In your Defendant’s response you make reference to a pre-existing commercial agreement between yourselves and Packlink (2.7). In that, you claim to have a clause removing customers third party rights under the Contract (Rights of Third Parties) Act 1999. I would like to request a copy of this contract and confirmation of the date on which the exclusion of third party rights term was included in it. If you refuse to provide this then I will be henceforth referring to that refusal in the claim, including to the Judge. I also notice that you have destroyed tracking information due to "lapse of time" in line with your data protection policy (2.12). Can you share where this data protection policy is disclosed to customers? I also ask you to forward you a copy of that data protectiono policy, and again if you refuse to provide this then I will be henceforth referring to that refusal in the claim, including to the Judge.     • Firstly, thank you for filling in the sticky so quickly - we wish everyone who comes here would do that! You're in the clear.  MET don't know who the driver was.  They can use Schedule 4 of the Protection of Freedoms Act 2012 to transfer liability to the keeper if their bilge arrives within 14 days - they didn't send it out till 102 days after!!! So sit on your hands.  MET will come out with threat after threat but ultimately will do nothing. Have a read of other threads for this car park - we are having a tsunami of cases at the moment. Be sure to come back here though if they ever send you a Letter of Claim.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Went clothes shopping today for the kids, my son J who's autistic decided to have a major meltdown and we ended up having to cart him outside of the centre. Normally we deal with it pretty well, but today something really got to me and ended up in floods of tears :rolleyes:. Probably people staring.

 

Then on the bus home a bunch of morons at the back, swearing and coming out with the most disgusting stuff. My partner, who's a big fella, told them to pack it in, but it was a bit tense cos there was a fair few of them. I kept thinking 'christ, what if they decide to kick off'?

 

Wish I'd stayed at home :(

Didnt know wether to laugh or cry or swear blue murder tonight.

 

I have a wedding(very posh one) next weekend, and went to chemist today to get my usual hair dye, but they must have changed it slightly as its come out a reddish auburn and very bright!!!!!!!!

 

So right now Im swearing like a trooper to my hubby about the state of it :eek:

It could have been worse...

 

I tried one a few years ago and had a severe allergic reaction.

The colour was OK but I looked like I'd gone to a KO with Tyson..I daren't leave the house for 2 weeks :-|.

 

Ok now you can laugh ....:p

Luckily for me, one of the neighbours daughter is a trainee hairdresser and came to the rescue this morning, so now I have a nice colour and she even gave me highlights :D

 

I was swearing today at my 'lovable' dog and cats, after one of the cats knocked over a bag of cat biscuits and the whole lot of them cleaned the floor, so now I have no cat biscuits left and a dog who is dropping ninja farts everywhere!!!

ME.. err no my landline is not working fine and the bill has been paid why would there be a restriction put on it , again explains i can't dial out or recieve calls from an automated message,

ME.... losing it by now :rolleyes:

Some stupid, stupid woman from Regal telling me that I was lying and that Natwest didn't already have a Charging Order so they would be enforcing the CCJ as they saw fit......:mad::mad::mad:

 

And then being told to calm down and stop shouting at her...If I'd have been in the same room as her I'd have done a lot more that bloomin shout. The ignorant flamin' mare. My day in court must have all been a dream and the papers I have must be flippin scotch fluffin mist:mad::mad::mad:!!!!

Just got back from meeting someone who I had to pick up something from Freecycle, she wasnt there and didnt even answer her phone. This has really hacked me off as she didnt have the decency to let me know she would be there:mad:

I was in a frozen food shop yesterday and needed quite a few bags of frozen mince but there wasn't any in the freezer. I asked an assistant if he knew if they had anymore in the back. He replied " Yes we do but I'm too busy at the moment!" He then carried on flattening carboard boxes he had just unpacked:mad:

 

I went shopping elsewhere.
