He not have to force the finance company and big motoring world to accept the rejection to give your money back. I suggest that you get the letter off tomorrow.     • Been perusing the actual figures on the polls above wondering where the '16% claimed for deform comes from? I understand that there are 'weighted' end results based on secret calculations ...   Probably going to repeat this later, but remember that the ukip/brexit/reform/deform party has ALWAYS had poll speculation FAR better than their actual  performance at elections - by large margins. SO: The labor and Tory votes come largely from simply the people who say they will vote for them - sorted Lab 43% Tory 20%, with maybe another small 1-2% coming from the weightings of the 'not sures' Greens largely get what is declared from 'other' , although with another declared green bit from the 'pressed' question   So as the share of the voting displayed in 'other' granted to reform/deform is around 11%, where does the '16% too often being reported come from? Seems that reform has been granted as beneficiary of effectively ALL the don't knows and wont says, who when pressed didn't actually declare for someone else ... effectively adding 40%+ to their reported polling % - rather strange given their consistent under-performance compared to polling - or perhaps that is the cause of the higher rating eh?   Now I admit the possibility (probability?) of wingers being ashamed of declaring their support for the yuckey lemon end of the spectrum ... but surely  that should affect the 'Torys as well? Maybe the statisticians have simply weighted in that deform wingers are simply more likely to lie?   But - without 'weightings' and assumptions that faragits will get everything that isnt declared as a definite and unequivocal 'not that Piers Morgan' - reform is on around 11% it seems.   Add to that the history of polling a lot less than the hype - and the simple fact that faragit wingers seem to be spread across the country (presumably skulking in their moms spare room despite being 45+) and greens and lib dems seem to be community minded - I think two seats will be an epic result for farage. Hardly the opposition - far more raving wingnut party.   and importantly - Has farage got a home in clacton yet?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How long have you been without money BobCat? Is there no way you can get to one of the offices and ask for an emergency payment?

 

I made myself swear today, I just realised that I wrote something the wrong way on one of the threads about OCD, and it looked like I was saying OCD didn't exist :!:

I see the Chief Of Merseyside Police at the time of the Hilsborough Disaster is still saying that the Liverpool fans did not behave (or words to that effect). He says he has nothing to apologise for, and is sticking to his guns.

 

And he is now a 'SIR'.

 

Can people get stripped of their knighthoods?

Yes. They can be stripped, although its normally done under pressure since the government and monarchy dont like to admit they made a big mistake.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

other half now has to go and get a "fit" paper to exclude her from working from the doctors just so she can be added on my Jsa Income based, just hope she can get one and does not have to pay for it otherwise she has to come with me every time to sign on with me

You don't have to pay for fit notes. You may be charged for letters confirming disability, etc. But not fit notes.

Absolutely disgusting!!! Surely someone can help or do something?

 

Banks make me swear!!! My OH went into our bank today to make a money transfer, and was told to do it on the phone as it was my account he tried to do it in - do you think I could speak to anyone today? No, they said their systems were down!!!!

Being told by someone that I owe them an apology. Yet, it's ok for them to be nasty to me. I think not. I am never going to apologise for something she took the wrong way.

 

You know what hunni, if someone is nasty to you, give them just as good if not better right back, and don't give a second thought to what anyone else says! Why should you just take things and not say a word? In fact why do people always raise their eyebrows and recoil in horror when people stand up for themselves?

 

Anyway, cyber-bullying and trolling makes me swear as always! But just look at this little beauty! Cyber-bullying/trolling will be no more!

She then proceeded to physically drag the poor child around ASDA. Whatever happened to kindness and patience? Get far more response from a kid making a game of things and getting the kid to help with the shopping or something....

Yes Yes, I'm weird. I tried being normal once, was the most boring 5 minutes of my life!:madgrin:

Did you say anything? I certainly would have, something along the lines of "ever heard of verbal abuse"?

