  1. Hi All, I am hoping that someone out there can shed some light on the rights and regulations governing tenants and letting agents in the UK. In addition, if either party (in my case the letting agent) is not complying with the contract and UK governing law, what action can be taken? I am not currently looking to take formal legal action against the letting agent concerned, merely escalate the matter so that this situation can in some way be resolved without any further frustration and negativity. I can provide more details if necessary, but for the timebeing here are a few key points: No inventory taken (furnished unit) - Agent notified - No action No notification of visits to the property (24hrs written notice or other) by the Landlord or Agent Access to the property provided to contractors by Landlord without prior notification or agreement (24hrs written notice or other) Faulty appliances and household services only attended to after several months following various written requests Formal written correspondence regarding the above (the 4th or 5th letter sent to the Agent) results in a response from the Agent which is personal and unprofessional (this is their first acknowledgement and response to any of my letters relating to the matters noted above). Following the repair and replacement of various appliances and similar, which were found to be faulty on occupation of the unit, the Agent sends further inappropriate correspondence in his and the Landlord's defence. Regardess of the circumstances the Agent now threatens to give defamatory references to any prospective letting agents whose services I may wish to make use of in the future. In addition, the Agent involved will not provide the details of the Company Directors or Shareholders and they are not registered with any governing body. Any advice / comments are welcome.
  2. I used my grans freedom pass and got caught. I have phoned/emailed tirelessly to try and settle out of court but they are not backing down. I offered to pay triple the fine but its seems they just want to prosecute me. I don't care the fine I just can handle that I will get a criminal record as this is my first ever incident with the law and I am a student When is your trial date? have you settled out of court?
  3. My wife and I have been struggling financially due to my being unpaid for the first 10 weeks of this year and this being followed by me being made redundant. Following this I was unemployed for 2 months, I have now found employment as a postman but my take home wage is approx £1,200 less than it used to be. We are keeping up to date with all our priority debts, we have fallen behind with non-priority debtors, now we have written to other debtors and most of them have agreed our reduced payment terms, HSBC seem to be ignoring our letters at present. My wife's Sygma card passed it onto Dryden Fairfax solicitors, despite our writing to both Sygma and Dryden Fairfax with our offer of reduced payment they decided to issue a CCJ. We filled out the forms supplied by the court and sent them a budget statement giving a detailed breakdown of our situation, our statement shown that we had £135 available to distribute amongst non-priority debtors which we did on a pro-rata basis, this allowed £3.20 per month for this account. Today we had a letter back from the court stating that "The claimant has objected to the rate of payment you offered", it then states that the court has decided on a rate of £635.81 per month. There is no possible way we can pay this amount, I have downloaded and filled in a N245 form offering a payment of £20 per month, we can afford to stretch to this. Is there any other action I should/can take at this point ? Should I send a letter with the N245 form asking how the figure of £635.81 was arrived at and then explain our current situation ?
  4. Hi All I was wondering if you could help me. I was told to call Halifax to claim being miss sold PPI by a friend who received £3500 by calling Halifax. However I did this and I have received a letter from them stating that they believe I was sold the PPI Insurance fairly as a tick box was ticked on the application form and this must mean the halifax reperesentative explained the situation. I know I have gone about this all wrong , is there a way to salvage this claim? cheers wasp23
  5. Apologies if this has been asked and answered previously ( i have searched). I had a loan from GE Money with PPI, i wrote the 1st letter claiming miss-selling and they have replied, that the broker is resopnsible. The broker is Karcus ltd who they state is in administration. GE state that i should contact the administrators or the financial services compensation schemes. Is thsi correct?

