    • How do I 'link' a letter without posting it publicly. Sorry for stupid question.
    • Rather than dsunaks lies, lets look at the reaL Data and real black holes in the UKs budget - all created by the poop Tories   Public sector finances, UK: April 2024   Main points Borrowing – the difference between public sector spending and income – was (a black hole of) £20.5 billion in JUST April 2024, the fourth highest April borrowing since monthly records began in 1993. Borrowing in April 2024 was £1.5 billion more than in April 2023 and £1.2 billion more than the £19.3 billion forecast by the Office for Budget Responsibility (OBR). Public sector receipts grew by £1.6 billion compared with April 2023, however, this growth was outstripped by a £3.1 billion increase in spending over the same period. Since our March 2024 publication, we have increased our initial estimate of borrowing in the financial year ending March 2024 by £0.8 billion to £121.4 billion, now £7.3 billion more than the £114.1 billion forecast by the OBR. Public sector net debt excluding public sector banks (debt) at the end of April 2024 was provisionally estimated at 97.9% of gross domestic product (GDP); this was 2.5 percentage points more than at the end of April 2023, and remains at levels last seen in the early 1960s. Excluding the Bank of England, debt was 89.9% of GDP, 8.0 percentage points lower than the wider debt measure. Public sector net worth excluding public sector banks was in deficit by £703.4 billion at the end of April 2024, a £93.5 billion larger deficit than at the end of April 2023.     and the Tory legacy of financial mismanagement  to be passed on :   UK government debt 2023 | Statista WWW.STATISTA.COM Government debt in the United Kingdom reached over 2.25 trillion British pounds in 2022/23, compared with 1.83 trillion pounds in... - and graph does NOT show the increases as it should

    • That's very interesting to hear! I received a notification of a CC verification from Coles in Australia on the 12th May - also a Sunday evening. Not having been to Oz for about 30 years I was somewhat suspicious and so immediately cancelled the card. Guess what, it's the one I use to pay Lyca with........... If you've got any further information I'd be interested in hearing it.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

mmmmmmmm i see that the directors addresses appear as public information therefore what is to prevent someone who keeps being pestered outside of the OFT guidlines from visiting the directors at THEIR home address to deliver the letters asking them not to harrass!

accompanied by a reporter from a national newspaper!

If you were so minded it's far easier and safer (legal wise) just to repeatedly send them a nice postcard saying you will visit on xx date between x and x time first :-)

That's a bit like:

  • "Education, education, education"
  • "We won't raise income tax"
  • "We will give you a referendum on the EU constitution"

One of the great lies.

Before you criticise another man you should first walk a mile in his shoes. Then, when you criticise him, you'll be a mile away and he won't have any shoes on.

Don't get me confused with somebody knowledgeable by all those green blobs. I got most of them by making people laugh.

Excellent piece. Glad to see he referred to Mackenzie Hall as ''That Outfit''

I am also glad to see he mention our good buddies in HFO as well. Of course thay all come up with the usual glib bullsh!t denials that they or their monkeys do anything wrong and that they are all good members of the CSA etc etc.

My god, I loved reading that.

When Mr Leech got his chance I thought he was going to say something to the contrary, but he just made a further observation about in-house Sols, and then came the 'yes, they are rotten to the core'. It was much better than a sneeze for me! :D

Does anyone have any idea who these 9 are that the OFT are still hacked off with? (I still think they should be doing alot more, although they appear to be doing more than I thought, though we know it's at best, limp).

Who is this DCA that is supposedly stopping pursuing debts that are in dispute?

What was all that about the CSA being helpful, though? (cynic me?)

That was brilliant, but still could have been hammered home harder... a few more 'ffs - boy are these animals at it, every second of every day...causing bedlam, concern and grief through threats and intimidation and with no f**king regard to our laws whatsoever' would have made me even more chuffed. :D

there was a phone call to my office just two hours before I commenced this Adjournment debate, asking for more information. That gives an idea of the sort of cavaliers and cowboys that we are dealing with, among both the companies themselves and their agents. Such behaviour has got to stop.

That was regarding Lowell.

Sent this to the OFT about JD Debt Recovery

Reply from the OFT.

Dear Mr Alphageek

Consumer Credit Act 1974 (the Act)

Complaint Against: JB Ventures Limited t/a JB Debt Recovery

Licence No: 596203

Thank you for your email received on 22 April 2009.

We can confirm that the business you mention holds a consumer credit licence. Under the Consumer Credit Act, holders of consumer credit licences must be fit and competent to do so and the OFT has a duty to monitor the fitness and conduct of all traders who hold such a licence.

As you are aware, the OFT has issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance is intended to ensure that debt collectors treat individuals fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants. You can view our guidance at: http://www.oft.gov.uk/advice_and_resources/resource_base/legal/cca/debt-collection

We have therefore noted the details of your complaint, and we will consider this alongside any other complaints we have received with a view to any consumer credit licensing or other action we may decide to take. If we do take any action against this trader, it is likely that we would need to disclose your identity to this trader along with details of your complaint. I should therefore be grateful if you could sign the enclosed consent form and return it to me. Unfortunately, we cannot disclose any details about any action we may take, due to legal restrictions on the OFT relating to disclosure of information.

Thank you again for writing to us and bringing this matter to our attention.

Yours sincerely
