    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on.     • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Owed them when you set up the plan? As they keep on

Maloni, please please report their joke of an 'offer' of the 2 x £270 to the OFT, if you do not you are wasting time posting on here - remember the OFT is doing an indepth investigation into the murky market that is payday loans and needs all the evidence it can get.

Get their email to the OFT, they cannot charge more than the original loan, and it is against the guidelines in debt collecting to charge set up fees for arrangements, they are taking the proverbial.

 

I thought they were allowed to charge interest, just not above the clearing banks base rate. What you said about penalty fees though i completely agree with.

Thank you for your advise, I have sent through the details to the OFT and I have contact 1month informing them I have done this and will not be paying their standard interest and will only be paying off the original loan+interest at £585.

There we go, once you let them know you are not a rollover (no pun intended) they then have to either accept your terms for repayment or be reported to the OFT.

 

Please make sure you stick to the arrangement as if it falls through it will not look good for you.

 

Don't forget to repay them from an account other than your main bank account, you don' want it accidentally raided.

pounds to pocket now agrred to a repayment plan.....thats 10 PDL that have reasonably agreed to help me clear the amounts

Good luck with minicredit. You'll want to throttle them before you get one.

Quick questions guys.

 

If i set up a repayment plan with a PDL but then need to change it due to my circumstances do they still have to accept it under OFT rules

They can take it under consideration and also your revised financial circumstance. OFT guidance says they must not escalate repayments to an amount that is out of your reach. So if your circumstances change so much that you need to lower the amount you give them each week/month, as long as you can provide proof of it, there shouldn't be an issue.

just a quick update guys....slowly paying of all 10 PDLs each month and hopefullly ill be rid of these parasites in 12 months....never again will i get myself into this mess

just remember to pay only what you can afford....do all correspondance by email...dont let them bully you...they tried and failed with me

Had a guy from PayDayUk like that yesterday. I quoted the protection from harassment act 1997 which seems to have calmed him down

Hello again forum...hope everyone is winning the battle against PDLs

 

I have a question which I would appreciate answering.

 

I downloaded a copy of my noodle credit report ...which is currently 1/5 however when looking at my history all the PDLs that I ever had but were repaided ONTIME are showing as settled.....surely this should be listed as "paid on full" otherwise it reads like that I haven't met my contractual obligations? I have about 30 loans which were repaid on time

 

Any info would be appreciated thanks

There you go.... Having that many loans recorded on ur file is bad for you... looks like you are credit hungry,especially if they're close together.

Although Noddle is not always up to date and accurate with its information so on the next 30 day refresh it may have improved.

 

my husband is only got 3/5 but his is because he has no credit history except his mobile phone so that goes against you too... but yeah you should try with experian and see what might be on ur experian but not on noddle., x