  7. Hi everyone! I am new to this forum and struggling to find my way round. I have a Capital One card and decided last week to try to claim back the PPI I have been paying since 2004. I sent them a claim form last week which stated I didn't remember taking PPI out but had found a statement dated 12th January 2004 that has a payment listed on it. My argument is based on the fact that I didn't know I was paying it so it can't have been sold to me correctly. They have responded to me with a letter titled Payment Protection Insurance Review. Letter reads: "You have been protected by PPI since 14/08/2003. Your PPI can cover your Capital One credit card payments if something happens to you and you can't make them. The enclosed PPI annual review summarises your policy (please note for policies starting before 14 Jan 2005 no policy summary is included). However for full details of you cover & exclusions, please refer to your PPI policy document. Please take a few minutes to look through the annual review and check that your details are correct. If anything needs updating or you have any questions regarding this review, please call us on ........... We will write to you again in 12 months with your next annual PPI review. Thanks for being a Capital One customer." I have never received a review before and don't know why they have sent this to me and would like some advice as to what to do next. Thanks
  8. Hi, this is my first post so I hope I am asking in the correct place? I have a Northern Rock Mortgage and had Payment Protection for it with Liverpool Victoria to cover for redundancy etc. I thought I had to pay it for the Mortgage and agreed to their amount of £91 a month s they said I was high health risk after a nurse came round and took blood pressure and asked a few questions. (bearing in mind I dont smoke and and played football 4 times a week). Yes I was a little big, but still very active. I was told I needed to get down to a 36" and under 16 stone. I had to stop paying as could no longer afford the rate. Am I able to claim for this under the PPI claim? An advice would be appreciated?

To cut a long story short it is now around 6 years since I was last on the forum and in that time I've got myself back on top except for the usual insistance by the DCA's that even though they haven't ever supplied any agreements they will continue to register details on my credit file. Well I now want to get each and every one of them to admit they haven't got the authority to process my data and to then remove all entries and defaults from my file. I know the first thing someone's going to say is that at nearly 6 years all this will soon drop off the file, however as many of them are assignees they are trying the trick of registering new defaults on the date of assignment. I've got the money and the patience now to take them on one by one. So the question is where do I start? Cheers Ho Chi Min

  12. What if we get together against PPC. In number strength, dont know if someone came up with this before but surely its a good idea. My first post but just got an answer to my appeal from VCS, as expected got refusal. awaiting further communication. In main time Had some time to run through few forums and must say many people are angry with them . Why dont we all get somehow together, pay £5 each towards the solicitors costs, sue the b*****s and get all paid charges back - £5 x 1000 angry people = £5000 for a solicitor/barrister. We may get criminal (or not criminal) case for misuse and unlawfully claiming charges, pretending and fake papers, get insurance to cover our stress and losses. We all have some fake papers they send us. Why dont we bring them down. If the government cant do it, surely we can. We can make it big , get it into papers and other media, they will get scared. All we need is publicity and more people will find our case worth paying into. I bet it will be closely followed by millions! We can call ourselves GAA( check topic title for explanation) It would have to be a big head behind it all but if we manage to get it done we can take them one by one and they will bankrupt! I know its great idea but is it do-able?. What do you all think? [EDIT]

  15. Hello, I recently went to see an advisor from the c.a.b. for advice on my finances. The advisor suggested a DRO. I provided some basic information on my income and debts and we got a rough idea of my expenses and disposable income. The adivsor asked me to sign a letter approving them as an intermediary and said he would write my creditors a letter. I was planning on going to the Citizens adivice bureau on an appointment. so they could help me fill out the dro application form and get a more accurate picture of my finances. I decided not to go ahead with this so I called cab to cancel the appointment and not go ahead with the application/fee. Yesterday i received a credit report and credit summary in the mail, i don't know if i should just discard it or not. The advisor also said on the telephone that the creditors are still going to come to my house. Should i notify them i did not pursue the dro? should I expect a letter from them? i am not pursuing the dro at all.. thanks
  16. the carer of a client has made a complaint against me via a third party. i have not been suspended. if it does not become a formal complaint what are the potential outcomes? is a verbal warning a possible outcome and willi t affect my registration?.
