Can National Collection Services repossess my ovens?

 

I own a small bakery/cafeteria and I have fallen into debt due to a downturn in business.

 

 

One of my creditors has a CCJ against me for around £5000.

Their bailifs have attended my premises

 

 

i managed to pay them £2000 out of my takings for last week,

but they have said that they will be back to remove goods some time this week

and asked the value of my ovens. Surely they can't take them?

 

They haven't been threatening or aggressive, but they were very firm with me.

I know they're just doing their jobs, but I',m not good with the law.

 

Any thoughts?

Are you sure theyre baliffs? They seem to be a DCA. ALthough i could be very wrong. If they arent bailiffs then youre being had

NCS are are not bailiffs

however I suggest the lot you had at your premises were HCEO's?

 

 

so who got the CCJ against you??

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

These do sound like HCEO, and yes they could well come back and take your ovens thereby closing you down, I feel this thread should be on the bailiff forum, to get more focused advice. I would advise OP to have site team change their screen name also.

My screen name is an alias, but thank you.

 

I'd rather not name the Creditor, but I do believe the gents who attended my property were HCEO. I was taken aback, so I don't even recall where they were from other than that they represented National Collection Services.

 

I thought they may be prohibited from taking any goods that assist in my earning a living, which I guess is why I asked the original question.

the only thing that puzzles me is - if they represented the clamant, they'd say so.

not say they were representing NCS that was all.

I assume you got a receipt for the monies handed over previously? This should tell you who collected it.

 

You make comment about them removing your ovens - are these hard wired & are they on a 3 phase supply?

It may be that NCS are acting as asset recovery agents under the terms of your contract. Like many car finance agreements, the creditor usually has an option to recover their asset without the need for legal action and an order for delivery.

 

I do not believe that NCS are acting as HCEOs in this matter as there is nothing to suggest so on their website.
