  1. i would like to say a big thank you again to all of you on here who helped me and supported me with all your words of encougement .thru this nightmare. i dont here from any of the debt collectors regarding these debts any more, im still paying provident, i give them £2.00 a week, money owed is about just under £300, im ok wid paying them just £2.00 a week but thank you for the little known good advice dizzyhead90 i will def be keeping that in mind xx
  2. hi everyone its been a while since last logged on to this web site, i would very grateful if i could get your help again, a friend of mine is in a spot of trouble with some debt collectors calling him and sending him numerous letters. back in 2000 he had a morgan stanley credit card ,he honestly only remembers applying for one, and never signing any other documents apart from the first one. i wrote them a letter requesting a copy of the signed credit agreement i got the letter from this web site. Barclays wrote back and wrote a long 3 page letter explaining my friends rights as well as there own and attached 2 photocopied sheets of paper. the first one is tittled in big bold writing application form, and written under it in normal writing it reads credit agreement regulated by the consumer credit act 1974 . source code 107h5zzgf. it has filled in, his date of birth, full address plus how many yrs he has lived there, work address, bank address and bank details,statement date options, and payment protection insurance options,which the box no i do not wish this has been ticked. each of these are numbered 1 to 12, part 10 is tittled the agreement, which reads please send me my morgan stanley credit card and pin, it goes on to say that i confirm all details are true and that a credit check will be carried out . part 11 reads your signature and reads this is a credit agreement regulated by the consumer credit act 1974 sign it only if you want to be legally bound by its terms, my friend has signed it, and its dated 20]04]00 . part 12, reads your write to cancel, it says you have a short time to cancel, details will be sent in the Post by the bank. now its getting quite confusing for me please bare with me....a few yrs ago my friend told the bank he could no longer afford the repayments becos he was off work ill, the bank stated paying for his repayments via the insurance policy. 3 yrs later the bank tells him he can no longer have his repayments payed via the insurance, 3 yrs being there max time they will pay it. yet they are still charging him paymeny protection every month the second photo copy sheet they have sent is the financial and related particulars which reads about the APRs , i really need to try and scan this and get it on here, it is signed by i guess the person from morgan and stanley, because it reads for office use only. but the date has been changed, the original date has been written over,it was originally different day and month and changed to the date my friend took the card out.i know it could of been a simple error and a genuine mistake. some thing else i have a couple of statements they recently sent my friend, bare in mind he ent used this card in years, i read on the statement previous balance from last statement £1,927.38 22nd jan 2010 AXA payment protection £15.52 22nd jan 2010 interest on ur cash balance interest 2.000% £33.67 22nd jan interest on ur standard balance interest 1.527% £2.43 22nd jan interest on your default sum balance interest 1.527% 22nd jan new balance £1,980.20 any advice would very much be appriacted on what should we do next x
  3. hi everyone, every thing is pretty much the same,i only hear from about 2 debt collectors now, one to say they are still chasing up getting a copy of my credit agreement (that was for citi cards) lol, it makes me laugh becouse it was all the way back in april i requested it! some how i dont think they got it. the debt i had with capital one, it turns out was made up of all unfair charges plus there was extra they owed me, i had a company who claims it back for you, sort it out for me, just as it was about to be took to court they wrote a letter to say, they will use the money to pay of the out standing debt i have with them, and give me the rest back! but they havent told the debt collector acting for them, so i am still recieveing court threatening letters from them,which reminds me i really should write them a letter,and tell them to go and have words with capital one! im still thinking what to do with the unfair charges citi have chrged me.... do i try claim them back myself or have this reclaim company do it for me, the debt i have with citi is far greater then the unfair charges, so i dont want them useing it to pay of part of the out standing debt, and have nothing to pay the reclaims company. i know you guys on this wonderful web site will be with me every step of the way, but i am still quite nervous. a big thank you again for all you fantastic people who has helped me along the way, so much has been sorted out this year, and ive become more confident for it,im not afraid anymore it really is quite a amazing feeling, its so refreshing to know that there are people like you lot in this world who care and want to help others.   5. hi thanks for your reply, they wont replace the door, becouse i have already done this,out of my own pocket i was told a few months ago that i could do this myself, by two inspectors. i did this believeing the door was to never be replaced by a new one, ( the inspectors told me, the windows and not the doors will be done) now ive just found out the council will be giving its council homes new pvc doors as well as windows. the reason why im so upset, is becouse i paid all that money for nothing, the woman i spoke to on the phone told me the inspectors new all along that the doors would be replaced with the windows. and i should of wrote a letter to say what i was doing, i did not realise this, after all i had asked the very people the letter gets sent to, and they told me yes in person. i know its going to be my word against theres, but it is the truth, and im so gutted, i can not stress enough just how much money that door cost me and im so upset xx
