Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, haven't seen a preview yet, but not tried in any other browser.

 

My text is centred when logged out, but alligned left when logged in. Though yesterday I think it was centred in both cases.

 

My screen res is 1600 X 1200, but none of this makes any sense to me. :-D

I'll stick to Firefox I think, the difference in layout for this site between the 2 browsers, is just not comparable. Similar issue to Kiptower as well using IE

That makes sense, I am not logged in using IE - So it has to be to do with that.

Totally agree

 

Although I appreciate the site upgrade may be necessary for a number of reasons, I have to question the layout.

Center alignment is fine for short sections of text but makes reading difficult for lengthier passages, which are often found on here.

I'm suffering eye strain since the change and expect many others will be experiencing the same problem.

Sorry to add to your list of woes.

 

Who ever told you Web Design was easy? They lied.

How does it go? ... 'You can please all of the people none of the time .... etc.'

yep sure is except the first 1 in new threads a bankfodder one, reply to thread not working yet , and how the heck do you start a new thread , get that long blank page on both, and advance still the same , common fault or link going wrong places

Ok, back to the 'edit' button (sorry guys:oops:)

 

Fair enough if it shouldn't be there indefinitely, that is just common sense really, but why only 5 mins?

 

If I've posted a long response/question, in the time it takes to type you can find there have been many responses in the meantime - I did this only a couple of days ago; talking to my kids whilst typing so it took longer than normal. Whilst I typed a good 8 people had replied. I post my post, then see so many others have got there before. Their posts render mine irrelevant/out of step in places, but in the time it took me to read their posts mine was now not able to be edited.

 

5 minutes is just too short a time. Why not an hour, or even half an hour. It would just give us enough time to either read posts that have got in before us, or even to go and sort out kids/burning dinners/mental animals that don't wait for us to edit things in a short time limit.

 

I'm just at a bit of a loss to see why it has to be such small window of opportunity? Going back and quoting/reposting/saying it's no longer relevant is all well and good, but it just lengthens threads with pointless duplication.

 

Just my two-penneth:)

 

ps - it's all left aligned in Chrome; no centre aligning here;)

A couple of other things that may be to do with Chrome, or maybe others are having the same issues?...

 

At the top of the page, where the 'thread tools' 'show printable version' etc are in the header, it is now in a list vertically down the header rather than being next to each other. The result is that it adds an extra load of line space to top of the page which is messy and annoying as it means more scrolling.

 

Also, could the 'Quick Navigation' bit be moved from above the 'Quick Reply' box so that you don't have to scroll past that too when trying to post?

 

Lastly (for now), when I go to advanced, the 'your message' box shows the title, then the font sizes and fonts in a long scroll list, then font colours, then the smilies and attachments, also in a long scroll bar, then finally you get to the text box. Is there any possible way of neatening this up? It used to all just be contained in a couple of bars just above the text box, and it was much neater and easier to use as you didn't need to be scrolling up and down to change fonts/colours/sizes.

 

I know they are only niggly things, but it's just adding extra faff to posting and it's already getting very tedious constantly having to scroll through stuff before you get to what you want.

 

That's it. No more moaning for the time being, I promise:)

Another couple of little moans from me, if typing a post in advanced mode and you click a smiley, it appears to the right of your cursor and you cannot scroll right to type after it.

 

and still no spellcheck in edit post... and thats the reason I normally edit my post! :p

Couldn't agree more. Removing the edit button (now 5 mins) seems an overeaction to preventing Users who had left after a disagreement/being moderated from editing/removing entire posts. Of course, that means that all Users, the vast majority of whom were using the edit button entirely reasonably are now penalised for the actions of a tiny, tiny handful of people. Talk about a sledgehammer to crack a nut.

Just remembered another thing, although I guess it must be a Chrome issue as no-one else seems to have mentioned it.

 

When I click to rep someone, the rep box opens underneath the post below it so I can't type, or in fact see the box. I have to right click and open in new tab in order to rep.

Its getting better :) Like the way the stickies are toned differently now to other threads, easier on the old eyes xx

 

ps. yep I noticed on the editing being slower. I normally go back realising how bad my spelling is along with a little dyslexia creeps in. I will have to be more careful when typing and go back to english school :)

Yeah, basically the post text :s

 

Just checking, I thought it'd be that. We could potentially go round in circles all day with this one. The reason I increased the font sizes was that a lot of people were complaining of the fonts being too small. Of the two (too small or too big), I think too big is the lesser evil. I think we'll probably end up creating some alternative themes off the current one - eg one with large fonts, one with smaller, one with higher contrast etc

Which browser are you using? I know someone using AOL 9 is having problems starting a new thread - I'm wondering if it's a browser-specific problem

 

"Reply to thread" should open a reply box at the bottom of the thread, and scroll down to it. Could it me that the box is appearing, but you're not being scrolled down to it?

I'm on chrome too, and it happened once yesterday, but not the next time. Go figure.

I'm using firefox and no reply box opens on reply to thread, I have to use the Quick Reply box ?
