    • Well we can't predict what the judge will believe. PE will say that they responded in the deadline and you will say they don't. Nobody can tell what a random DJ will decide. However if you go for an OOC settlement you should still be able to get some money
    • What do you guys think the chances are for her?   She followed the law, they didnt, then they engage in deception, would the judge take kindly to being lied to by these clowns? If we have a case then we should proceed and not allow these blatant dishonest cheaters to succeed 
    • I have looked at the car park and it is quite clearly marked that it is  pay to park  and advising that there are cameras installed so kind of difficult to dispute that. On the other hand it doesn't appear to state at the entrance what the charge is for breaching their rules. However they do have a load of writing in the two notices under the entrance sign which it would help if you could photograph legible copies of them. Also legible photos of the signs inside the car park as well as legible photos of the payment signs. I say legible because the wording of their signs is very important as to whether they have formed a contract with motorists. For example the entrance sign itself doe not offer a contract because it states the T&Cs are inside the car park. But the the two signs below may change that situation which is why we would like to see them. I have looked at their Notice to Keeper which is pretty close to what it should say apart from one item. Under the Protection of Freedoms Act 2012 Schedule 4 Section 9 [2]a] the PCN should specify the period of parking. It doesn't. It does show the ANPR times but that includes driving from the entrance to the parking spot and then from the parking place to the exit. I know that this is a small car park but the Act is quite clear that the parking period must be specified. That failure means that the keeper is no longer responsible for the charge, only the driver is now liable to pay. Should this ever go to Court , Judges do not accept that the driver and the keeper are the same person so ECP will have their work cut out deciding who was driving. As long as they do not know, it will be difficult for them to win in Court which is one reason why we advise not to appeal since the appeal can lead to them finding out at times that the driver  and the keeper were the same person. You will get loads of threats from ECP and their sixth rate debt collectors and solicitors. They will also keep quoting ever higher amounts owed. Do not worry, the maximum. they can charge is the amount on the sign. Anything over that is unlawful. You can safely ignore the drivel from the Drips but come back to us should you receive a Letter of Claim. That will be the Snotty letter time.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The funny thing is that they haven't got my address or landline number. I cannot think how they got the mobile number. I purchased the phone when I arrived back in the UK after living overseas for some years.

 

 

If you registered the Sim Card with the phone company then the Credit Refernce Agencies would have got hold of it and passed it on to their pals in the DCAs. Similarly if you filled in a warranty for say a new TV or washing machine and used the mobile number they would get it the same way.

That's a bit rum isn't it? It's a Tesco mobile and I can't recall what I had to fill out, forms-wise, to get it. I did complete a warranty card for the TV though. I wonder if there any DPA issues here? I purchased the TV with cash and made no credit application; in fact, I don't have a UK credit card. This bears looking into.

Oh Dear! :sad: It seems the DCA's are getting harassed on the phones by "debtors" and now they need to do a course to deal with the abuse!!!! I wonder if we debtors can also sign up for the same course?? http://www.csa-uk.com/UserFiles/File/Course%20Booklet%20harass.pdf

Oh is receiving at least 10 phone calls a day from one company - landline and mobile. We've sent the harassment letter - by fax and mail - and still receive at least 10 phone calls a day...

 

We've told them they are breaking the law and that we've sent this letter but it has not helped!

 

The other day we heard one of the callers saying "I'm just winding and grinding" to one of their colleagues. I assume this means "wind them up and grind them down".

 

Yesterday when they called for the 12th time I asked to be put through to a supervisor and was asked why. I said "because you have been faxed and mailed a letter regarding this harassment and I want to speak to your supervisor about your continued harassment." He said "we won't put you through until you confirm how you are related to X." I said "that's none of your f.....g business." That really upset him; he said if you use language like that I'll end the call. So I used the word again and another, worse word, and he hung up! Childish I know but it got a result...

 

Can someone explain to me why, when they have been told about 100 times that they are harassing us, that they are in breach of the law and they have been sent the harassment letter we should be polite to these people? If swearing at them means they terminate the call why not swear at them?

I quite like this approach....

 

When DCA phone I tell them how pleased I am to speak to them as I've been on my own all day and i've been really lonely and love to talk to people. I think reel off my opinions on anything to everything - from what Dot Cotton said on East Enders to how many times i've been to the loo in one day!!

 

They will try to talk over you, but just keep going, talking about absolutely nothing meaningful - they soon hang up!!!

 

They other fun method is answer why with everything. They seem to get really annoyed about that - can't think why???

I had several calls today from some reptilian firm of 'claims specialists' based in Liverpool.

 

Eventually I answered, intending to give the drone a piece of my mind. However, as he whined on in his awful scouse accent an idea formed....

 

Monkey: So, have you ever been charged for overdrawing your bank account?

 

Me (in the style of an elderly, confused man): Have I had my tea yet?

 

Monkey: What?

 

Me: You're not the usual girl, are you. Where is she? Who are you?

 

Monkey: (spiel about company again)

 

Me: I think I've forgotten to take my tablets. I'm 74, you know. Where is that girl?

 

Monkey: Are you not interested in getting some money back off your bank?

 

Me: This chair's very damp. I haven't had my tea yet, have I? Nurse! Nurse!

I once had a "doorstep collector" turn up at my door, it went something like this,,,,,

 

monkey, Hi is XXXX ( my sister)there.

me, who's asking,

monkey, thats private,

the sound of a door slamming.

30 seconds later,,knock knock.

me, oh your still here?

monkey, ok we've got off on the wrong foot,

me, no, like you said it's private and so is xxxx's whereabouts,

the sound of the door slamming again:D

 

he gets into his car and gets on the phone,

 

5 mins later I see him walking back up my drive so i go to the door,

 

me, your trespassing go away,

monkey, can I leave a message for XXXX,

me, NO, NOW Fxxx Off I'M RINGING THE POLICE!

 

I don't know why but I've never seen him since,:p I had not long before found this site and would of cr4pped myself before i had, so thanx again for all the great advise given out.

 

I should explain that this is a new account i'm using as the other was in my real name.

This one made me laugh out loud, one of the funniest things I’ve read in a long time, thanks yourturntopay, I needed that.

 

Wish I’d known about this site when I was getting the never-ending calls. Makes me feel sad that I can’t join in anymore (I’ve changed phone number).

Hi, I am new to this and can't figure out how to start a new thread! My query is regarding CCA request. I requested CCA info using a template found on theis site for 3 credit cards with Halifax, Barclaycard and Virgin on 17/4/09 by recorded delivery each with a £1 postal order. I have also cancelled my direct debits for the minimum payment, and have already had Virgin (MBNA) and Barclaycard contacting me for payment. My questions are:

1. do i have to make minimum payment in the mean time?

2. is there a step by step guide to what action i should take now? i have not been in arrears previously and am worried about my credit rating being affected

3. what do i say to the companies when they call me?

thanks for any help you can give, and apologies if i have posted this in the wrong place!

A DCA company called I think RMA have been calling us every single weekday for about a month now. We keep telling them there's no-one by that name here but the next day there's another call. They call any time of day, sometimes they call twice. We've just had to pay the £3.50 a month to get them barred from calling. I'm so angry I'm still shaking here. What part of 'don't call this private number again' don't they understand and why do they keep on calling?
