It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

I am Hoping that this list will help in our argument to have stays set aside, by demonstrating to judges that (at the moment) the majority of courts are continuing with claims on a case by case basis, which is a fair and just way to continue.

Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.

I also hope to raise the awareness a bit, it may give us all a bit of hope if anyone was fearing the banks letters were right saying all cases were stayed when in fact they werent.

Oxford seems to have jumped from business as usual to staying all cases, yet there seems to be no posts (that i have seen) to indicate this is the case, could this be an error or just wishfull thinking on my part, no official word from court as yet to do with my case

I changed it after reading someones thread, they had rung the court and this was the latest info they have given out to my knowledge, it may be worth your while ringing Oxford to double check current status

Have spoken to IPSWICH County Court this morning, and they inform me that - 'A decision has been taken in the last few days to STAY ALL BANK CHARGE CLAIMS UNTIL THE RESULT OF THE OFT TEST CASE IS KNOWN. Letters are now in the process of being sent to all bank charge claimants'

 

Very bad news for me, but inevitable I suppose!

Hi,

 

Have just rung Chesterfield County Court and they say that they cannot refuse N1 applications and they have been dealing on a case by case but that they are looking at putting a stay on them until April next year!

Submitted my bundle to STOURBRIDGE County Court today

 

I mentioned to the lady at the Court (Stourbridge) that Barclays had contacted me to say that they were going to apply for a stay (blanket letter that everyone's had) and asked whether the stay had been (a) applied for and (b) approved.

 

She said that Stourbridge County Court were going to apply stays for all cases except those above £5,000 but that I was still able to appeal if I wanted to. My claim is up around the £4,850 mark now so not far off £5k but I haven't had anything from either the court or Barclays regarding the stay application.

 

My question is should I appeal it before I get notified of it? if the court themselves have applied it I will obviously have to appeal rather than just turn up and hope Barclay's cock up but I don't want to get to court (6th September) and find that although Barclays have submitted nothing the stay has still been applied anyway!

 

Will I pee the court off by applying before I'm notified of the stay or am I ok to apply in anticipation?????

 

Given the size of my claim I might have a good chance of getting past it anyway, I just hope that B's are lulled into a false sense of security and don't turn up or file a defence and my appeal is upheld :grin:

Well Shinobi, I woud,nt hold your breath, I have had a few dealings with Stourbridge CC and they have got to be the worst snale pace and inefficient Court ever. And they do not like bank claims, especially the fat c*w on the counter.

What they are saying is that Fastrack cases are not being stayed and yours is not fast track, it is Small claims, so expect the worst.

All those in Worcester Court (who are hopefully watching this thread).

 

Given the general unhappiness at the manner in which people have been dealt with by the Court I am proposing to draft a letter to the court. I will post it to a new thread (possibly later tonight although it is more likely to be tomorrow).

 

If you would be interested in signing up to such a letter please let me know by PM'ing me. I'm happy for it to be publicly moderated (so hopefully all bright ideas get included).

 

As an aside, the person I was helping has decided to accept the banks original settlement figure. To be honest I'm gutted. I was looking forward to the fight, as it were, on his behalf. He's not sent his letter off yet (and a covering letter I've drafted) so fingers crossed I can persuade him otherwise. The lure of a computer and flat screen tele are proving a bit much for him at the minute though.

Abbey was given up to 4pm today to comply with DJ's instructions or have their defence struck out unless hey made an application to have it varried or stayed. However eventhough I received a letter from Abbey a week ago to say my case was to be stayed, I visited Willesden County Court today and there was no stay on my claim so I guess I've won!!!!!!!!!

Confusion at Ashford County Court !

 

I 'phoned the court last week. The lady I spoke to said the papers had been seen by the judge and he had ordered a stay. She said all bank charges cases at Ashford were being stayed.

 

However, they have now sent out an order saying that unless the defendant files an AQ by 28 August the defence will be struck out !!!

 

So, clearly, they aren't staying all cases. The defence AQ is very late - it was due on 2 July. Maybe that made the difference.

 

I wonder what the judge will do if the bank now sends in the AQ - but asks for a stay at the same time?