  6. hi please dont think im a fool for what you are about to read, but 590 pound is such alot of money, and im gutted, ive screwed up big time. im sat here in floods of tears, i live in a council house with my 3 children, i am a single mother. a couple of months ago i contacted the council repair line, to complain about my frount door, it lets in the rain and has a whooping big gap at the bottom of it, they sent a inspector out to look at it, and he told me he will get a repair man out to re-seal it, and replace the glass, as for the whooping great big gap in it, he told me thats the design of the door, (yea okay maybe hundreds of years ago, i thought to my self) i asked the inspector can i put in a new front door at my own expence a pvc one, he said yes, as long as if you move you realise you wont be able to take it with you. i had also had this very conversation with another inspector who came out to my house back in july. (can i put in a new door) he said yes too. both inspecters told me that the council will be replacing the old windows with new double glazing ones,at the end of this year, but NOT THE DOORS, the doors will be staying has these are the standard concil doors. both inspectors told me yes by all means i can put a new one in my self. last week i had managed to save up the money to get my new front door fitted yesterday i recieved a letter in the post that i will be getting a visit from some one from the council to measure up for my new pvc windows and doors. i burst in to tears and phoned the council, i told them what had happend she told me i should of asked for permission, in the form of a letter, she said no one was available to talk right now and that a inspector will call me tomorrow, well today came and no one called so i phoned them at 2.30, i spoke with another woman on the phone, who to be very honest talked so down to me,i burst in to tears again. i told her what had happend and that some one was supose to call me today, she replyed, what for, what do you expect them to say to you michelle. i said i dont know, she asked me what were the names of the inspectors who said i could put a new door in, i could only remember the ones first name,and his second name sounded like finagun, i couldent help but snap at the woman, i started screaming down the phone, why are you talking to me this way, im a single mother who has just saved up and spent 590 pounds for a door that now there is no point for. i felt such a idiot, i felt like she thought i was making it up, when she could hear i was crying, she dident sound so harsh to me, she told me to write a letter and make a complaint,and i might have a chance of getting my money back. if any one out there could please give me some advice on how to word the letter i would be so very greaful xx
  7. hi gizmo, i requested a copy of my credit agreement back in april, when i had debt collectors threatening to come to my house and take goods ect, i do have a thread going about my problem with debt collectors,and alot of kind people are giving me support.it was on that thread i was adviced to request my credit agreement. it was before i had discovered this web site, that i got in touch with this company who trys to get back your unfair charges, to be honest at that point when i contacted the company,i would never of had a clue on what to do if i was going to do it myself. michelle xx
  8. thanks linz i hope the company will let me pull out they should do, they have just made 173 pounds of me with ca[ital one. im gonna tell them, if they use the same tactics as capital one did and use it to pay of my debt, there wont be anough money to pay them. michelle xx
  9. i would like that. but i do find the whole going to court thing nerve racking, im such a shy person lol, it is true though! will i be able to take of where the reclaim compay as left off? i would ent have a clue where to start! xx
  10. hi sequenci, thanks for replying, i had a credit card with citi financtial a few years ago, im no longer with them, back in aprill this year i requested a copy of my signed credit agreement, from the debt collectors the debt was passed on to, the debt collectors (hillesden securties) write to me,every once or twice a month to explain they are still in the process of getting it from citi financial, and as soon as they recieve it they will pass it on to me. i was gonna get a company to reclaim back my unfair charges from this credit card, the company are at the stage where they are sending me court papers to sign. but there fee is 25%, im not sure i will have enough to pay them, if citi use the money to pay of the debt. michelle xx the company has just got my money owed to me from capital one which capital one used to pay of a debt i had with them (all of which was made up of unfair charges, that was also about to go to court. capital one was another credit card debt i had that couldent produse a copy of my signed credit agreement,instead the debt collectors who i thought at the time had bought the debt of capital one, sent me a copy of my application form.
  11. no i dident do it, i was young and foolish back then, its all about the money at the end of the day, and companies like that would do any thing for a sale,including abuse there staff, and yes i know it was only a mobile phone shop, lol,thats what makes it very funny! but imagine what other huge companies out there could be up to, if a phone shop could go on like that! michelle xx
  12. hi caro EDIT i did tell them my situation about being in debt with all these credit cards and bank when i first started dealing with them. the lady asked me last night if i wish to continue with citi, they have already sent them a few letters, now they are about to take them to court. i did tell her yes, but im sure i could change my mind if i tell her, there wont be enough money to pay them if citi keeps the money to pay towards the debt. i requested a copy of my signed agreement from citi back in aprill,the debt collectors acting on behalf of them write to me every once or twice a month, to tell me they are in the process of getting the copy still. she said the court papers she needs me to sign are in the post, michelle xx
  13. i am happy with the debt being cleared, at leaset that one debt out of the way! im seriously thinking of doing the citi one myself, the claims company are sending me out court papers to sign and send back. if i tell the company i know longer wish them to act on my behalf, do i take on where they left off?, taking them to court, the thought does scare me a little, a the good thing will be the claims company has worked out how much citi owe me, and do i need to get hold of the statement copies the company would of got of citi?, the company might still charge me for them gaining the statements. ive already asked them for my barclay statements (the unfair charges with barclays were only 40 pounds, for the company to help you you must have over 250 pounds in unfair charges) ive got a feeling with citi, they owe me less then i owe them, i dont want to be in a situation where i will be in debt with company helping me with these unfair charges. michelle xx
  14. tell me about it, when i worked in my shop, i was told to go out looking for customers in the street,and give the blokes the impression if they came back to my shop they would get more then a mobile phone, i also got a warning from my area manager when i refused to go out for a meal with a customer in exchange for him getting out a multi contract deal for his firm, he apparently worked for. michelle xx
