I have considered that but the keep trying to take the full amount from my card Im worried about giving new card details to make a payment now incase they take all my wages. They tried to do it so many times on my old card my bank fraud dept called me

 

Ask them for their bank details and agree to pay by standing order only.

Well, in my opinion - no. I think most people now offer them the original loan amount plus one month's interest. If he tried to take you to court for the full amount including charges, he would have to show the judge that the charges were justified.

That is the way to do it. Don't be afraid of them, you take the upper hand. If they should tell you that isn't possible, you say then I can't pay you.

If the situation really is as bad as this - go to the media. There are non judgemental journalists out there waiting to hear accounts and get them published - it is news now how people are being dealt terribly with by these companies in default situations and maybe this will bring some relief to you and prevention for others at the same time Name and shame to the world don't be afraid - thats what these companies rely on x

he has one called sexy payday, i have seen others too! I have had a nightmare with this man, he emails general emails to a BCC mailing list threatening court action (have u never noticed the email is to himself) he tried to tell me he had a court order against me for 2k which he didnt, after pursual the court action was for £400, he tried to bully and harrass me into paying back 2k but I wouldnt stand for it, I have endless email trails of me trying to make an agreement of repayment plan with him and to no success, he is a shame to the human race and should not be able to hold a job never mind own a company.

Have to agree the guy just wants to make what he can with scare tactic on another note Does anyone else get calls from the raglan hotel as well Im confused by this as when I call them back they say it must be a guest but I know noone there or anyone has ever stayed I mentioned payday o/d they put the phone down.

Jeez... I recall spending 2 nights reading a thread about Mr Hart and his tactics. Just type in "paydayoverdraft" into the search bar and look for the thread with the most replies. An interesting read.

 

Mr Hart reads these forums. You'll see in the other thread that he identified the op and questioned his postings on here.

 

Words can't describe this man and the way he does business. I can think of a few that come close... But don't want to be banned.

 

I know court is a daunting thought, but the more of Mr Harts customers that defend themselves in court the better.

 

He needs closing down and quick...

Hi I informed him I was going to enter into a DMP he said basically ok but im taking you to court now. I replied saying ok but ill be challenging your charges. It went quiet for a day then more texts and emails saying set up a plan I said look I will set up one with you but my debt management company will deal with you.... Now I have started geting texts a 10pm -10:30 pm he has also added me on whatsapp messenger (an iphone application) I have jkept these texts and emails I even commented to him this is harrasment he said look at your T and C's I can persue you for this debt. Please can someone help with what to do this is stessing me out and all he does is add charge after charge including £5 per text

Please report this insidious practice to Trading Standards and the OFT.

As for all his silly charges-unlawful and as such can be reclaimed (if you have actually paid them)

If he does try to circumvent the dmp by taking you to court, you could try getting a time order

thanks everyone I think I may just let him take me to court. If he sells the debt on tho how does that work in that obviously I want to challenge the crazy charges? ALso is he allowed to be contacting me after 9pm. Found a picture of the guy on his linked in profile where he also said he created a black list for people who didnt repay payday loans on time surelt a breach of data protection laws !!

Why bother with a time order when what he is claiming is blatantly unfair, unjust and profiteering. A complete defence should flatten this claim.

 

Is there a total *legal* defence rather than partial admission?

I think there is more chance of Camelot taking you to court to force you to take a share of their leftovers than this man doing so. To do that he would have to expose himself to questioning and all his texts and phone calls will be revealed, he wouldn't want that when he can frighten most of his clients into paying.
