DCA Agents - Has anyone ever had one turn up?

They even employ pensioners....(well I supose it's better than harrassing them !!!) -

 

Simply because I have not got around to it, I have not sent the suggested letter yet, but typical 1st Credit, just when you thought it was safe to go back in the water.........At 4.30 my door buzzer went. I was expecting someone so I went straight out. It was not them but a pensioner who works for 1st credit. He wanted payment for the BOS account of £4000.00 He had prepared for the event that I would not be in and a postcard was handed to me with his name and phone number. I said I was keeping it for evidence, that the account was in dispute and that Trading Standards were dealing with it. I said it was illegal to try to collect on a seriously disputed debt and I took it he would not be on my door step again. He said he would try not to be and would make a note in case in six months time he was asked to collect, because it was a waste of his petrol, he does not get paid unless he collects.

Yes, I actually had a really nice one from Richburns. it was for a bill which was in dispute and when I told him about it, he sorted it out and they passed the account straight back.

All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.

I had a visit from Clarity Credit Solutions last April.

 

He asked for me by name when I opened the door and I said "and you are....?".

 

He said "it's about a little debt you have" at which point I said "Nothing to do with ME mate...!" and he said ok and disappeared!

 

Never heard anything from them since...

 

Scotcall took it on and I'm still waiting for an acknowledgement of my CCA request despite them having signed for it in July.

Yes they do....we had one from scotcall he was a right numpty!

 

My OH had an old bank loan that had been passed to scotcall they said they would send a doorstep caller. Previous to this my OH had written to them saying that, as he (OH) was not dealing with the stress of the alleged debt all dealings should be done through me.

 

When the man came to the door I explained that all dealings should be done through me and why. He was extremely rude to me, everytime I tried to speak he turned his back on me and point blank refused to acknowledge me. :evil:

 

Then after about 30 secs he'd turn back to my OH and start having a go at him about the alleged debt, when I again tried to speak and he responded the same as the first time.

 

He kept doing this...about 7 times in total. In the end I shut the door in his face. :evil: :evil:

 

This was before I found CAG!

No, but several threats which have never been realised. I think it's all a myth.

I really do appreciate all those 'thank you' emails - I'm glad I've been able to help. Apologies if I haven't acknowledged all of them.

I had one turn up at my front door whilst me and a dozen or so of my fellow biker/doorman pals were sitting in my back garden having a can or two in memory of a fallen comrade. my g/f ushered him through to the back thinking he was one of "the gang" arriving late

 

I'm 6 foot and 18 stone and I'm one of the smaller lads in our group,

 

The "gentleman" left a lot quicker than he arrived and not by the same route

Yes baliffs do have more powers, (not as many as you think), however it does depend on if its a civil debt or you owe money to the government.

 

A DCA cannot just ask a baliff to call, they have to have a court judgement against you 1st, (despite what they would have you believe).

I had a guy turn up from moorcroft.

 

He showed me a letter from Moorcroft regarding the account he was collecting on. I just said that the account was in dispute and that I had a leverarch file full of paperwork and that his visit would add to the complaint I was compiling. He left quickly and was quite pleasant, he even said he was claiming back his own charges!!!

 

The account has since been passed to CABOT - who have kindly put it on an indefinite hold as they cannot find the CCA Agreement ;)

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

If the collector is employed by the DCA, then this should not be an issue. However, most are self-employed. According to the OFT, if they work for only one DCA, they are covered by the DCA's consumer credit licence; if they work for more than one, they need their own licence. I am not sure what the situation is with the Information Commissioner - would a self-employed collector need to register as a data controller, or be covered by the DCA's registration?

 

In addition, if self-employed, I wonder if the DCA pays them under PAYE, or gross and expects them to pay their own tax and NI?

 

What training do the collectors receive, both in ensuring their own safety, and in consumer credit law?

 

It seems, as is typical with the debt industry, rather a sordid business: old people seeking to augment their income are sent into unknown, potentially risky situations by DCAs who only pay if they collect.

Had many many threats of field agents but not one has ever turned up;). The best one was when the postman handed me a card which read 'we called at your address today - blah blah' which kind of shot them straight out of the water. I lived in fear of them turning up at one point - not any more - although I don't think I am quite as scary as DMD:D
