  2. I would really appreciate a reply regarding my query as to whether issuing a SAR is the right action to take. It's a matter of urgency as I'm running out of time to submit my defense/acknowledgement of service. Cheers
  3. I don't honestly know. Most likely not at the moment but maybe a few years ago for a good while they possibly could have been.
  4. Thanks. I cannot recall whether there has been a break of 6 years or not as my mental health has varied somewhat over the last 10 years. Do I issue a SAR to Horwich Farrelly to find out if I'm able to defend the case using statute limitations? Cheers for the help.
  5. Hi, I've been issued with a County Court Claim Form by Horwich Farrelly for an old Intelligent Finance credit card dating back to 2001. From the information I've found on this website and forums the only prescribed term missing is the 14 day right to cancel agreement missing from the signature area of the agreement. I'm wondering how best to proceed. Do I go for enforcability of the claim or go for a SAR to see if there's a break of 6 years without any communication or payments? I've scanned the documents (apart from T&C's) they sent in response to my CCA request.

  7. Hi all In a bit of a state as I received a County Court Claim Form whilst away from home. I only found out about it a few days before it expired. I managed to get it extended until the 13th/14th of this month but have struggled to find any solicitor who would offer legal aid to cover this kind of case. So at the moment I'm really up against the time limit without a clue as to how to move forward with my defense of the matter. Have tried reading the sticky regarding making a start but in my current mental state I'm not really taking it in If there's anyone who could spare the

  9. If I go for 1. does that mean they also wouldn't be able to pursue me for the debt due to the fact that the PPI agreement hasn't been honoured? From what I can tell/vaguely remember is that they tried to wriggle out of it by saying that the PPI contract didn't come into effect until the payment holiday was over. Looking back at it now I'm fairly certain that as soon as I signed the contract then the policy was valid? And what letter should I be using? Cheers
  10. Do I have to give them the choice or can I state which is the case? I'm assuming the multi-part agreement would be the best option here? Are there any standard letters that can be sent out to cover this/be modified? If they insist on pursuing this into the courts can I used the PPI contract as a defense that the debt should never have been pursued as the PPI contract was never honoured? Thanks for your help so far!
