Hi i went to sign on today and the advisor said that in her opinion that i had not tried hard enough over the last 2 weeks looking for work and have stopped my JSA and has been sent higher up for a decision to be made

 

Ive done my work search as i have always done for the last year and not had a problem until today

 

Im a 43 old man with a partner and a disabled son im at wits end and worried sick and wondering what to do

 

Ive been a driver for 20 years and last year lost my licence and im having a nightmare finding a job as thats all i have done but the job centre dont understand that

 

Ive never missed a signing on, im going to a work programme with seetec and looking at doing a 3 months course

 

Im thinking of moving out just so my partner and child can get some money again

 

Any help would be great thxs

Has your JSA been stopped or have they said they're sending it to a decision maker? The decision maker has the final decision.

 

 

Sorry im all over the place as im worried sick, they said it has been stopped and have sent it to a decision maker

Your claim has been referred to DMA to consider if you have been actively seeking as per your current Job Seekers Agreement.

You claim will be suspended until the decision is made and it will either be allowed, disallowed for one week or disallowed for 2 weeks, this will come under the old sanction rules and will be considered only for a 2 weeks disallowance.

Can some one clear this up

 

I have been actively seeking work but i have not applied for any jobs in the last 2 weeks as there wasnt anything out there that i can do and within the hours i can attend work

 

Because i havent applied for jobs this why they have stopped it?

 

Also how can i apply for jobs that i have no experience of doing thxs

How long have you been claiming? If it is more than 26 weeks then you are expected to look for an apply for all jobs your are qualified to do and also capable of doing.

You can only appeal the decision once the outcome decision has been made.

The first thing to do if you are disallowed is to request a reconsideration but you will need to provide further information regarding your job search over the previuos two weeks in question and state if the decision is not favourable that you wish to appeal.

The reason for this is the time element mostly as a reconsideration is looked at fairly quickly where as an appeal can take anything up to 6 months to be heard.

Welcome to the system! Of course jobs are not there (I've found mine through a referral and not through the JC+). Unfortunately you have to be creative when filling your fortnightly form. I sympathize with you but realistically I think you have little chance to win this case and I hope I'm wrong.

Well we heard back today and we have a 2 week sanction

 

I spoke to the decision maker and she said i have not tried hard enough, i should be going about with CV in hand and knocking on employers doors and handing them my CV telephoning them getting peoples names and putting them down on the work search form

 

It is not acceptable any more to look in the Newspapers Look on the internet or Visit the job centre as a sign of looking for work you need to have the names of companies and contact details put on your forms

 

Well im sorry but to keep them happy ive just applied for any job by email just to keep them happy

 

Funny thing is i received a text by the job centre telling me to apply for a job by sending my CV by email which i have done and the bloody thing has been returned 3 times Delivery Status Notification (Failure)‏ they haven't got a clue

Keep all the delivery status notifications, I've had those from jobs too they sent me for, and one job was closed due to too many applicants, and they gave me that job at 9.30am, I applied straight away via my phone and showed them the response then and there - they did not like it at all.

 

I also rubbed it into them that it also proves I know how to use technology to my advantage and therefore didn't need their basic IT course!

 

Keep every email you get from applying for jobs, and write on the form when you telephoned people, and the number, play them at this game for as long as possible - after all they KNOW the older you get the harder it is.

Oh and i forgot to add i wont be appealing against this, instead i will we using the money whatt my parents had given me to get my Driving Ban reduced by 6 mnths as i will be needing it to live on and pay the remainder of my rent

 

So now my ban wont finish for another 9 mnths because of them, so i will be claiming even longer i suspect than i was hoping for as i was getting my licence back in 3 mnths

 

Oh well

If it's because you haven't neen deemded to have been actively seeking it is a 2 week disalowance of benefits not a 2 week sanction.

What is speciifically mentioned on your JSAg? Does it categorically state visit x number of employers, use gov.uk/direct.gov.uk x number of times each week, specialist/local papers x number of times per week etc.

Do you have restrictions are in place regarding care for your disables son or other caring responsibiliteies?

 

Just thinking in type to see if there is anything else I can advise on for you to request a reconsideration. (just in case)

Can I ask an additional question on this subject? My JSAG is 25 weeks old and I am on the Work Programme. I have read elsewhere on this site (without the statement being qualified) that a JSAG only lasts 13 weeks and no longer applies when I am on the Work Programme.

 

My JSAG says I need to do 3 things to find work a week. In the last fortnight I ony found one job to apply for directly having applied for others via agencies. They are trying to argue I have not complied with tht JSAG, which is the above is correct is inaplicable anyway.
