    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have used EPDL, but my situation changed and I am unable to pay it back. I have written letters and repeatedly asked them to contact me by letter and not by phone. EPDL have called my work, mobile and home number. Not only have they been harrassing me, but they have phoned home and spoke to my wife about this debt.

 

I have cancelled all cards, but they repeatedly re-set up direct debits, when asked not to. They have not sent me bank details and have not replied to my payment proposal. I refuse to talk to them to get into a payment plan I can not keep to.

 

I am sending a letter stating harrasment by phone, I do not give permission for them to set up direct debits.

 

Anyone having problems? Wish I never used them.

Bonus77, be in your situation 10 times over. get over it, they are going to talk to you, work out a plan that you can afford and begin by answering your phone and offering payment. I swear to you, that if you didnt ignore them in the first place they wouldnt of have to call more than once, trust me. Anyway, once an agreement has been reached, ask them to email confirmation and confirm bank details and that's that... easiest, simplest and cheapest way forward. good luck and keep us posted

Nice piece of advice there!! Strangely enough I work I can not answer my phone, as well as work in a open plan office. I have luckily received a pm from someone who informed me it was harrassment. Not only that there are letters on here so surely letters suffix. Also talking to my wife is surely against confidentiality???

 

That was rather harsh considering it was a question! In future, giving advice that is clearly unhelpful with dealing with problems when my wife is a nurse and her shifts have been cut! Through no fault of my own!

look, forgive me for being blunt for you, if you really want to deal with the situation tell them to call during your lunch break and you'll speak to them. if you really think that some harrasment letter's going to work you've got another thing coming mate... everyone who's got the situation sorted has had to go through this, or it will not stop... i assure you that if you answer the phone they cannot harrass you because they'll be NO POINT! you do what you want, but think about it logically, this company is nothing but a loan shark and i'm up against them just as much as you, the only difference is i NEVER ignore them so they hardly EVER call, if they call at work i answer and ask them to call on my mobile so i can speak, walk out the office have the conversation, if they agree great if they dont fine, what are they going to do if i continue answernig the phone, call again? what's the point... i hope you see where my advice is coming from, never meant to offend anyone...

Bonus 77, unlikely to get anywhere with harrassment. somewhere in your credit agreement will be a section giving them permission to contact you on any number available, if thats work, mobile it does not matter.

 

They can ring you 100 times at work if you dont pick up phone and talk to them its not harrassment as they are only trying to make contact. If you speak to them come to an arrangement,or even tell them you are unable to take calls at work, then if they continue to call you could have a case for harrassment.

 

unfortunately at the best they may get a small fine probably a slap on the wrist unless they are repeat offenders.

 

As for calling your wife unless she is party to the loan you have a very good case, if they discussed amounts, missed payments anything like that then you have a good case to make a complaint.

I disagree with Jamie on speaking to them, you need to email them, that way you have positive proof that you have tried to deal with the issue long before they start piling on default fees and letter charges and phone charges.

 

EMAIL EMAIL EMAIL is the answer. Some of these companies are quick to try to use the court system so with the emails you have proof that you have contacted them in ample time, let them know of the change and try to come to an arrangement, most judges will frown on their terms and conditions as being unfair and as for their interest rates....

 

If they do phone send an email and state that you cannot discuss freely on the phone and you will automatically be recording the calls and using them as evidence should it be necessary.

Silly Girl, i never said only talk, i said talk and then email for confirmation. You and i both know that if a lender is persistant enough we'll talk to them in the end. how about talking from the beginning and then emailing confirmation that way everyone's happy, wouldnt you agree??:|

Jamie does give good advice! It depends how you want to deal with them but it is VITAL to have everything in writing so that if it does escalate to court you have proof of your contact. If they ring you at work and you do answer it, just explain that you are unable to take personal calls at work and ring them on your mobile in a break if you can - even if it's to say it's all in the email and I want to keep a written record of everything.

 

They have no right to speak to your wife though - unless it's in both your names!

I agree Jamie, a little harsh. I might not agree with your phone them at all costs approach but I don't think your motives can be questioned. Treat the 'idiot' comment with the contempt it deserves.

I also agree with Robojam and Cornet Girl, noragchick sounds like a possible troll... however we do agree to differ sometimes on the advice but the general advice is if they call, confirm the call in email form and that should leave a nice trail...

 

I've seen particulars of claim from a PDL company stating "The defendant has been posting on an internet site and we therefore believe they have no intention of repaying this loan" when the posts are completely to the contrary (and have been included in the defence - nothing to stop either side doing that at the monent so be careful what you put).

 

As said on another PDL thread, I think the industry needs to be heavily regulated and all PDLs should be paid back over a three month period, if after that there are problems then there is obviously a deeper underlying problem either with the original company or the person who takes the loan out.

Oh dear, where do I start with this one? It's a one man band it would seem. Luckily I moved jobs and changed my phone number so that got rid of him that way. Then he resorted to sending a letter to 'the occupier' of my flat, stating that he was considering taking legal action against 'a member of your household'. I replied, stating that you are not obliged to inform other denizens of an address of putative legal proceedings unless you could prove a joint or several liability. That shut him up - as he is a one man band it would seem. All this harrassment because I was a few days late with the payment I'd agreed.To start with, he did agree to a payment plan in writing but only because he got no response by phone. He is a very stupid person. Also worth bearing in mind is that his credit licence expired a while back.

if you are dealing with EPDL, they will repeatedly set up Direct debits on your account without your authorisation at all times of the day/night. You need to be very aware of this. Cancelling your card will not stop this. If you have a savings account transfer your salary into this or open a basic bank account with the Halifax ( Easycash ) or the Co-op, both can be done online.

Is this meant for me? If so, I was only describing my dealings with this company and advising another poster that they will eventually agree to a payment plan via email. I do not think that I did anything wrong. I was voicing my opinion, which I thought I was entitled to do, and as I did not name any names, I do not see how anyone can be offended. If, however, this is the case, I can only apologise. If you are singling me out, this is unfair as other posts are far more abusive than mine.
