Hey Millem, good to see another Edmonton wallah, thanks for that good news

 

I got my two court dates this week, my NW one only today in the same post as Cobbetts letter asking for a stay

 

Am i right to think that if a person has a court date already, the earliest the stay will be considered will be on the court day and all person need do is take his argument against the stay along with all his other paperwork?

 

Hi Micky - I've been to Court over this today, looks like your claim will be stayed unless you convince the Judge otherwise - which I failed to do using the standard arguments in the objection letter on this site;

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

I am Hoping that this list will help in our argument to have stays set aside, by demonstrating to judges that (at the moment) the majority of courts are continuing with claims on a case by case basis, which is a fair and just way to continue.

Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.

I also hope to raise the awareness a bit, it may give us all a bit of hope if anyone was fearing the banks letters were right saying all cases were stayed when in fact they werent.

Just had a letter from Grantham county court - case due to be heard on Monday 20th, I wrote to them asking for default judgement as Abbey had not complied with order to submit bundle but it has been stayed pending outcome of OFT case. I am fuming, Abbey have walked all over the leagl process, not complied with court orders yet still they get a stay :( To add insult to injury I received yet more bank charges today because I am over my limit due to the blooming charges aaaargh!!!!!!!!!

Not sure about this fella, best to check with one of the banana experts on the board about this. Good luck with the case - i'm due up on 31st Augst. Just had a letter in the post form the court saying:

 

"Judge does not think special directions are appropriate in his view, court case remains listed"

Add Bournemouth County Court to the list, had letter this morning

 

"The case be stayed pending the final resolution (being the judgement in the action or of the final appellate court. whichever is the later) of the case brought by the Office of Fair Trading in respect of the matter of bank charges"

I see from the above Croydon CC is listed in two places - Business as usual, and situation unclear.

 

Is anyone able to confirm?

I've received a letter from Kingston-Upon-Hull County Court saying that they are staying my case :

 

"This case is stayed until further orde with a view to awaiting the final decision in the test case (which shall be interpreted as the outcome of any appeal or the expiry of time for permission to appel the first instance decision)."

 

Para. 4 states:

"Either party may apply at any time, by application on notice in accordance with Civil Procedure Rules 1998 part 23, to lift the stay."

 

Yet Para 5 states:

"Because this order has been made by the Court without considering representations from the parties, the parties have the right to apply to have the order set aside, varied or stayed. A party wishing to make an application must send or deliver the application to the court (together with any appropriate fee) to arrive within seven days of service of this"

Hi Zoot,

 

No, the claim is not recently filed, but has been ongoing for a while. I first filed it with MCOL at the beginning of April, but because of mistakes in the Particulars of Claim, which I had to ammend, I was told could no longer deal with the claim online and had to communicate with the Northampton court by phone and mail - then later the Hull County Court.

 

SC&M had made me a conditional offer to settle in full, which I'd declined and returned a day or so before the OFT announcement. (Now I think I should have accepted the offer but struck out the conditions - anyway, that's life!)

 

So, I was awaiting a date for a hearing from Kinston-Upon-Hull County Court, but then the OFT thing happened. I received the "General Form of Judgment or Order" letter last week - dated 14 August.

 

I've downloaded the n244 form and the updated (GaryH version) text for part C of that form. Armed with these, I think I will apply for the stay to be lifted. I'll probably deliver the application to the court on Monday - with my additional fee of around £35.00.

Hi MtH,

 

I know, it does sound a little crazy -

 

but firstly because of the conditions attached, which would have meant that I wouldn't be able to claim for further charges applied to my account since I started the claim, and in the future;

 

and secondly because of an error on the agreement form that SC&M wanted me to sign: to cut a long story short, I had to change (slightly) the name of the claimant on ther PoC from what it was initially - when the claim was first started. When SC&M sent me the agreement form, it had the original claimant name. I felt that even if I signed it it wouldn't be worth the paper it was written on. So when I wrote back declining the offer I also asked them to change the name of the claimant to what it should be.

 

If the error in the claimant name hadn't been an issue, I would probably have struck out the conditions and signed the agreement.

 

I hope I've explained that clearly - I was a bit confused with all this when I first issued the claim, hence that initial error in the PoC.
