Well they will tell you, you can claim other benefit what that really mean is job seekers benefit of course once you are on jobseekers benefit you lose everything because that's where the sanction would come in thick and fast. You they fail you, you can claim housing benefit under nil income make sure you go straight to your council just concentrate on your esa appointment dont distract yourself with the nil point, you never know you might have a good HCP and past your esa medical.

The main thing you need to concentrate on is telling them about how your condition affect your day to day activities, they are not worrying about your illness or your doctors etc because they don't even bother to check with your doctor or psychiatrist, the so call atos Healthcare Professional are not doctors and they are employed by atos to just get the information from you and then type ten to the dozen in their computer which is all a farce. I think you should concentrate on preparing for your appointment rather than worrying about the nil point. Make sure you ask the ATOS Healthcare Professional his/her name, GMC certificate or number before you speak by law they have to give you that answer, also record your appointment they cannot refuse you that either. The best way to do that is to send a letter as soon as possible before your appointment date if you wish to record your atos medical sent the letter to DWP and the copy to atos. Also inform dwp and atos by letter that you want to know the name, GMC number of the HCP who will be doing your medical assessment. I would advise you also to enclose The Fraud Act 2006 pointing at Section 2 that scared them big time talking from experience. Like mentioned if you are genuinely ill then you put them under pressure don't let them put you under pressure. Please I am not saying you are not genuinely ill all I am advising you is that dont let them fail you, those medical assessment is really to get you off benefit that's their goal. I've sent my friend esa50 form together with The Fraud Act 2006 and also has informed dwp and atos that I wish to know the the name of the Atos HCP and their GMC number and that I intend to check with the GMC if Atos HCP have at least 3 years of experience as as stated in the contract between the dwp and atos having that contract in hands help a lot. Yes it is a shame it took so long, herself and myself both became ill because all the people we approached either could not help us, even the MP caseworker, he a mere junior doing his internship haven't got a clue and refused us to see the MP face to face, after me giving him an ear full that was it in the end I took matter in my own hands and studied Welfare Benefit Law trust me it worked big time. The Ombudsman who was supposed to help was unhelpful too alarm bell rang when he told me it will take three weeks and then he doesn't how long the dwp will take to make their decisions, I thought that was strange because it's not what I read how the ombudsman handle benefit problem, he even ignored my email but I chased him to see if he got it, he got the cheek to tell me he hasn't even read it yet that was 5 days after I sent the email to him that's when I told him to read further and take note of the deadline date I gave them and to make sure the 3 dwp staff knows of our decisions. All was done within a day and a half.
  4. Beware of sending letter and documents even though recorded delivery or special delivery they'll find a way to get lost, I was told that by a whistle blower whilst still working for the DWP. One minute my friends ESA3 form was not received and was told to fill a new one when I say Law matter miraculously the ESA form appear withing 50 minutes and was processed whilst I was talking to the dwp staff. Know the system and throw the law book at them they'll deflated like a balloon.
  5. There is an extreme quickest way to get back that 15 points and be in the support group without mandatory reconsideration, all the OP need is the person who made the decision and the Health Care professional who conduct the medical appointment.

I'm not surprised, I've spent the best part of this year fighting the DWP staffs, 11 long months but yesterday received an email, my friend got all back pay esa benefit money they stopped since 29th December 2013. Mandatory Recommendation will take for ever and Tribunal can take up to 18 months that's a cop out anyway, they offer my friend MR and Tribunal but I declined on her behalf by then I knew all the loop holes and legislation that would benefit my friends. Can I ask what benefit you are receiving? with your illness or injury you should not be working. Do you have the Atos Health professional's name if you do I can help you get your 15 points. It took a mere 1 day and a half to get back all the money my friend was owed and put back on ESA IR benefit. I've spent 11 months studying welfare benefit Law, you wont believe how fast 3 of the DWP staff two Managers top tier and the Decision Maker himself including the Ombudsman moved, I was told by the Ombudsman it will takes three weeks and then he did not know how long the DWP will take for my friend to get her benefit, I told him to please read further in my email and look at the 3 names written in bold and take note of the deadline. Within a day the money was is in her bank. To get your benefit you need to know the system that is in your favour and not the DWP.
  7. Hello Everyone, Hopefully to get some advises about housing benefit. My young who was on job seekers started full time employment on the 22nd of September, whom I've trained and found the job for him myself no thanks to the DWP's useless job search website. I've reported the change of circumstances straight away to my Local authorities also went there took his first pay slip and job offer letter he received from his employer. This week I received a letter from my housing benefit department about the change in circumstances, I was receiving £124 housing benefit per week but now since my son is at work my housing benefit has reduced to just £14.00 per week it looks like they are making my son pay most of the rent on his wages which I don't think it's right because I am the tenant on the Tenancy agreement and not my son, I am surprised they are making him pay the rent, he have to pay £400.00 a month plus the Council Tax credit I was paying £11.00 a month to now they are asking me £6.00 a week and my son has to pay £11.00 a months for CT. Can anyone tell me if that is correct the local authority making my son pay the rent, I am aware there would be a deduction in housing benefit but not most of it due to him working, I was pretty shocked but not surprised. My son was very good when I told him what has happened though I did warn him the council may reduce my housing benefit, he is happy to pay the £400 a month because he knows I cannot pay for it. Any advice on this would be appreciated before I just make payment to them. Thanks all helen

