  1. HI, I recently posted asking if anyone knew how to get tax without the registration document as the new keepers suppliment had been sent off to DVLA, and althougth the car was officially taxed, the previous owner was disabled - try this link http://www.consumeractiongroup.co.uk/forum/vehicle-retailers-manufacturers/96533-d-l-advice-please.html to see the original post. Well there is now a twist - i have just been in touch with the dvla, who now have my application to change classification of the vehicle, but cant issue documents until the vehicle has had a VIC. All they will tell me as to why the car needs this is that is has probably been involved in an insurance claim, possible write off and they need to make sure any repairs have been carried out properly and it isnt two cars or more - ie cut 'n' shut. On top of this it will take about 4 weeks to get an appointment for the vic and all the time the mot is ticking away and i havnt got a car.Obviously i have no idea of the cars history, however there is a lot of broken windscreen glass all over the inside of the car... So it turns out the car i bought from a trader, for £180, on the road with tax and mot untill november, now isnt... i am hopeing the trader will out of good will offer me my money back on the car, however if he doesnt how do i stand legaly? As the car wasnt as advertised am i entiteld to my money back on it? Also if the car up until now has had tax, mot, and regisrtation documents with dvla, how come it now has to have a vic? What could have changed? please help, Many Thanks JS
  2. Hi , I wonder if anyone can give me any advice on taxing a car...? At he weekend i bought an old cheap run around car from a trader on e bay, with tax and MOT - or so i thought. Before veiwing the car i checked on the DVLA website and they said it was taxed until the end of July this year, we veiwed the car and the trader said the same and looking breifly at the tax disc it didnt register that the disc was a year out of date until we actually got the car home.. I have enquired with DVLA and it turns out the car was kept by a registerd disabled person, so was technicaly taxed for him, but i need to take the documents to the DVLA office in Maidstone to re- licence it as not disabled. The problem is i didnt get the new keepers suppliment from the Trader, as this didnt seem important as we thought the car was taxed. Having spoken to him he has sent it all off to DVLA, but was very apolagetic and has refunded me the cost of 2 months tax. The problem i now have is that i cant tax the car with out the registration document or new keepers suppliment, and DVLA say it will take about 4 weeks for the document to come back in my name, and until then the car is registerd in the disabled persons name and so therefore tax isnt due. So the advice i need is has anybody had a simelar situation recently and manged to get tax? Does anyone know of any ways round it without waiting 4 weeks? Are there any loopholes in the DVLA rules that anyone knows or has discoverd? All i need is the new keepers supliment from the old style document....
  3. Heeelpp! I hate all this and am finding it all very confuseing. I am in the process of takeing abbey to court and they are still being as obnoxious as ever.... My brother in law is a solicitor and so has put the claim in for me, but i need the schedule of charges. I had it all worked out at the end of last year, but only just discoverd that when i saved it the first 5 of the 6 years calculated didn't save!! Have just come to do spread sheet again and found that vamps chambers are offline for the moment. Last time i used the simple excell for word and i have to admit shed a few tears over it all as i realy dont get that sort of thing-just a mental blank! Anyway can any one help me with how to find a simelar spreadsheet else where to calculate charges?? The email linked to this is my other halfs and as he's not home until tonight, and in the hope that some kind soul will take pity and be able to help me out here fairly soon, could anyone e mail it to me at [email protected] ? Many thanks, Alice (Jay Smith)
  4. Thanks Nutty, this is all getting very stressfull, and like many others i feel like giving up- but if i do then abbey have won-and we cant let that happen!!! will keep you posted if i need anymore advice, Jay
  5. Hi All, I am also 'doing' abbey. I have done getting back statements bit, been through the microfice thing with them, and finaly got what i asked for. I then sent them the prelim letter, and got the 'sorry you're not happy, we'll get back to you sometime' answer. Well they did. I got a letter from a Mr Mark Treadwell, Senior customer resolution Manager. And they say, I quote: Having carried out a full investigation, i can assure you the charges do not contravine those regulations and therefore i cannot agree to refund all of them. However, as a gesture of goodwill, i am happy to refund £400.00. A cheque will be raised in favour of our Debt management department. The regulations say that we must explain our charges in plain language and that we have to act in good faith, which, according to the office of fair tradeing, means dealing fairly and openly with our coustomers. I therfore reveiwed the litrature and infomation you recived when you opend your account, including the terms and conditions. This explains that charges will be applied if you do not keep to the terms of the account.Because of this, i belive we have been fair and open in telling you about them. The charges were correct, becasue you did not have enough money in your account to cover payments requested from it. When i looked into the history for your accounti found that, unfortuanately, this was not the first time this has happend. You have asked that any default notices against you in connection with the charges aplied to your account, can be removed. As we have canceled the charges as a gesture of goodwill and not due to an Abbey error, i am unable to alter any information held with a credit referace agency, as this information is factual. It is however unlikely that any adverse information has been registerd against you in connection with this matter. I am confidant that i have been fair and taken into account all the points made in your letter, but if you have any additional points that you would like to discuss with me please call me on 0845 6006014. He then goes on to say that i can contact the finacial ombudsman if i am not happy with his reply, and encloses a leaflet from them. Also that he hopes he has at least clarified abbey's position. My points on this letter are: 1) he doesnt begin to explain how the charges are proportianate. 2) Abbey's own debt colection agency when my partner spoke to them siad i was already on the bad debt regiser, but he says it is 'unlikely'. So... What do i do next? the toatl claimed is nearly £2,000, so £400 is an insult. Do i just send the LBA as in not having an aceptable response? or do i need to write a diferent letter? Or do i adjust LBA to answer his letter and carry on the process of takeing Abby to court for the whole amount? Any help and sugestions most welcome please. Has anyone else had this sort of repy and what happend? Thanks, Jay

  8. Hi, Im sure this has probably been asked a millioin times before, so please forgive me for asking again.... But how do i work out the interest and the time/days on the spread sheets? I am useing the simple excell for banks as i am about to claim back from abbey. I have filled in all the charges but now need to fill in the other two colums for days since offence, and 8% interest. surely there must be an easy (ish) way to calculate ? many thanks JAY
  9. Hi, i am embarking on a claim from abbey. i have finaly ,and not without struggle, recived statements form them for the past 6years and am working out how much i want to claim. I am now going to send the prelim letter asking for charges refunded but in it you say 'I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX' and in the faq /advice you say not to include the 8% interest untill you are sure it is going to court... Im confused-what is the interest claimed in the letter? and how is it worked out? Also by schedule of charges claimed do you mean to write (type) out a list of all the charges and dates they have put on my account that i am claiming for? please help
