As others have said selling your house shouldn't even enter your head but, There are mortgage companies who would consider you in term of remortgaging, it might be worth finding a good adverse broker. I'm assuming you have SA302's that you can declare? Sure the interest rates might be higher, but in the scheme of things £100 per month extra on your mortgage could be manageable for you? You could always remortgage back to a mainstream lender after a few years. Or, and this is a hard pill to swallow after owning your own business, Enter full time employment, after 6 months , once you have past your probationary period you might be in a better position to remortgage with the Halifax,
  2. I've had debts abroad, in Canada. Not a damn thing anyone can do to chase you in the UK. Also nothing transfers over on your credit rating despite them using Experian, Equifax etc as I am sure they do in Australia too. Best just to forget about it and enjoy your new life !

  4. Also one other thing, Either search on line for your local council's code of practice, around collecting ctax debts, or if you can't find it give them a call, asking them to send a copy. Without a shadow of a doubt you will find a clause listing vulnerable people who Bailiffs are not as a solution for collecting a debt, such as pregnant women, chronic illness sufferers etc. I would say a single, elderly, possibly ill/disabled lady would fall into that category. Be prepared to send the council a doctors / consultant's note if necessary. This will get the bailiffs of her case, at least. I got busted and stupid (Bristow & Sutor ) of our backs because my wife was off work chronically ill at the time. Any questions on this, let me know!
  5. Excellent news, follow them up, you would be amazed how much influence they have on these matters. I would also recommend contacting the actual head of the council too. It's quite possible they will be able to put an end to this problem.
  6. Contact the elected head of her local council, and her local councillors. Call and email them, they will quite possibly be able to sort this for you rapidly.
  7. I agree with the poster above, that everything should be in an email. However, you should also be speaking with / leaving a voicemail for the councillors / head of council. I got through on the first attempt to the head of my council on his mobile, who was actually incredibly sympathetic, I asked him to read the email I had sent. It's worth noting that I was begging the council's revenue department to take of the second AOE for a week, and explaining that I wouldn't be able to make the rent. I was told that once it was on there was nothing they could do. After speaking to the Head of council, it was somehow gone 25 minutes later. Do not under estimate the power these people have! The councillors generally work for the good of society. They know that making someone homeless, or starving is only going to cost much more in the long run either to the local authority or to the NHS and they also want your vote of course!
  8. Phone the councillors on their mobile, phone the elected head of council (not the CEO) on their mobile, leave them a voicemail, send another email. For example the one below is slightly different but you can adapt it. This worked for me. Dear X, I wonder if you can help, hopefully I am contacting the correct person. Put simply, we got behind on the Council Tax because of my wife's illness and her inability to work. She's now back working and I'm paying off an attachment of earnings at a rate of 17% of my Net Salary. I completely understand the need to pay back this sum, however it seems like another AOE will be placed on my salary for another year's bill at the same time. I'm quite happy to pay this after the current AOE is ended, but no one seems to be listening. Put simply my basic salary is only £X after tax, my rent £X. If they add this one at the same time, we will lose our home. Hopefully you can prevent this. I can supply you with all details necessary if need be, Kind Regards Hopefully you can prevent this
  9. This is the best advice on here! In fact contact local councillor plus head of council. Do a quick Google search. Phone and email them, both of them! They fixed it for me in 25 minutes. Even if it doesn't work , you have nothing to lose.
  10. I do have a statement from Capquest, with an Itemised list from Shopdirect of what was purchased. It lists 'charges' of £180 but doesn't specify what they are for.

The Statement that Cabot sent, is itemised with list of everything that was brought and a list of interest charges, it is a significant amount for such a small debt too Would you suggest is is worth sending an SAR to Fashion World? Are interest charges a good defence? I ask this because I have another similar one from Capquest, and just looked through the statement, there is more than £400 in interest !

Hi All, Cabot Group £231.13 Default date 15.1.15 OC Fashion World I received a so called reconstituted agreement from them, along with a letter saying they now consider the agreement enforceable. It looks like something a 10 year old could knock together on Word, but I was hoping someone who knows better than me could tell me if it's enforceable. Neither the agreement or the terms & conditions are dated, if that makes a difference. They also sent a statement of charges. About £30 of that £231 are interest charges ! Should I just sit tight and wait for a claim form or is there anything else I should be doing here. I have attached the documents, Thanks in advance cabotcca.pdf cabotccatc.pdf

  18. The debt is definitely nowhere near being statute barred so what else does that leave as a defence if anything?
  19. Hi guys, As always your advice is much appreciated. Lowell issued me a backdoor CCJ on 11.11.15 to my old address. However they were writing to me at my current address at that time regarding another debt. In fact they received our new address details on 17.09.15 and wrote to us on that date. Worth trying for a set aside?
  20. any names of these 'solicitors' ? Debt collection agencies always have some dodgy law firm attached to them.

  22. What A DCA demands is irrelevant, they are completely powerless. They are like my car, makes a lot of noise but goes nowhere ! You do not need to be frightened of them at all! When the appeal process has been exhausted, and HMRC says you still owe money. Come back to us and I can explain the next step. HMRC are obliged to do an income and expenditure assessment with you, the figure they will come up with is nowhere near the £200 per month you mentioned. Calling the DCA to make an arrangement is like peeing into the wind, it's pointless and will cost you a lot of money!
