Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

AJACS pronounced AJAX is an electronic diary, each Jobcentre has one, appointments are made in the AJACS diary for such things like counter payments, handing things in etc etc. Contact centre staff can book a appointment in the diary, if someone calls up and needs to go into the jobcentre, we can book people in as well...

I can't believe people get £1400 a week on benefits even if they have a couple of disabled kids. The most anyone can get on DLA is £131.50 per week and there is no way they'd get that if they didn't deserve it and need it. Besides most (or even all) of that would go on expenses most do not need to fund.

 

I don't know how much one gets for kids, but the rate for a couple is only £111.45 (as a pensioner couple we spend more than that on our weekly food shop) per week, those under 25 only get about half that.

 

I got all these figures from the gov.

 

You'll never convince me people go through all this by choice.

some couples can have eight to ten childrem, the couple ususally has DLA each so couple disabled premium, Carers Allowance , so this gives them CP. Their grounds to I.S can be Carers or IB

 

lots of the children can have DLA full awards, we pay just under £65 per week for each child, plus the children with DLA get DCP, and sometimes EDCP. can add on £80 or more per child extra for the children with the DLA

This can all add up, now add on housing benefit.

If CTC are in payment as apposed to I.S then similar amounts are paid

 

There is not much difference in the amount paid for an over 25 and a child.

And strangely if the customer is under 25 and lives on there own, the child would get more and they live with their parents

 

I agree nobody would choose this as a way of life. :(

But the issue is that here, on this forum, we wish to provide a place where people can get help with their benefit problems without being judged. So we have some rules about how we discuss things. Point taken thanks, i do have very strong views and opinions about the system and certain people using the system and believe things won't change for the better if there isn't enough support to bring about the right changes so the system is used correctly.

Pointless to worry about these thing when they pale into absolute insignificance in the face of the complete chaos the introduction of UC will precipitate. The benefits system will probably simply cease to be when that happens. Maybe that's the plan.

our office has been chosen to process UC, I think one of eight offices around the country, the benefit system we have now is out of date, UC is coming in can it be any worse then the mess we have now? who know we will have to wait and see...

They are bringing UC in, in stages, the benefit system will not cease beleive me

I think your right mikey it wont cease but think it will be more difficult to access...but time will tell...however, I am more concerned with the influence of big private companies with their hands in this particular pie..and can envisage the day when public servants will no longer be needed to do the role you are doing at the moment...and I can honestly see companies like w2w being given the responsibility to decide and pay who or who is not eligible....they are already attempting to push the public sector to the limit...work longer, harder, for less..pay more for your pension for longer...look at the possible savings they could achieve if they did this...minimum wage...easy system to administrate.....one universal credit...dont need public servants now to do this job.....

nothing this lot does or will do no longer surprises me...disappoints me but not surprises...and it would not be beyond them to do this......I am in wales so regional pay here for public servants has already become an issue with the teaching profession, medical, nursing staff etc...divide and rule...

The Sanctions are pushing the country into poverty in a big way. I'm currently unemployed but busting my backside trying to find the jobs that just are not there.. They are filling our country up on immigration and then sanctioning us when we cant find jobs...

I lost my job as a construction worker because it was cheaper for my employer to take on 2 polish guys who have no regard or knowledge for health and safety, so i was paid off....

I was Sanctioned for 6 months in total 4 weeks, then 4 weeks again straight away another 4 weeks, then slapped me with 3 month sanction all straight after each other.

All because i had to return to Glasgow to attend court and be a witness against a polish man who raped/gang raped and abused me. He got 16 years in prison after a 2 week long trial( was over the papers and everything), and in those two weeks trial i missed 1 job center signing and 2 work program appointments due to the trial, (that they were fully aware of, even had court letters and numbers to speak to legal representatives, prosecutor fiscal everybody but the judge himself) so they saw fit to sanction me 4 times for 6 months in total,. My sanctions only just finished in October last year, yet even now, i only receive £25 per week as i am currently having over £100 taken from every payment because i am now paying back rent and council tax arrears that happened due to my unfair sanctions. £25 a week, thats less than i was getting on hardship allowance on sanction, and im still expected to starve and use this money to find work, ooh and did i mention i am a single parent with 3 kids, whos on the verge of doing something illegal just to put food in our mouths.... The state of my counrty brings me to tears, the state it has left my family in has me on the brink of doing something really desperate and probably illegal.....

unfortunately mark there is one thing you have to learn whilst being on benefits.

 

Do everything they tell you. It is a joke yes but unfortunately getting angry won't help you. For future reference just do anything they say no matter how dumb. It's not too hard and you just completely avoid sanctions. Apply for enough jobs per week, turn up on time, keep your head down and you'll be ok. Hopefully you can claim hardship and I would also try to appeal the sanction if it goes ahead. Send evidence of all the jobs you have applied for and say you didn't apply for 1 job that was too far away and you are doing everything you can to look for work. Just apply for any jobs they give you probably won't get them anyway and it keeps them quiet.

Sorry to hear about your sanction Mark I know how nasty these things are after been on the receiving end so many times myself.

 

Get all your evidence together for the DM (Decision Maker) and if that is refused you can go to an independent appeal and put your case forward in person.

As already said on here, do everything they ask and give them no reason to sanction.

 

I just signed on, on Wednesday and was going to get a sanction if I had not signed up to the UJM, Created a profile and uploaded a CV, Even though

I have just gone through 5 months on the NEA getting my business plan signed off to come across another problem with the NEA loan providers not

wanting to touch me with a barge pole with very bad credit so back to JSA.

Even though I had a 16 page letter of reasons why I could not join UJM, Fake jobs, Scams etc.. I knew I would be sanctioned as I failed a direction so did

what I was told and safely joined the UJM site with a redacted CV and limited information.

 

Same day a guy before me almost took out my adviser as she sanctioned him and security had to be called to get him to leave.

I can see some JCP advisers getting really really hurt sometime soon, People would be better of in jail than living with no money.

 

The whole system is starting to fall apart, No matter if you have paid into the system for the past 20 or 30 years now that means nothing.
