    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It's in their terms and conditions and if they're phoning to check payment dates etc., they may add these as charges. I would check it with them to make sure.

Their share prices have dropped drastically recently. Most prob because of the credit crunch and their banking licence application being delayed. They've also stopped lending apparently and have made redundancies.

Yup they do, I have just got a full statement from them. £10 a call. One day I got 3 calls at £10 a shot:eek:

I wouldn't be surprised if they have lost a lot of income from people realising PPI is not worth it for them.

 

I have a car finance with them, car is great (got lucky but am now looking for some wood to touch).

 

I've seriously conned myself, as after all I accepted their high interest, and have been paying for over 2 yrs with no missed payments but loads still owing.

Direct Auto Finance & DLC dispute ongoing.

Offer with confidentually agreement from DLC / DAF DECLINED :D

I Realised my mistake and just wanted out so I executed my right (as per the contract) by asking them to collect the car after i paid more than half in 2005.

They charged me a fortune in interest just on the PPI, as well as the loan for the car.

I am now thinking of claiming back the money they robbed off me and the interest because they bullied me into taking out the PPI when i was so desperate.

I was made redundant in November 2008 and unfortunately still seeking employment. I only receive JSA (£60.50), housing benefit and council tax relief. The housing benefit is paying most of the rent, less £80 per month until 15th February and the Council tax relief is only £12 per week. At present I am in deficit of £60 per week.

 

I have two loans with Welcome Finance, one is a personal loan (£3689) and the other was for hire purchase on a car. I have succeeded in a Voluntary Termination on the car account, so it has now reverted to a none priority debt (£6002.26).

 

Since being made redundant I wrote to my local Branch and notified them of my financial situation and that I would not be able to make payments on the accounts for the time being. All started well with this, but they soon started phoning me constantly asking for payment, even asking me to BORROW money so that I could make a payment to them. With all this happening I sought advice from the National Debtline, who advised me on what to do. First thing was to ask Welcome to hold any action for 28 days and freeze interest and charges. This they refused to do. In one week the car account balance increased by nearly £100!!!

 

Still the calls persisted. I spoke to their Call Centre and they said I should speak to the Manager of the branch. This I did, and she agreed to not contact me until my circumstances change. Which is what I asked for in the first place. Still no mention of interest freezing though.

 

I then sent a letter asking again for charges and interest to be frozen for at least 28 days, offered a token payment of £1.00 per month and that all future correspondence be in writing.

 

Today, I received a phone call from the local branch, again asking me if my circumstances had change, even though it had only been three days since I had spoken to the manager. Again, he asked if I could BORROW money, to which I said he was out of order and acting illegally.

 

Should I know push forward with a complaint to OFT and the Financial Ombudsman? Or make a complaint to their complaints department first?

 

Any advice would be greatly received. These people are killing me.

can any one help with this i took the loan with welcome but land registy have it as progressive financial services can they do that my loan is with welcome den

I am relieved to have found this site and found the Welcome thread most interesting, my situation is that in Feb 06 I paid off a welcome car loan (for partners car taken out via YES Finance) and took out a new loan (i know seemed a good idea at the time) - since the loan was taken out there have been numerous problems with them - they tried to collect the direct debit on a differnt date to what was agreed usually a week or so before pay day so there was not always sufficent funds hence i incurred charges, the loan was then discussed with my husband without my knowledge or consent. In November 07 the property the loan was secured on was sold and welcome received a payment of £7k from the sale but say that there is still £10k left to pay - i cannot see how the loan was for £10k - can i claim the ppi they sold me and what can i do to get them to give me the right amount left? i cannot seem to get through to them - they want me to do a statement of means and thats come out of the blue from nowhere :confused:

We've been with welcome for a couple of years now. They've been mostly OK, we pay on time so we never really hear from them. The rates are rubbish but then we knew that when we signed up but we were desperate and we just rushed to get the money/car.

 

We are currently paying £195 a month over 5yrs for the car loan and £75 a month for an unsecured loan of £1100 over 3 years.

As it stands it is becoming more of a problem every month to meet the payments. Has anybody here ever successfully negotiated paying them a lower rate every month? We've not asked them yet, we are a bit concerned we'd lose the car which we really need ATM/

Hi Heidi83, thats a lot of money you are paying them back! I know the rates are terrible etc, but you obviously have the insurances etc for payments like that, don't you?

 

Please avoid re-financing with them, they will only trap you into a lot more borrowing over a lot longer. You could try making a payment arrangement with them (in writing, recorded) if you are struggling, or if you decide you do not need the insurances cancel them to lower your payments.

 

Unsure about the car loan, have not dealt with them much but that should be a last resort anyway and a long way off.What type of agreement is the car loan?
