  1. Luckily you are in Scotland no POFA there so you can simply ignore it. Having any contact with DRP+ simply encourages them. You will receive a few letters then they will disappear, sometime through the letter sending they will morph into Zenith and offer you a reduced payment offer. Did you get anything from the original issuer?
  2. Nah you will win at POPLA with the genuine loss, I had a quick look on street view at the location is it were the Barclays bank is? If so it must be a honey pot for them especially when they were allowed to clamp. The signs are up on the first floor walls. DVLA : [email protected] BPA: [email protected] = Steve Clark
  3. I suggest you email your appeal to POPLA anyway, they may accept a late appeal but if they don't you will have further ammo to fire at ANPR. Still complain to the BPA and the DVLA.
  4. Well done hiding the code on your letter didn't work then did it.
  5. That will do except stick "allegedly" in before "observed in breach" they either have proof or they don't. Watch this company though they will issue a claim if you drop the ball. They get paid anyway so its win win for them. They got £120,000 from Aintree hospital trust and recovered £5000 nice init!
  6. Oh dear oh dear ANPR have given you a code XXX3193ZZZ todays code would be XXX3483ZZZ that is 29 days POPLA has timed out. I have looked over your POPLA appeal it waffles a bit but you hit all the points to win. However POPLA won't accept it! You have the dated letter and the envelope with the post date to prove they have been deceitful it needs to be brought to the BPA's and the DVLA's attention that this company is acting way out of line.
  7. It seems all these companies have to say is sorry it was an error and thats the end of it, its a pity DVLA are not so keen to except a motorist can make a simple error when there is a penalty they can issue.
  8. OK lets take it a step at a time 1 Ticket on car on 31-8-12 2 First contact on 14-10-13 What was this letter headed as it should have been a NOTICE TO KEEPER giving you the option to pay appeal or name the driver? 3 Your letter on 11-11-13 was it an appeal or did you simply say I was not the driver? 4 Their letter dated 27-11-13 giving the POPLA code it should read XXX3313ZZZ the first XXX is their code, the 3313 is the date of issue, and ZZZ is their number of refused appeals. 331 is the 331 day of the year ie: 27th Nov 3 is the last number of the year. The 14-10-13 first contact should have been a NTK and would have to be POFA compliant which includes. Which car the ticket relates to What land the car was parked on The period the car was parked Advise that the driver is liable for the parking charge and the amount and that it has not been paid in full State whether a notice to the driver was given either to the driver or placed on the vehicle and if so to repeat the information in that notice about paying the parking charge and when Specify the outstanding amount of the parking charge and of the maximum additional costs they may seek to recover, and of the dispute resolution arrangements Invite the registered keeper to pay the outstanding parking charge or, if he was not the driver, to provide the name and address of the driver and to pass a copy of the notice on to that driver Identify the “creditor” who is legally entitled to recover the parking charge Warn the keeper that if the parking charges remains outstanding after 28 days and the name and address of the driver has not been given, or otherwise known to the person entitled to the parking charge, that “creditor” will be entitled to recover the parking charge from the registered keeper. Details of the discount for payment within 14 days, The Discount should be at least 40% of the full charge under the BPA Code of Practice (applies to BPA Members only) Date of the notice You can PM me your appeal if you wish to look over.
  9. Very much doubt it an appeal is not a legal issue, if it got to a court case maybe, but i would not bet on it, there is normally a clause to get out of everything.
  10. If they chose to yes, its best to appeal, how did they know you did not have a child with you? What I mean is you could have arrived alone to pick a child up, or left alone after dropping a child off!
  11. The signs seem woefully inadequate Excel lost a case in Stockport because their signage was printed with a 13mm font, these signs even without them being hidden dont look to be anywhere near a large enough font.
  12. No its not if they are issuing charge notices they should be doing it through the DVLA. Unless you have agreed to the company releasing your details. Do you have a permit system?
  13. You could unofficially block them you know by sort of accident, maybe a van may unintentionaly park behind one when the silly driver has a habit of going home with the only keys!
  14. This was a windscreen job wasn't it? If so they have 56 days to issue the NTK. However they have not been POFA compliant as they never gave you a POPLA ref when they refused your appeal to them. They have then instigated debt recovery still without giving you a POPLA reference. Include everything you can but the killer is them trying to prove the charge is a genuine loss.
  15. Clamping or blocking would be illegal now. Your probably correct they are probably bringing the cars from some farm field where they have been "dumped" for a fortnight whilst the customer has been charged for their car being in a secure compound. You could slide a few flyers through some gaps advising the owners that their cars have not been stored correctly.
  16. As above relax now and enjoy christmas and the new year, I would guess at late spring early summer for a court date. You may be lucky the way its going for PE at court at the moment they may pull the plug.
  17. Yup thats what you will need to do, NCP will no doubt state its a contractually agreed amount and refuse your appeal. Luckily POPLA won't and you should win easily.
  18. I think the row of XXXXXXXX's under claimants solicitor should be striking through "claimants solicitor" which would make her the claimant.
  19. I don't see her here! Put Sarwar into the surname box. http://www.lawsociety.org.uk/find-a-solicitor/?view=solsearch
