I can prove that I had to buy a new washing machine, I have my pay slips showing the emergency tax code and a letter from the tax office after I had spoken with them to get it corrected and of course I can get a copy of my vet bill. And all of this was in the first 2-3 months of 2024.  I panicked. Stupid I know and as you say, I have learned the hard way and I am not in any way denying anything that I have done wrong, but it just feels a bit unfair.  It is what it is I guess and if I have to have it on me forever then so be it. I am just so worried about the bank situation 😕

    • Hi @LilMissM   I guess you could call me our resident CIFAS Specialist - Personally have been through all of what you have and now have come out the other side when my marker fell off in May 2023. For a start Monzo may close your account but as I had a Marker for App Fraud (Vodafone ended up making a whole hoohah of the account I had with them) - I was with them and still am from Oct 2017 till today. And not once did they close my account. I actually spoke to a couple of current account providers at the time that I had accounts with - Nationwide and Barclays - Told them what was going on and provided all the evidence to them. They advised they may do so but it was highly unlikely now that they understood why it happened and what I was doing to fight it.    Anyway - On to your marker. MCB is My Community Bank?  I can say to you that on experience that On Monday you can be on top of the world then on Tuesday you whole life changes in a flash of an eye. Suddenly you cant pay your bills, Work isnt feasible and you are left with no other choice but to scrape by.  If this has happened to you, then join the club.  - Why is this important? Well Financial institutions get one whiff of potential fraud and you are guilty without a chance to respond. You found out the hard way   If it sounds like I'm waffling, I'm not - Its important to your issue. They have deemed you guilty by the fact that no payments have been made and potentially entered into a loan agreement knowing looking not to pay (Although thats how it may appear, there will always be factors against that)    First off - Questions - What Category of Marker do you have? If unsure, check my signature for a Credit File Guide which will tell you all you need to know about what Categories apply.  - When did you raise the complaint? They will have 8 weeks to respond. More on this in a mo.  - Do you have Correspondence / Audit Trails of communications showing that you were in severe financial strain due to an event AFTER you took the loan?   My next suggestions, Send this complaint to the CEOs office - CEOEMAIL.COM Let them make the decision as per the Complaint Procedure. Then if they refuse to remove the marker. take it to the FOS who can force the company to remove it if found in favour.  Some companies do need a slap or 2 once in a while to bring them down a peg. You could be looking at this right now.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

so many things wrong with this letter,

the additional charges are not due and arent contractual.

 

If they were part of some other contract as yet unseen

then they are an unfair clause of that contract anyway so lose lose for them.

 

Problem is that many people either pay up or if taken to court dont defend so the entire claim becomes set in stone wheras,

 

if challenged at least that amount gets removed from the claim and puts the judge in a mind to look very carefully at the rset when they wouldnt necessarily have done so.

 

dont forget,

NTK issued too late and wording is fatally flawed to create keeper liability.

 

IPC members have a new ploy where they dont issue tickets or NTK's in time, just advisory notes that money is due.

 

Obviously this drivel hasnt been tested in front of a judge yet so when you get the next letter (if from BWL or Gladstones) we will help you compose a letter to ask them about this departure from the law as part of a denail of any monies being due.

Well it not only you who are dealing with this Gemini Crap - I went for a car wash and now they have sent me the letter - I have already appealed them "that I went for a car wash" but they replied to me stating that motorist using this car park will have to pay - Unfortunately we are unable to take the mitigating Circumstances into this account.

 

The owner of the car wash is aware of this will update you further.

Obviously that is utter piffle but how are they supposed to earn a dishonest crust of they admit their ANPR system is rubbish and pick up the wrong traffic? It is not mitigation for a parking event, there was no event to create a contract so it cannot be breached.

too late to do anything other than that and they dont have a leg to stand on should they want to get tough.

 

Make them spend their money chasing you rather than rersponding to their garbage,

 

they will think you are a waverer if you do and just try a different set of porkies on you to get you to fall ontheir side of the fence

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Bailiffs only turn up when you have lost a court case,

failed to pay the monies due

and ignored the courts letters

and the other party has paid for their services.

 

 

You have to read and understand other threads to know what goes on rather than just guessing.

 

The debt Collection Agencies are people who get paid a pittance to write scary letters to make you pay them an inflated amount that is not due.

 

 

As many people think that dca's and bailiffs are the same they use this ignorance to prey on the victim and add unlawful fees to the supposed debt and write in terms that make it look to the uninformed that some awful thing will happen if they dont pay up.

 

The reality is that my cat has more rights to enforce a debt than they do and also could probably write a better threatogram as he walks on my keyboard to attract my attention.

OK Thanks I imagine next step is another letter in April saying they want £150 after that I assume we will see letters threatening bailiffs etc? thanks

always worth trying.

 

 

Make sure that you word the letter carefully so that it doesnt show the driver and keeper are definitely the same. so, unless your details were needed for entry into the centre you say my vehicle attracted a ticket when the user of the leisure centre parked it......

 

They may say it is all too late but you can remind them that the parking co are their servants and should do as they are told

had two letters come through yesterday from DCA called " Debt Recovery Plus"

 

 

quick google of them seems to suggest everything already previously mentioned on here

 

 

I assume the fact I received two on same day with slightly different dates is a scare tactic

 

 

My only slight concern now ( and this might be last of my worries),

is that I move in next month or so,

 

 

so were any court papers to be issued don't want to miss them.

 

 

Will look at doing a Royal Mail re direct cheers

If you had bothered to read a number of the parking threads you would have realised that DR+ are toothless.

 

You would be very wise to have your post redirected and even send a rude letter to the parking co telling them your new address for all legal documents to be served at.

 

 

That wont necessarily stop them being naughty but if they do try it on then they will have to pay for their sins.

 

 

a default judgement using the wrong address will get them a bill for the set aside,

your costs and the cost of a new claim,

 

 

That will be more than any claim could ever be worth

so even if they won the second time round

they would be hundreds out of pocket

so it is something they would only ever do once!

yes I had a look on here and on google, and everyone echoed the sentiments DRP are just scaremongering,

 

 

just nice to have it reaffirmed by yourself

- just one question on your advice

 

 

- I should write to the parking company about address change

ie Gemini and not the debt collector ?

Just do the redirect and dont inform the muppets. You set yourself up for further harassment.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
