Another question from me folks. Im filling in spready and because GE money havent supplied stats going back to Jan 01 (only from July 01) I am going to assume they charged me every month from Jan 01 to Jul 01 so I have filled in previous estimated charges box (never needed to fill this bit in before). I see it doesnt work out CCI on this, am I doing it right?

 

Also, slightly off the thread but does anyone know if I am ok to assume the charges being as they cant provide the statements (they also have some missing for Jan 03 - Jul 03 so I was going to assume them for that too) I have read threads about issuing non compliance letters etc and just wondered if I HAD to go down this route as it will take me ages to get my money back and because Im on maternity leave I need it sooner rather than later. Any thoughts on this please? :confused:

I hate all this and am finding it all very confuseing. I am in the process of takeing abbey to court and they are still being as obnoxious as ever.... My brother in law is a solicitor and so has put the claim in for me, but i need the schedule of charges. I had it all worked out at the end of last year, but only just discoverd that when i saved it the first 5 of the 6 years calculated didn't save!! Have just come to do spread sheet again and found that vamps chambers are offline for the moment. Last time i used the simple excell for word and i have to admit shed a few tears over it all as i realy dont get that sort of thing-just a mental blank! Anyway can any one help me with how to find a simelar spreadsheet else where to calculate charges?? The email linked to this is my other halfs and as he's not home until tonight, and in the hope that some kind soul will take pity and be able to help me out here fairly soon, could anyone e mail it to me at [email protected] ?

I think this has started to be discussed somewhere else but I can't remember where...but what happens if the bank have transferred all the money to me but not the interest?

 

How do I claim the interest?

 

You can send them a letter telling them that you accept the amount in part settlement only & that you will persue with a county court claim for the rest if neccessary ... that is a) if you want to proceed for the rest and b) if you haven't already filed court action :)

I wouldn't do that personally. The interest alone they may well argue about, and may be succesfull. The charges + interest, no chance, they just don't want to defend those in Court. I would send them a letter declining the whole lot, telling them to either pay the rest or have it gone from your account in 7 days.

How d'ya get 'em to take the money back tho ... presumably all you can do is leave it there unspent as u can't force them can you?

Yes that would certainly make sense. You would have to make sure you have written to them telling them this though so you can rely on it later.

Bit of a dumb question now!

I have sent off the pre-lim along with spready calculating contractual interest...dated 27/01.07

As i have had no response from cap one, i am just about to send LBA with updated spready(to accomodate the new charges!)...should i change the claim date or keep it at 27/01?...maybe i just havn't woken up yet, but i can't think what to do!!!

27/01/07 is just the date of your letter. The claim date is a date on your spready. It carries on until you are paid. Even if you claim through court, the claim date is one thing, but the date the interest accrues to is another. You're fine.

No. The date on your spready is the latest date. If you put into the date cell the formula "=TODAY()" it will keep updating the spready to today's date.

 

"Date of Claim" should perhaps be changed to "Date of Spreadsheet."

I don't want to confuse things, but when you are preparing to file a claim, you can change this date ti the date you will file on and it will work out your charges/interest into the future up to that date - just so you don't have to wait till the day you file to get it printed!

I spose a way of wording would be (for example) .. I've claimed £100 charges + £80 interest - You have made a part settlement of £100 therefore the outstanding amount of my claim is £80 at today's date (increasing daily) no need to mention 'you have refunded my charges but you still owe interest'

D'ya know I've always thought that ... date of claim wording should really be changed I agree ... 'Today's date' or just simply 'date' .... ? :)