  9. Hello everyone, I haven't been on here for a while long story, I was surprised to see all the important sticky threads closed and just the Food Bank one left open is there a reason why? I'm I allowed to ask? ose threads was very helpful just wondered why they have been closed? After just browsing and reading in the benefit forum I see many people still having problems with the dwp and ingeus, I am so glad that my young son start permanent work on Monday, he was claiming jsa after finishing his accounting college courses, he is lucky to not have to endure the like of Ingeus as others have, he's worked hard at finding a job that he has studied for a Junior Accountant. I went with him to the jobcentreplus to hand over his jsa booklet and give a copy of the letter from his would be employer to show his start date, one of the staff after congratulating him said to him you have escaped knowing the same day he was to start his work program is the day he'll start full employment instead, yes he has indeed I told the staff. I myself working hard on my health to get better and intend to go back to work next year Spring, I'll be glad to see the back of corrupt DWP and Ingeus. Good day to you all. helen
  10. He definitely should receive a letter about the income based jsa, but i've got a feeling that what the dwp meant he cannot claim income based jsa, please don't take my word for it it's just the feeling I have that what they mean. Ring and ask them.
  11. According the the welfare reform job act 2012 the dwp has been directed that they cannot sanction a claimant who have no access to a computer or internet. My son miss one day search they threatened him with sanctions until I read the act from the welfare reform job act 2012, they left him alone. Your adviser has not follow the guidance according to the welfare reform act 2012, please do download and read her the part that is in favour for you. They cannot ask or make you give access to your profile. Chapter 97 and 98 on the welfare reform act it is your choice to refuse them. Read the act to the dwp adviser and ask for your benefit to be re-instated.
  12. By the look of things I am sorry and agree we all make mistakes but the dwp regime are harsh and the fact sheet stated the reasons for sanction, 'you fail to attend is one of the reason'. DWP should cater for people with illnesses but they do not care. Apply for hardship payments straight away but you will have to meet one of the criteria, if you have a disability or long term illness you should qualify. If you phone the dwp record your telephone conversation, I have done so by my ipad, you do not need to tell them either.

Atos is/was also struggling to employ genuine medical professional as suggested by a court, hence! all the long waiting for medical assessment besides they are being taken over by some other private medical company, as far as I know from benefitsandwork website no medical assessment should be carried out until further notice, so I am surprised how people are still asking to attend medical assessment by ATOS. Did you know even America got rid of ATOS for not treating their vulnerable disabled people that is saying something, we all know what america is like when it comes to their benefit systems. Capita is one of the third party behind the DWP and the Local Authorities too, the corruptions are spreading like a virus. Capita, A4E and some other third party will be taken over the dwp in the coming year and those private companies have no intention of helping the vulnerables, the benefit systems are changing, I just received an email this morning from my local constituent they are cutting cost for disabled children after school care. My local authority actualy call themselves a business and is run by Capital. DWP/Capita has asked the authorities to give them names of all problematic tenants all those goings on spelt privitisation to me.
  14. You can ask her what is the decision, she must tell you. Don't understand your question, have you been sanction already and claiming again? Read the form carefully before you fill it up, people have been made to sign a form at the dwp but what they were not aware was that they were signing for two weeks more on sanctions, don't want to worry you but just be very careful, it's best to know the going on at the dwp than not. Apply for hardship payment if you haven't already done so, you've already waited for two weeks without money, please be aware you may have to fall under certain circumstances to get the hardship payment, you can apply for a crisis loan but they are a one off, you can get that from your local authority, you don't need to pay that back. For housing you can claim housing benefit under nil income, if you are claiming housing benefit. hope this helps