 

I remember one time, I was only around 17, and I was leaving my Granddads house when I saw a guy with a German Shepherd, he was kicking lumps out of the dog (you know when a dog makes that blood chilling, howl like yelp?) - I shouted for him to lay off, to which he replied "if I come over there, are you gonna f*****g make me" - I absolutely pooped myself, but stood my ground, and told him not to bother as if he did it again I go over to him :madgrin:

 

I don't know if he wondered if I was maybe trained in Marshall arts or what, but he just told me to f**k off, and walked away :lol: - at least he stopped kicking the dog!

wow D/L when our youngest boy Billy was a little tot he used to scream blue murder at going shopping right up until we bought him a little red and yellow plastic trolley that he used to shove around sainsburys while we had the real one and just so long as he could put a couple of light weight items in it he was happy as Larry lol....mind you he used to flippin run off all over the place at times too ....bugga...now though he's 6'3" and off to uni this coming friday lol...where has the time gone

We have. This issue a lot our daughters autistic and has found that if she screams and makes ascene then she tends to get taken home which is what she wants paediatrician says to just ignore her until she gets bored of it, if I had a penny for everyone who hadq a go at me for it saying " aren't you going to do something about that?" then it would be better than winning the lottery got asked to leave a pub the other week as the landlady just said " I'm not putting up with that noise any longer"

To duckwaddler: I started over to the woman but staff got there first, said something to her, hence the dragging off. Think they's asked her to leave.

 

LOL burlyb: my eldest had one of those trolleys and was a huge help until he started picking stuff off the shelves that I didn't need or want. That trolley went all 3 of my boys and like you I now have one at Uni, one at college and the youngest is still at school. Where DO those years go?

 

To labrat: thats the other side of the coin and thank you for reminding me that all screaming kids are not just misbehaving. The girl in Asda wasn't creating, the mother was and made her poor kid cry.

I volunteer in a charity shop and we had a child who threw a tantrum, which I ignored. One worker commented on how this child is just a spoilt brat. Another person (worker had walked off by then) said that the child is Autistic. This worker believes that Autism doesn't exist / is over diagnosed and "we had nothing like that in my day". In her day, we would have been put into institutions.

Labrat this is terrible!!! Does the landlady know your daughter has autism? If she does, you ought to consider just mentioning in a very quiet voice that there are laws in this country against disability discrimination.

I know exactly the kind of person you're talking about DL, they shout and scream at life and everything that comes with it usually! They also think they're doing no wrong whatsoever! This is exactly why there should be a license to have children (just my opinion lol), the law wouldn't permit someone to drive a car without a license, yet thousands of people are allowed to be in charge of raising a human being!

Because back in "their day" Nystagmite, they would have been put down as either just naughty, or mentally ill and institutionalised! Thankfully "times" have changed, it's just a shame that "people" haven't!

Duckwaddler, I agree a Licence to have children could work in so many ways, but then I guess thats a form of communism.......

 

I know, I've had this discussion many times before - and many of my friends think I'm terrible for even thinking it :lol:

 

I just think if a person is going to be responsible for a human life, they should at the very least be skilled in basic life skills that the child needs in order to survive, such as common sense, cooking, tolerance etc - and also be fully vetted for possible issues such as anger or violence.

 

If someone were adopting they'd have rigorous vetting.

 

I don't know, I mean were would the line be drawn? All I know is there are generations of children being raised that have no clue what the word manners is let alone have any, the same with respect, they seem to think it's acceptable to scream shout and swear at whoever they like because it gets done to them at home, the only food they eat is takeaways or convenience food (God help the majority if the economy collapses, a lot of people I know don't even bother to grate cheese themselves anymore, they buy it ready grated!).

 

And if they're raised with a violent parent, that violence usually either comes out in the child, or the child suffers from violence themselves.

 

Going back several years ago I would never have believed I'd be saying this, but there is a generation of feral children now, and they're getting younger too, so rude at such a young age.

 

There are though on the bright side still some lovely well mannered and raised kids around, I just hope they're not a dying breed!
