Yes they did eventually submit those docs to me after a second letter advising them I was contacting the ICO to make a formal complaint for failing to comply with an earlier SAR that they brushed off as an "administrative error" or something. When I sent the letter telling them I was in contact with the information commissioner to lodge the complaint, the original PCN etc quickly followed along with their excuse!

    • The property was our family home.  A fixed low rate btl/ development loan was given (last century!). It was derelict. Did it up/ was rented out for a while.  Then moved in/out over the years (mostly around school)  It was a mix of rental and family home. The ad-hoc rents covered the loan amply.  Nowadays  banks don't allow such a mix.  (I have written this before.) Problems started when the lease was extended and needed to re-mortgage to cover the expense.  Wanted another btl.  Got a tenant in situ. Was located elsewhere (work). A broker found a btl lender, they reneged.  Broker didn't find another btl loan.  The tenant was paying enough to cover the proposed annual btl mortgage in 4 months. The broker gave up trying to find another.  I ended up on a bridge and this disastrous path.  (I have raised previous issues about the broker) Not sure what you mean by 'split'.  The property was always leasehold with a separate freeholder  The freeholder eventually sold the fh to another entity by private agreement (the trust) but it's always been separate.  That's quite normal.  One can't merge titles - unless lease runs out/ is forfeited and new one is not created/ granted. The bridge lender had a special condition in loan offer - their own lawyer had to check title first.  Check that lease wasn't onerous and there was nothing that would affect good saleability.  The lawyer (that got sacked for dishonesty) signed off the loan on the basis the lease and title was good and clean.  The same law firm then tried to complain the lease clauses were onerous and the lease too short, even though the loan was to cover a 90y lease extension!!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bet they dont do print outs of posts theat show them up for the lying cheats that som of them are. Bet they dont do print outs of posts where people are advised of their legal rights. Bet they dont do print outs of the success stories.

This thread is such interesting reading!! It really shocks me that they read our post's and then try to turn it against us!! I live with my daughter who was told by a dca when she answered our phone to "tell your dad to buy a suit" she was only 14 at the time, and then they think they can try and intimadate us on here, I will try every thing in my power to not pay that debt as I was outraged and angry they had the cheek to say that!! They can print off this message anytime and show the judge or who ever they like!!!! :mad:

Now that is uncalled for and clearly shows the character of the people we are dealing with. The stupid part is, debt collectors are supposed to collect money. I would say that set their cause back about a century!

Especially the photoshopped moorcroft castle logo with a gingerbread man climbing out of it. :D Took me ages to make that one.

 

I could do with some DCA letters that have a good logo to play with, but none of mine have anything creative enough. I went through all my folders last night to see.

So, taking screenshots, then? Would that even be admissable in a court? Screenshots can be altered/manipulated for example ... as can any image ... tape recordings aren't admissable *or used not to be* for the same reasons ... too open to doctoring. Never knew they were doing this, though!

 

But certain correspondence, certain activities lately from a few DCA's I have mentioned on here a lot lately ... let's just say I imagine they've been reading what I've been saying.

Funny thing is, the screen shot they've sent trying to prove their argument that I've received a complete CCA actually shows that I was saying it's illegible and unsigned by the OC.

 

Therefore, proving MY point and not theirs.

I don't know, dates, documents, letters, recognising phone calls?

 

They would have to spend a lot of time and energy, but I imagine when courts are involved it wouldn't be that difficult. DCA snooping division it is.

 

Plus, we stand out because we fight back and are informed of the law. Just imagine, they are used to the masses shutting up and paying- not turning round and telling them that they are doing it wrong.

Well, court isn't in sight (yet) but it was easy to identify me because I recounted a telephone conversation which I subsequently complained about.

Nice of them to bring to your attention that the CCAs were illegible! So you know that they know they are illegible- maybe they can get you some legible ones...

 

Due to the ongoing situation I won't say more than it is nice that they trawl the internet for complaints- bet they google themselves on a regular basis.

All sorts of things can give you away - posting scans that don't hide all the identifiable information, like postal barcodes, account numbers, figures on agreements, markings, etc. Also the quoting of the exact amount of the figures involved in postings. Some of the quotes from phone calls & letters also make it easy to identify you.

To be honest I believe people get a bit of a 'comfort zone' feeling about being on this site and feel we are all speaking amongst ourselves. It's easily done especially as these DCA's when they do raise their heads on here usually get spotted and come on with ulterior motives so are run just as fast. That all leads to a sense of security on the forum which of course is ludicrous because it is a public forum and absolutely anyone can view what we post.

 

PEOPLE MUST TAKE CARE when posting information about their cases or letters received so as not to be identifiable, we can see now how they use it trying to be clever so my message is just be careful and don't take anything for granted with these companies.

 

If you're not sure, don't post it.

I for one would be more than happy to display my full details on this site for any DCA to read/make a note of - i wont of course for other security/safety reasons etc...(and to save being cagbotted most prob)

The point is that i have no fear whatsoever of any DCA knowing who i am as a result of here.

They are simply useless organizations at the best of times - so the notion that they would take me to court as a result of here, after me begging with them for the past 10 years nearly to take me to court, i find a bit rediculous to be honest :rolleyes:

Anyway..even if i did ever go to court - thats what i'd have been wanting all along anyway as it would give me a chance to put my "play the system" plan into action ;)

Well this is the irony of all this. Once upon a time the banks ( & Citi did it to lickthewallfatboy in Northern Ireland ) did print this all out and use it in court, but of course during the passage of time our constant exposure on here of their (DCA'S) wrong doing is now working in our favour because WE are right and they are WRONG, enforcing your point Mr Ton, it often doesn't matter if they identify posters as it does, like tiglets, work in our favour, not all the time, but certainly more than before.

 

The danger is personal data being posted and game plans, the court system and anything legal is not just about the case laws and sections of Acts of Parliament, it's about selling it in the courts in front of judiciary who are not quite as familiar with particular legislation and the CCA. Cases can easily be lost by a well briefed Barrister or solicitor speaking legal language to a Judge against a Litigant in Person. That's why you need to be careful, a Barrister is not going to tell anyone their plan of argument in court and neither should we.

Well, whether they (gorbellied clotpoles) like "these forums" or not, I for one think this one in particular is the cats pajamas!:D

 

If it weren't for this forum I would have contacted the low life DCA's that sent me the Statutory Demand and offered to pay money on a statute barred debt.:mad:

 

I think all the forum members should consider the help and advice that they share with people on here as a public service!:)

 

Through the knowledge, support and advice I've received on here, I've gone from a nervous insomniac to someone who walks down the street with my head held high knowing that I have taken on these bottom feeders and won. It may be only a small victory in some people's eyes but for me it was never really about getting money from them...it was about showing them that I wouldnt just lie down and let them walk all over me.

 

I for one wish that this forum had more publicity and then a bigger proportion of the public will benefit from this site.
