    • Rather than dsunaks lies, lets look at the reaL Data and real black holes in the UKs budget - all created by the poop Tories   Public sector finances, UK: April 2024   Main points Borrowing – the difference between public sector spending and income – was (a black hole of) £20.5 billion in JUST April 2024, the fourth highest April borrowing since monthly records began in 1993. Borrowing in April 2024 was £1.5 billion more than in April 2023 and £1.2 billion more than the £19.3 billion forecast by the Office for Budget Responsibility (OBR). Public sector receipts grew by £1.6 billion compared with April 2023, however, this growth was outstripped by a £3.1 billion increase in spending over the same period. Since our March 2024 publication, we have increased our initial estimate of borrowing in the financial year ending March 2024 by £0.8 billion to £121.4 billion, now £7.3 billion more than the £114.1 billion forecast by the OBR. Public sector net debt excluding public sector banks (debt) at the end of April 2024 was provisionally estimated at 97.9% of gross domestic product (GDP); this was 2.5 percentage points more than at the end of April 2023, and remains at levels last seen in the early 1960s. Excluding the Bank of England, debt was 89.9% of GDP, 8.0 percentage points lower than the wider debt measure.     • That's very interesting to hear! I received a notification of a CC verification from Coles in Australia on the 12th May - also a Sunday evening. Not having been to Oz for about 30 years I was somewhat suspicious and so immediately cancelled the card. Guess what, it's the one I use to pay Lyca with........... If you've got any further information I'd be interested in hearing it.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I'm in need of some quick advice for a friend please,

 

My friend has had the bailiffs at her door this morning for her X-boyfriend unpaid fines

Her X-boyfriend hasn't lived or been with her for over 9months now,

 

She wants to know what to tell the bailiffs as they are coming back on Friday

& said they will get a lock smith out if they need to get in the house, (Nothing in the house is his)

She told them he don't live there any more but they are insisting on coming back to seize goods.

 

I told her not to let them in but she is panicking any help will be much appreciated thanks.

Tell her to go to a solicitors, and swear a Statutory Declaration, getting 3 notarised copies, send one to the bailiffs company stating he is non resident, since 9 months ago, and all goods & chattels (property, TV Stereo etc) in and arouund the premises are hers soley, he took his property with him when he went. and pin a notarised copy to the door for when the skank calls on Friday What bailiff firm is this?

 

Tell her not to let them ibn , amd if they shout bawl and catawaul about police and locksmiths, she should phone the police and tell them she is being threatened, and that the debtor has long gone and the bailiffs are trying to force her to pay a third party debt by fraud and intimidation.

they CANNOT force entry once told he no longer lives there

call the police if you have too

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If as DX has said he is not registered to vote at that address then technically she can tell them to Foxtrot Oscar, but as a safety precaution a Statutory declaration should be a safety net, as she likely is minus recepts for some of her stuff, if they ignore the Stat dec, and carry on trying to force her to pay up, they will be in a whole heap of trouble, and she can call the old bill to remove them, if the copper sides with the bailiff after being shown a stat dec the copper would be in hot water also.

Excellent thanks Hallow, that will do her nicely, print that off for her Pedro, and get it witnessed at a Solicitors, and get three notarised copies, one to sent to bailiffs office one to show bailiff and police when she has to call them to remove the skank from her doorstep, and one spare for her to keep safe .

Post back to keep us in the picture the bailiff has no right to take her property, or threaten to remove her goods for a third party debt period.

I done the exact same stat dec for someone went to the solicitors with her the only question the solicitor ask her was do you have anything on HP (goods on hp don't belong top you till their paid in full) so if she has goods on hp you might need to amend the stat dec it cost her £5 I faxed it over to swift bailiffs for her and she never heard from the bailiffs again
