  1. Hi Is there a standard letter on here to use in order to claim my fees back from SD?
  2. To repeat, I am assuming you have been living alone? If so you are entitled to the single person 25% discount. This could add up to thousands of pounds over the years that could be taken off your debt! If you haven’t claimed this, call the council ASAP Monday. They might even owe you money?
  3. Contact your local elected councillor immediately, details should be on the web. Email and phone. Also copy in the local elected head Of council. Several threads here over the last month illustrating how they have stopped this type of action. In my situation they stepped in immediately to prevent an AOE! Also the elephant in the room here. Have you been claiming your single person’s rebate. If not they will owe you money and you have every right to claim for it!
  4. As above, See how may threads there have been in the last month, where the local councillor has stopped this dead in it's tracks. I always say contact the local head of the council too for good measure.
  5. I think I will need to try and claim from the OC. Looking through some threads her SD seem very difficult to reclaim from, would I need to be prepared to take them to court?
  6. I think you have a good chance if you just ring them up and ask for a waiver. I picked up around £50 worth of charges for being overdrawn by £5 or so for a week without realising it. A quick phonecall, no anger, no shouting, just an immediate refund. That was Nat West.
  7. Hi DX, Looks like just phishing, I may have informed them but I can't find any letter on my computer, as it was too long ago. It's not the end of the world, if I keep paying £50 per month, it will be gone in 4 years, and that is the point it will also slip off my CRA files. I've already received a mortgage offer , factoring this CCJ in. It is a bit galling that there are hundreds of pounds worth charges in there but I will take it as a lesson learnt.
  8. Got my SAR back on this one too. I've not run it through the compound interest Spreadsheet yet but their are a ton of admin charges. Also almost every purchase on the statement says BNPL, and there do seem to be a lot of big chunks of interest added. I have a letter that Lowell sent to me on Sept 17th 2015 regarding another account at my current address, the CCJ they (lowell) issued was on November 11th 2015 at my old address. Do I have enough to get a set aside?
  9. Great stuff , all filed away, and will come back on here when/ if a letter of claim arrives
  10. https://www.consumeractiongroup.co.uk/forum/showthread.php?481027-DWP-Dea-overpayment-of-tax-credits-or-UC-from-yrs-ago!-**RESOLVED-BY-MP**&p=5070721#post5070721 See Above
  11. Nope, The DCA is powerless , ignore any communication from them. Only deal with Tax Credits directly. Please , please do not start paying anyone, the DCA is a non threat! Please , Please make an appointment with your MP, they all have weekly surgeries, and in your situation will be of great help. There is another Tax credit thread, a month or so back where the MP stopped all action!
  12. So I see an extra big interest charge of £53.97, close to when they sold the debt on. Would that be what I am looking for?
  13. The CAB's advice is terrible. The Tax Credit's own COP26 Code of practice is on the internet for all to see. For your own reference here is the extract from the COP 26 most relevant to you. I would say your circumstances fit this exactly for a cancellation. I have also included the link for you, page 15. and yes, you should offer to send them a note from a GP /consultant . For good measure do what another poster did, look up your local MP's surgery, make an appointment and explain everything. If you need to discuss financial hardship with us, phone us to explain this. When you phone we may ask you about any family circumstances that may lead to extra living costs. For example, if you’re looking after someone who is chronically ill or disabled. In some exceptional circumstances, we may cancel an overpayment altogether https://www.gov.uk/government/publications/tax-credits-what-happens-if-youve-been-paid-too-much-cop26 Here is the link to COP 26 for your own reference
  14. I will take a look at that later, but from what I can see from threads on here, if you want money back from SD you need to be prepared to take them to court! Not sure if it's worth it for a few hundred quid.
  15. So, what's the best thing to do? Just leave it? I haven't heard anything from Capquest for 8 months or so, the debt becomes SB'd in Sept 2019. If they do issue a claimform I don't really have a defence.
  16. £295.13 wow ! Do I claim it of SD? or get Crapquest to reduce the balance?
  17. Hi All, Excellent piece of Excel there Charges are £218.75 inc compound interest. Do I make a claim from SD or do I tell Crapquest to adjust the amount owed accordingly?
  18. Hi All, I have received the SAR and have found £192 worth of 'administration' charges on the account. Would these be something I could use to bring the value of the debt down in order to begin paying it off? Or should I just wait for a claimform and use that as a defence if and when it arrives?
  19. Report drunken phone call guy to the police immediately. This is a separate issue, you have the evidence on your mobile, it's criminal behaviour. I would imagine you are worried about the repercussions, it's understandable, they could sack you, which would really not be very wise on their part as you are entitled to take it to a tribunal (no fees anymore) and claim for unfair dismissal, and cost them a lot of money. Have you shown your director evidence of these calls? as he should be investigating said employee for gross misconduct.
  20. https://www.gov.uk/dismissal/unfair-and-constructive-dismissal Constructive dismissal Constructive dismissal is when you’re forced to leave your job against your will because of your employer’s conduct. The reasons you leave your job must be serious, for example, they: don’t pay you or suddenly demote you for no reason force you to accept unreasonable changes to how you work - eg tell you to work night shifts when your contract is only for day work let other employees harass or bully you Your employer’s breach of contract may be one serious incident or a series of incidents that are serious when taken together. You should try and sort any issues out by speaking to your employer to solve the dispute. If you do have a case for constructive dismissal, you should leave your job immediately - your employer may argue that, by staying, you accepted the conduct or treatment. Text taken from Gov.uk
