      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My son has somehow bricked his phone after trying to download a software. We've had this phone for less than 7 days, can we have it replaced? The network provider is vodafone but we got the phone through mobile phone direct online. Who do we approach in the first instance.

. This is a two year contract phone. Thanks for any help given.

How do you mean bricked? Was it an official OS update? Or has he tried modifying it? If the former, then yes, the provider or retailer can sort it. If the latter, then nope.

 

You need to be specific and define what you mean by 'a software'. To me, it sounds like he's tried modifying/routing it and messed up.

Can you give more detail? Because its really sounding like he was trying to install a custom rom. In which case, it is very likely that youre out of luck, unless the phone company decides to be compassionate.

SO he tried modding the phone which in all likelihood invalidated his warranty. The best thing to do now is call the phone company or the place where he bought it from and see what they can do, if anything.

 

Also, depending on the phone and model number, you might be able to do a sequence of keypresses which reverts it back to its default state.

Doesnt matter. The phone worked fine, until your son tried changing the firmware. As i said. If you cant find out how to revert it back to its default settings or pay to have it done, you are wholly reliant on the goodwill of the phone company/retailer to sort it for you. Most will simply tell you its your own fault and you are liable for the rest of the contract ( as the sim can still be used in other phones). Some however may be able to help. Youll just have to ask.

So the sale of goods act doesn't apply? It's a 2 year contract.

 

The sale of goods act most certainly applies to the sale of the phone, but I can't see how that helps you.

 

Was the phone of merchantable quality? Yes, it was fine until the unauthorised software update that isn't covered under warranty.

 

Was the phone fit for the purpose for which it was sold?. Unless your son told them "and I want to install unapproved software which could 'brick' the phone", and they agreed it should do that, they haven't breached the Sale of Goods Act

1979.

 

What part of the Act were you planning on relying on?

If you bought a new car and took it racing on Silverstone having drained all the oil .... You can't use SOGA 1979 to complain when the engine seizes.

He should go to the XDA developers forum where there will be a subforum for his model phone. http://www.xda-developers.com/

 

Chainfire is a very helpful developer and will very likely be able to advise as to what - if anything - can be done.

 

If the phone is in a boot loop - then it is not entirely bricked and there may well be a way to get it functioning again.

He was trying to install chain fire 3d a graphics firmware. It was suppose to reboot but it went into a boot loop.

 

Did he read the requirements for Chainfire3D first:
