    • if the agreement was taken out jan 23, then she has not reached the 1/3rd mark so the car has not become protected goods under the consumer credit act.  this puts her in a very very vulnerable position regarding ever keeping the car....whereby once they have issued a default notice they can legally send a guy with a flatbed (though they are NOT BAILIFFS and have ZERO legal powers) to collect the car.  if the car is kept on the public highway then they can simply take it away and she will legally owe the whole stated amount on the agreement AND lose the car. if it's on private property i'e like a driveway, ok they shouldn't take it without her agreeing, but if they do, it's not really on but its better than a court case and an inevitable loss with the granting a return of goods order. are these 'health reasons' likely to resolve themselves in the very short term (like a couple of months?) and can she immediately begin working again ? i'e has she got a job or would have to find one?  answer the above and we'll try and help. but she looks to be between rock and a hard place . whatever happens she will still have to pay the loan off...car or no car....unless you can appeal to the finance company's better nature using health reasons to back off for xxx months.

    • Hello all,   I ordered a laptop online about 16 months ago. The laptop was faulty and I was supposed to send it back within guarantee but didn't for various reasons. I contacted the company a few months later and they said they will still fix it for me free of charge but I'd have to pay to send it to them and they will pay to send it back to me. The parcel arrived there fine. Company had fixed it and they sent it via dpd. I was working in the office so I asked my neighbours who would be in, as there's been a history of parcel thefts on our street. I had 2 neighbours who offered but when I went to update delivery instructions, their door number wasn't on the drop down despite sharing the same post code.  I then selected a neighbour who I thought would likely be in and also selected other in the safe place selection and put the number of the neighbour who I knew would definitely be in and they left my parcel outside and the parcel was stolen. DPD didn't want to deal with me and said I need to speak to the retailer. The retailer said DPD have special instructions from them not to leave a parcel outside unless specified by a customer. The retailer then said they could see my instructions said leave in a safe space but I have no porch. My front door just opens onto the road and the driver made no attempt to conceal it.  Anyway, I would like to know if I have rights here because the delivery wasn't for an item that I just bought. It was initially delivered but stopped working within the warranty period and they agreed to fix it for free.  Appreciate your help 🙏🏼   Thanks!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

AIC are absolutely wicked. Don't pay them anything.

 

They so frightened me last October - bankruptcy, bailiffs, charging orders, all lies - that I seriously considered driving my car into the river. It was only that I couldn't leave my very young daughter to wake up alone that stopped me.

 

I am so, so grateful that I found CAG and I thank God every day for that. I know that there are people out there who haven't found CAG and will be crying, desperate and suicidal tonight due to these absolute bast***s.

 

You will get all the help you need here - and just like any bullies they will run off when you stand up to them.

And just think of all of that pollution that you would have caused to those poor fishes!:eek:

 

In fact stuff the fish, I'm more concerned about the car, typical woman, no thought for mens pride and joy, my mother parked her new two week old Toyota Avensis in next doors house last week!

 

She definitely won't hear the last of that:D:D

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

It was a new car - once, a very long time ago. It's still the only one I've got. :D:D

 

If it had been a halfway decent car last October I'd have probably flogged it for about half the retail value just to get the *******s off my back - and that of course would have been absolutely the wrong thing to do. :)

 

Of course it's easy with hindsight to realize what powerless scumbags they are, but without CAG and knowledge you just don't know that.

Thanks, Babybear, I know that now and am very confident about telling them all to sod off now, but the education I have received here is second to none. I wouldn't have believed how much I could learn here.

 

I can now drive them so mad on the phone by quoting CCA, regs, and more, that I don't even mind speaking to them any more, but that's down to CAG and the encouragement and friendship you get here - and of course when you arrive here, often in a terrible state of shock, you can't imagine that you'll find anything to make you laugh, but you do - especially your underwear thread. :D.