Yes my son have that written on his document, we are in London perhaps it's different where you are, one time he did not search on a Sunday and got threatened with sanctions absolutely ridiculous. I am training him myself for accounting job, thanks god for my accounting career, I will make sure he'll find a job in the private sector as soon as possible. He's only been claiming for 3 months, 3 months too much for him and me because he is so fed up with the dwp. I cannot work through ill health at the moment but are looking to do freelance Bookkeeping/Accounting job at home because two my friends/neighbours benefit's stopped for no reasons without even a letter been to hell and back with the dwp, I am watching my own back just in case. I read an article in a paper somewhere the ESA support group now have to have medical assessment twice a year and 6 in 3 years instead of getting call once every 3 years no one is safe, some people in the support group has already been call at home and ask about their job prospect etc.
  16. Yep agree with you, if my son not getting through again I will tell him to tell his dwp adviser he will not use UJM it's in the welfare reform act, he can search for job elsewhere, it is so annoying when you try all day and not get through especially when you have to do that 7 days a week. .

Be careful about asking for a mandatory consideration which you have to give them notice within 4 weeks if it's past the 4 weeks you've sent them nothing, you'll find yourself claiming Jobseekers allowance because if you do not get in touch with the dwp within that 4 weeks the mandatory consideration can go on for ever because they don't have a time limit on it, another clever way the dwp cut benefit and get sick people on job seekers.
  18. I couldn't agree with you more, the jobs are just a pile of crap Friday or yesterday they had no jobs on there for the London Area lol and they expect people to go on there to look for jobs. My son has not give them access at all. The job centre my son goes they have to create a UJM account and show that they are using it otherwise they'll be sanction.
  19. This happens everyday, it's a miracle to get through on first logging in. No you'll never find out what the problem is all you see is error to register or call their so call administration that perhaps don't exist, my son says in the job centre they don't have that problem surprise, surprise.
  20. If you don't give them access to your UJM they won't be able to check what you are doing, I'm still not convinced and don't trust them. You will have a lot of problems getting to the UJM website, you can try to log on all day and won't get through, on my son tried all day long and could not get through. I've told him to print out the emails confirmation of his job searches and show that to his adviser, again carrying the guidance is very important for not getting a sanction. The UJM is run by Monster website developer at a cost of £3 millions tax payers money of course and also be aware the job shown on the UJM are fake or 4 months out of date. CV Library, Monster and Reed throws fake jobs but just go with the flow and applied on those websites then record them on your UJM job activity for not being sanctions. As I've mentioned before you do not have to look through the UJM the welfare guidance mentioned looking for job on an online site which could be any job website, Universal is not mentioned. Get those guidance about UJM is at Chapter 2 of the welfare reform, it's a guide for the dwp to follow and told them what they can or cannot do to claimants. They've been told to cater for claimants that do not have a computer, are not computer literate, do not have access to internet at home, if all those applied they must allow the claimants to come to the dwp office to search and print the job searches and if you are ask to come on a date that is not your interview date they have to pay your fares. My poor neighbour was treated like a dog and was told to go about and search for a computer don't matter who she'll ask but she must found one and create a UJM otherwise she will be sanction, yet the guidance told the dwp avisers to cater for people who do not have a computer or internet access devise etc! pff
  21. Be aware I've read somewhere if ESA questionnaire are send in late benefits are being stopped it happened to someone! No trying to be a scaremonger!
  22. Best thing is to use a computer from the library, internet cafe or dwp's own I've used a different address but they can still pick things from your computer altogether.
  23. Do create an account because it is mandatory but you do not have to give them access to your profile it is your choice to do so as mentioned in the guidance of Welfare Job reform act 2012. My son was threatened with sanctions several times if he did not allowed his DWP adviser access, I rang her up and read the guidance to her and also have him carry the guidance on him at all times they've left him well alone since. You might get another adviser seeing you instead of your main adviser it's a trick they do and that other adviser can sanctions you also which again my son had, I rang her up too she backed off surprisingly my son has since only the main adviser since. You got to be aware that all the dwp advisers have to sanctions three people a week each it's a fact, so make sure you carry or know the guidance that is in your favour. DWP advisers don't like Guidance throwing in their face and they have been told by their managers to leave those with guidance alone.

I have typed the sample letter you advice me and will send it today, so far I have 2 lots pf £12 fees and that is from one of the catalogue, Woolworth is not pestering me as much but Very now is ringing me all day during the day and night, I'm having to take my phone off the hook. I'm hoping when they receive the letter they will leave me alone, I have told them times and again about my financial difficulty and even offer to pay so much per month but nothing perhaps now with that letter in writing they will take notice keeping fingers crossed. Appreciate your help.
