    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I blame CAG for giving me back my weekends and being able to live my life more instead of just regarding it as an existence! and no longer sitting in front of my pc in floods of tears all the time!I can actually enjoy being on my pc again!

I also blame Cag for giving me strength when I needed it, The support and advice that has helped through the most difficult and painful times. Nothing I could say could show how grateful I am :D

I know exactly what you mean. Above all, I realise now that the clowns who contact me are just that. Their threats and psuedo legal papers are just bottom-wipe material. I was terrified by the correspondence and 'phone calls I used to get. I'm not really gung ho enough to say "bring it on" (I hate that saying), but calls like this simply don't bother me any more and I rarely get them anyway.

 

What I have now is normality back in my life. If I get threatening letters I can now consider them for what they are worth. I haven't won every battle but I'm well up on balance. One day I will settle things correctly but as far as I'm concerned, it is first come, first served. In other words I will pay the ones with the correct agreements now. The rest will have to wait for the time being.

Hi Creditcardmug! yes i was getting so depressed with all that debt and starting to dread answering the phone! and when i started to get loads of phonecalls at work that was the last straw! I did a search entering key words MBNA and bullying tactics! and got loads of links showing i was not the only one to be embarresed and humiliated at work and home!one of the first lnks i got was to this forum!At first i thought no way would i have the bottle to go through with CCA requests and challenging the enforceability of debts andas i did not have a very good start as as soon as i joined the forum i commited a faux paux! got accused of hijacking someones thread!though i was not conciously trying to hijack it just trying to commiserate with someone who had similar problem as me!so i though oh no id better delete my post !as i dont think i will be welcome on here so i edited it and tried to delete it but it kept comeing back! LOL i think fate meant me to find this forum !as straight afterward loads of wonderful people kept sending me messages on my thread and made me realise i would be welcome on forum!Thanks to these people who welcomed me when i first joined forum my life has now got a lot more bearable and given me a little hope!:)

Hi boavista, despite my number of threads I'm not really that knowledgable, so I just stick to what I know. More importantly, it's sometimes good just to give new posters some kind of response just to welcome them if nothing else.

 

I do know what you feel though, you don't want to cock it up because it's a real minefield and takes an awful lot of research and experience to get to the point that some people are at.

:D It suddenly dawned upon me that living in rented accomodation, having no job or savings and having very few realisable assets was a perfect situation to be in when dealing with DCAs ... I had nothing to loose by being a little impudent;)

 

At one point I wrote to all of my creditors saying that I was considering petitioning for my own bankruptcy. I offered nominal payments and with the exception of couple of them, they all accepted - payments I still maintain to this day!:)

I used to dread the postman calling and used to breathe a sigh of relief when he walked straight past my house, now I look forward to his calls but oddly now get disappointed when I don't get any correspondence from a DCA. There standard threat letters go on the ignore pile, or i use the back of them for shopping lists, well I have do to my bit for recycling. I am hoping for another stat demand, I had 2 earlier this year and missed the opportunity to go for set aside and get some costs. Come on DCA's where's my stat demand??:p

:grin: Me too .... last week I only got 2 letters; both junk mail from insurance companies ... most disappointing - looking forward to a 'BOS' or a 'Cabot' as I haven't had the pleasure of either yet;)

the phone now only rings when a family member wants something or the use of my knowledge.

 

But thatnks to CAG a friend of my bro is now demanding a CCA from a company. I dont know where he got the letter from appart from the internet but my lectures have helped my bros friend. SHaun if your registred on here then Hi and shout if you need any help.

 

Any way thanks to CAG i am about 3K or more better off and i have managed to re carpet the house and buy a new washing machine and freezer.

 

As well as spread the word about unfair charges.

Evenin all, I'm hoping to be able to blame the cag if can be successful against mine & hubby's dca's!! :p Have just sent cca requests to all those that have 'bought'/'taken on' our acc's & am waiting to see what kind of reponse (if any) we may get. Is soo soo scary just standing in the postoffice asking for the postal orders to send etc, wondering whats gonna happen in the next stage, if u know what i mean, but also quite satisfying that i can log on tonight for instance, & have a chuckle upon reading this thread whilst feeling a lickle bit of pride & hope for the 1st time in i fon't know when!! (Corny or what !) Anyways, nuff of that! Just wanted to say thanks & keep doing what every1 is doing cos ur all doing us proud! :D Take care, Julie x