Thank you all for the replies. you have actually made me smile :), thought i'd forgotten how to do that. and thank you daniella, you sound like you used to feel exactly how i've been feeling and again, it's only been my daughter thats kept me going. none of this would have happened if my mother had not been so ill at the end of last year when aic first got in touch with me, i was so worried about her i think i would have jumped off a cliff if aic had told me to, i was almost catatonic with stress, then my mum died so again i was away with the fairies. i was always quite a strong minded person but all this on top of each other really threw me. then on saturday while food shopping, something snapped, i was adding up as i went along and realised that i could not afford a jar of coffee!! it was a choice, coffee or cat food, couldn't have both so bought the cat food and sort of came back to myself. its not a way to live!! thats when i started looking around for some help and found you guys. Sooo glad!!! i had the best nights sleep once i'd mase up my mind to stand up to them, its like a big boulder has been lifted off me, no matter what happens now at least i'm doing something to stand up for myself. When I was absolutely at rock bottom I would lie in bed knowing that there must be people who were going through exactly the same as me, but I didn't know where to find them. I know what you mean about the coffee - I once had exactly £1.73 in my purse (pennies from my daughter's moneybox) and needed petrol to get home. I only let it run to £1.71 because I didn't dare go further in case it went to £1.74.

 

And I've gone without coffee - which I really need in the morning - to feed the cats. Having to go round the supermarket counting the pennies as you go is no fun.

 

Most people here are here because of circumstances in their lives which they really could not have anticipated - death, divorce, redundancy, incapacity, and sometimes more than one at the same time.

 

I found this site after I googled "unenforceable credit agreements" and just like you when I realized there was help I slept for the first time in weeks.

 

I always respond to any AIC threads and say exactly what they did because it's really important for people to know that someone understands.

 

I never thought I'd laugh but there are some silly threads in the Bear Garden which have had me falling about with laughter sometimes on very bad days. Babybear's knicker alert had me cracking up at the thought of all the guys checking in the morning to see whether it was pink satin or black lace. I bet she brightened a lot of guys' days - and apparently is about to do so again. :D

 

Ask for whatever help you need, and just scream in frustration if you want to.

Hi everyone. An update on how things are going. I sent off for the subject access to Nat West and received a letter back telling me that they have 40 days to comply. I also sent a letter to Allied asking for the CCA thing and enclosing a £1 postal order. Their reply was that they could not comply with this as they are acting on behalf of Nat West in respect of recovering this debt but Nat West are the legal owners of the product so I have to ask them instead.

I'm not really sure what this means, i did not know that nat west still owned the debt even so i need to know if i have to ask them for this CCA or if it will be included in the SAR.

Anyway, if like it says Allied do not own this debt does that mean that they cannot make me bancrupt? and what happens now? Do I just wait and see who gets in touch with me to see what they say?

I have written a letter of complaint to Nat West customer services about the way i was treated, i should have done that a while ago i suppose but was not up to it then. Please let me know what happens next.

What it means is that they are a complete bunch of idiots, who either don't understand the law, or are trying to baffle you with bullshine. Never mind though, once the 14 working days are up, you can send them the "in dispute" letter. Then that will give you an absolute defence against any legal action that they try and take.

Hi, have waited two weeks now as Huff&Puff said and have heard nothing from allied about the cca. is this the time to send a "in dispute" letter then? and if so, what exactly is it? Thanks to everyone for their help so far, you've all been great

Hi everyone, update for today. I have received 3 letters today, 2 from Nat West and 1 from Allied. The Allied letter says that the account has been closed and returned to Nat West on 15/9/09, which is strange because I had a letter from nw complaints dept at the end of last week saying that i should get in touch with allied as they are still dealing with account!! Have received subject access letter too although i have no idea what any of it means and have also received the data protection, whole sheaves of non-understandable stuff. The one line that does intrigue me is "we have been unable to locate the signed agreement". Does this mean that the debt is not valid? If so, what do I do now? Any help very appreciated as always. Thanks

They are in breach of the OFT's Debt Collection Guidelines for starters, misleading tactics by telling you it is with a AIC and then AIC saying it is with them?????:confused:

 

However I would always deal with the OC, Natwest rather than AIC anyhow, as AIC are nothing more than bullies.

 

The SAR you have received should contain the entire history of your account with NW, which is why it probably doesn't mean anything to you and there is reams of the stuff..

Amongst all the paperwork they sent you will be/should be a complete list of your bank statements and these will show you if there were any charges added to your account, ie, overdrawn, bounced cheques, missed payments etc etc, you should claim these back from NW, so if there are any put your claim in with them now.

 

Is the line about not being able to find your signed agreement in a seperate letter which NW sent you??

Or is it amongst the SAR response??

 

Have NW replied to your CCA request?

If they are out of time, then did you send them the dispute letter??
