I read Sparkie's reply and DCA guidelines/rules. I note with interest the section:

k. Ensure that collectors who use pseudonyms can

be identified within the member’s organisation.

I am in default with Amex and having to deal with RMAI Resolve/Regain (they keep changing what they call themselves) but are really NCO Europe. They have sent me some documentation following my request under the Data Protection Act but much of the correspondence is in code; such as "x was called by TAM1 and said....."

So are these DCA rules enforceable in any way?

Does a DCA legally have to provide all documentation, the did not supply a CCA to me or have Amex - any views?

Great to see a proper Credit Agreement, it now means the one i recieved from Barclaycard is my application form. Do i have to write to them now saying that they sent my application form, or do i just wait for them to default.

s.a. it looks kosher to me too! Its the same as mine from Alliance & Leicester. The key factor in my opinion is the proper terms and conditions of credit/APR etc. NONE of the "application forms" I have ever received from the rest of the DCAs on to me have had these terms and conditions, only A&L.

 

(((Mich))) I am so sorry to hear about your dad. I hope the police catch the **** who did this to him and they get their just desserts. I hope he is feeling better now. I was away last week so have only just seen this. Thinking of you and sending cyber hugs.

I see no credit limit on there . Nearest being a reference to 'over £600 ' . It says it varys, so maybe that would suffice thou ( .

I think it would too, Drexl, as catalogues do vary with their credit limits. Some give a set limit at the beginning and others (like Empire Stores for example) don't have a set limit. Their amount of credit is based on the conduct of the customers account. Vertbaudet seemed to have covered this in points 6 & 7.

Pugsley v Fashion World JD williams, 17/03 2008 Debt Managers returning file to JD williams as they could not supply the credit agreement

Capital one MCOL Settled in full

Smile lba settled in full

sorry to hear about your dad I get lots of trouble with teenagers here to, I would take photos whenever they are hanging around, it puts them off, (that is if they haven't got hoodies on).

i.would like to say a big thank you to you all, my dads okay, we have sorted it for him.

with my credit agreement i have recieved im going to write to the debt collectors and tell them my vertbaudet account is in dispute. and im going to send a S.A.R letter to verbaudet, any ideas on what i should write would be much appricated, do i just ask them to send me copies of my statements and send a potal order for £10.00 with this letter, i have seen the letter on this sitewhat to send when sending a s.a.r to banks, is it the same for catalogs??

Sorry for not being on here for a while.... my daughter has just finished her GCSE's and we are both shattered !!

 

The Agreement does look as if it would stand up and contains both signatures (yours being blocked out). However, this doesn't mean that you should pay more than you can afford.... so don't be bullied ! If you are only able to make token payments on the account, then that's all that they'll get ;) .... with all interest frozen, if applicable.

 

If you send token payments, then this should stop them from taking any action against you. You can still go ahead with the SAR.

 

I was so sorry to read about your Dad :mad: .... it makes me so angry to read about things like that. I am so glad he's on the mend now. Lots of love to both of you....

hi everyone :)

on friday i recieved a letter in the post from hillesden securities (acting on behalf of citi financial)

they write to tell me,

further to our letter dated 24th april regarding the above account i can confirm and advise the following...

 

1.we are foolowing up your request for a signed copy of your original agreement with our client citi financial europe, when this becomes available we will foward you a copy.

 

2.your account is on hold and all futher action has been suspended in anticipation of recieving the documents required.

 

should you require any thing further at this point please contact me accordingly, i will update you on developments in 21 days if there are no developments beforehand.

 

it then as the blokes name and direct number.

 

i do remenber signing a credit agreement for this card, shortly after recieving it. about 5 years ago

 

some thing els which ive decided to do, is make copys of letters ive sent and letters i have recieved from lowells and send them to trading standards,ive been reading other peoples threads who have done just this i dident have much luck with them when i emailed them, but im reading of people getting good responce when they send on the details.

shall i send them details of all my debt collectors becouse they all went over the 12+ 30 days.

also do i send this to my trading standards in gloucester or in the case of lowells to leeds trading standards where lowells are based???

hi everyone,:)

ive made copies of all my letters ive recieved from lowells(should i send originals or copies) along with copies of the letters i have sent to them, and recorded delivery slips, i know this is going to sound so dumb, but what do i put in the letter to trading standards?? sould i put in it, the fact they have gone over there 12+30 days they have to produce a copy of my signed credit agreement,the threatening letters they have sent me , and not forgetting the phone calls at my parents house,(which i moved out of years ago,and wasent even in debt when i was living there- they have my home telephone number of where i live now.)

also today i have recieved a letter from a debt collectors called C.A.R.S creditlink account recovery solutions limited.

it reads.....

confirmed resident

having conducted preliminary searchs our tracing division have confirmed your reidency at the above address.

we have been authorised by vanquis bank to proceed in whichever way we deem appropriate, within the boundaries of the law to recovery the money owed.

it is therefore imperative that you forward the full amount to the above address IMMEDIATLY by 1st class post.

failure to do so could result in any one of these actions;

1.instruct our local door step collection agents to make a personal visit to your home

2.recomend to the client to issue a registered default notice against you

3.instruct our litgation specialist COURTLINK to commence legal action against you.

so what i have done is printed of a cca request letter and im gonna post it out tomorrow

any advice on the above to do with trading standards would be very much appritated, many thanks michelle xxxxx

best thing to do is make an appointment and go in person with all your info.

Hi Mich, sorry for not getting back to you sooner, have been a bit busy lately..kids eh!!

 

Send copies of the letters to TS, keep the originals safe.

Put in your letter that they have failed to provide you with a CA, that they are still harrassing you. Also send them a list of all calls recieved and especially the calls to your parents home. Tell them of everything, any threatening behaviour, passing on your account whilst in dispute etc

 

Kenny has a good point there, if it's possible for you to go in person I would go for it.

 

Regarding the letter you've had from CARS, had you CCA'd Vanquis before they passed on the debt? just wondering...naughty of them to pass it on if you have.....maybe time to SAR Vanquis now?:D

i phoned my local trading standards this morning,the call got divirted to consumer direct, i told the lady all about the trouble im having with lowells, she said she will get some one from trading standards to contact me, she said they are very busy at the moment and it may take up to 5 days before the contact me.

sue..your right i did send a letter of to vanquis asking for a copy of my credit agreement, the debt collectors they were with then were called IMPACT COLLECTION SERVICES ive just found the recorded delivery slip, but... i got a big feeling i dident put the £1 postal order in it`,

doesnt matter, they cant PROVE you didnt put the postal order in, if they dont ask for the pound dont bother.

 

i didnt give one of my creditors a £1 postal order, they still wrote off the debt :-D

It doesn't surprise me that TS are snowed under....wonder why that is?...something to do with this site maybe haha.:wink:

Naughty Vanquis, not only have they not replied to your CCA but they have passed the buck...tut tut...def include that in your complaint to TS.

the letter i sent (cca ) i sent to impact collections, thats the one i have recorded delivery slip for, so why have the got another debt collectors on to me, i take it they are just making out they havent recieved the letter. xx
