her saying they couldn't renew her

life insurance policy as she had a terminal illness after she had passed away!

Absolutely outragious!

 

I remember when my Daughter was stillborn, and the very hospital I had her in sent me an anti-natal appointment around a month later, so it wasn't as if it could have even crossed in the post or anything.

 

And they say they learn lessons from this?

 

In April, a relatives partner had a miscarriage. In July, she was sent a letter for a midwife appointment.

My wife miscarried three times Nyst and one of the miscarries was not felt so Sue and i went to the clinic to have the ultra sound scan only to be told that there was no featus there they tried and tried to locate it but it had dropped so far down and it wasnt untill a few days later they took her in and found it.....she WE went through so much just to get our boys and then she passed away when she had so much to live for

Mobile recycling company who offered £55 for my old phone. I accepted and sent it off. The phone is working, but they have now emailed me saying there is excessive wear and tear and reduced the offer to £30. There is no excessive wear and tear at all. There is nothing wrong with the phone. They say if I refuse, then the contract will be cancelled immediately, but to get my phone back, I have to forward them £4.95 postage costs before they will send it back to me. Do all these companies work this way?

 

I have sent them a threatening email that I will name and shame them all over the internet, and get as many peeps as possible to stay away from them in the future.

 

 

If all else fails, kick them where it hurts and SOD'EM;)

Call consumer direct about them Sod'Em, because from as far as I know, it is they who are not happy with what you sent, so therefore it is they who must foot the bill for the return P&P.

 

But before you do, was there any small print that mentioned this?

There was a programme on yesterday morning on BBC One. I think it's Rip off Britain? Someone had a similar case but it was with one of those we buy gold companies.

Those 'we buy gold' companies are every bit as bad as the payday loan sharks, they all gather in one particular area in my town and I have complained to the council about this, I told the council they need to de-focus their trading standards activities from alleged 'under age sale of pets', ie 14 year old not able to buy a goldfish without a parent present.... to this blight on the town. I pointed out it makes the town look shabby and people don't go down there for fear of being mugged for their gold or other valuables (I even put in a few of the 'incidents' from the local press to back my complaint up.

 

All I've had so far is an online acknowledgement of my complaint. I handed in the complaint to the council offices (which are a short walk from me) and posted it on their online site so I know they have had the complaint.

Not being able to find the photographic evidence that I'd taken digitally and stored on my pc and had also printed off 9 A4 size photos and then could NOT bliddy find them so went to print off the photos again and discovered my colour ink was out ........................fooooooooooooooooooooooooooooookinorah.......then the disclaimer slip that I wanted to show the solicitor had slipped out of the sleve so i later back tracked and found it in the road surface of the carpark.......good job I'd attached a massive paper clip to it or else it may be anywhere now...................I was soooooooooooooo organised up untill yesterday.................why did it all go wrong for me today.............just had to do it all again grrrrrrrrrrrrrrrrr

They're all a disgrace BurlyB! Not one of them have a clue what it is to live in the real world - if they had to so much as pay for their own lunch everyday they'd think they were hard done by!

Specsavers Audiology department. I had an appointment at 4.20 today and was told I'll be seen soon. I was seen. But it took 15 minutes for someone to find my ear plugs. Why didn't they look before seeing me?

 

Maybe they should have gone to Specsavers.

been there bobcat got a massive t-shirt on that and from what a nice lady "who passes my house" told me....one of the people who stabbed me in the back just weeks after my wife passed away is now an very very lonely person and has complimented me on where my boys are now almost 14 years after she and others stabbed me and twisted their dirty devious knives....I think she now know's that one of the worse instigators used her and now years on the penny has dropped....I told the nice lady that if the "once bad lady" wants to talk to me she'll have to find her way to me ...dont really know why I should give her the time of day but we'll see.

 

Rest assured though bobcat I do know whats what lies do to we innocent people ....chin up
