    • As a rough guess it would be your landlord who would be responsible. But you need to understand the extent of your losses before you can begin any claim. This means that you need to list out any expenses to which you have been put, any expenses which would be associated with repairing damage or cleaning et cetera. And then list out the inconvenience to which you have been put as a result of this. Any actual expenses – money loss which has been incurred already all that is likely to be incurred in result of repairs will need an inspection and to quotations which eventually you will present to the landlord. Even if I'm wrong and it is not the landlord – you will still need the evidence that I have listed above in order to begin any claim.  
    • Hi, I have been renting a three bedroom, top floor flat for six years now in England. Just so you know, there is a letting agent, landlord and a block management company involved. Eighteen months ago we had a considerable leak in one of the bedrooms, affecting the next door bedroom as well but not as badly. This led to a lot of damage to the ceiling and the formation of mould within the first bedroom and to a lesser extent in the second bedroom. As far as we are aware, the leak has only recently been sorted by the block management company(who owns the roof etc…) Just over three weeks ago, a large inspection hole was cut into the ceiling, the workmen (instructed to come by block management) who undertook the work did not put any dust sheets down over any of the furniture, causing an incredible amount of dirt and debris throughout the entire flat, rendering the room unusable. We were left on a Friday afternoon with a gaping hole and no instruction as to what was going to happen next. Only after contacting our letting agent to inform them about the state of the bedroom had been left in, with a gaping hole and bits of debris falling, did they come to do a temporary fix to cover the hole which was after a week. As the bedroom is still unusable. My daughter has for more than three weeks been sleeping in the lounge. The letting agent did offer to get the place cleaned, but we see no point until the job has been completed. My landlord has reduced my rent by £200 for the past couple of months and is now wanting full rent regardless of the work being incomplete. A plan has been put in place, however, we have not been given a timeline for when these will be completed and this could take some considerable time. In addition to this, there was a leak in the kitchen but this was very minor, and we have a major condensation issue in the bathroom as the extractor fan is apparently not strong enough so the ceiling is covered in mould which is now being revealed as the paint is flaking off. The problem we have is that the building (roof etc..) is managed by a block management company. My letting agent has basically said that the damage is the responsibility of the block management and this nothing to do with the landlord, and therefore, does not want to give us any compensation. What are my rights as a tenant in this situation? Am I entitled to a continued rent reduction or additional compensation given the ongoing uninhabitable condition of the bedroom and the disruption this has caused?     • I have just read it again and I see that you say that you are going to be claiming for time and stress. This is not recoverable loss so I think that you should leave it out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Andie I think I have spoken with you, I'm just new to all this sort of thing, Never had to ask for help on a forum before always managed myself, but found this forum and thought it was brilliant. Now I want to challenge everyone, and get my money back :D

 

I know you have a lot going on yourself with welcome and hope you get it resolved. My post doesn't matter, I have sent away to-day for CCA and SAR, but out the blue I got a personal loan statement this morning, never had anything from them before.

 

It was a paragraph at the bottom I just wanted someone to comment on about " Interest will be calculated at the Rate of Interest on the daily balance outstanding of the total amount of Credit".

 

It probably means nothing, and I am living in hope of getting money out of Welcome:) Will wait until CCA and SAR come through then will post up, and see if anyone can help me.

 

I don't fall out with anyone, so water under the bridge now:cool:

I have a recent statement too with the following underneath.

 

"Interest will be calculated at the Rate of Interest on the daily balance oustanding of the Total Amount of Credit and the Acceptance Fee. It will be paid as part of your Monthly Payments".

Ok - I think i'm correct when I say

 

Acceptance Fee added in before interest calculation unenforcable

Acceptance fee after interest calculation on your agreement enforcable

 

Hope this helps a little

Hey Rabbi I know the feeling I've put up a few posts and have had no response but I think everyone is just rushed off their feet!

 

 

You're right this thread is now moving very fast and I can only speak for myself but when I nip away from the PC for a bit and come back there can be as many as 7 pages worth of threads to go through.

 

So i find myself skimming over them and not always reading them properly - If you need help with anything bump me again with a reminder when you can see I am active (sometimes my name will show on the bottom but i'm away from my PC) and I will do everything I can to answer questions.

thats wierd cos I have had a couple of those statements recently never have before and unfortunately been with welcome on and off for 7 years!

 

Slightly strange that it only started in the last month once i had sent a sar

 

 

There;s no conspiracy theory here - it became law a few months ago that a yearly statement HAD to be sent - this is why people are getting them now after never having them before

Yes and they can't charge you any interest or defalt charges for the period of none compliance either.

Hi everybody

 

Iv finally made the effort to join this amazing forum after a long time lurking. Iv got a loan with Welcome which is for £2500 over a 3 year period. Iv been reading about all these possible things that could be wrong with with my agreement but im pretty sure im one of the rare group of people with an enforceable contract. I do have one question though, not sure if its me just nit picking but iv used the loan calculator which has been posted on here and some other ones which iv found online and some lead me to believe me that my total charge for credit is 1p more than it should be. I could only find one which worked out my total charge for credit which stated the correct amount.

 

I doubt this is really anything really and just a case of the decimal places being rounded up differently but I was wondering if anyone had any ideas about how to work out the total charge for credit on paper so I can see the maths behind it for myself.

 

If anyones interested its a loan for £2500 paid over 36 months with a payment of £131.51, the total charge for credit is £2234.36 and the APR is 59.39%. I would scan it in but being a poor student iv not got one :(

Barclays are looking to consolidate and farm out parts of the business and ring fence bad assets.

postggj your full of useful knowledge, any chance you would know how to work out the total charge for credit using the APR and total amount of credit by hand? iv used some loan calculators but they keep telling me different things.

Hi all! I am sooo pleased to learn that the post regarding the reply from Norwich Union may be a hoax. I got a little bit worried when I read that because I used to be an underwriter for Norwich Union. I know how many different systems they use and loads of different departments. I worked next door to a different department for 5 years and still didn't know what they did. Also I spent a full day once trying to locate someones policy who got directed to our office by switchboard. I guess what I am saying is I thought that maybe welcome policies were being underwritten in some little office somewhere within Norwich Union - but I hope this is not the case :)

Was worried that this concerns my post? maybe not following thread properly but to clarify I have copied the letter to photobucket, first timer with that so hope the link is correct. If not I will take guidance and try harder. I just thought it was interesting how quickly NU got back to me and re-directed me to Welcome, almost as if they have a bundle of copies ready to go. Not sure why others have had standard replies and still waiting, I just emailed through the website, apparently it went to CEO! I'm not a spy either :confused: I'm just another obstinate woman who is likely to lose money to the swines before they go under but wants to give them a headache in the process!

 

If this didn't refer to me then apologies! Oops.

to me this gets better by the day how can a company as big as nu underwrite policies for a 3rd party that they know nothing about, ffs if i wanted life insurance i would need a medical at least to get it, its like trying to insure a car that dont belong to you but could??

In view of recent revelations regarding tax avoidance are Barclays really the best bank to be in charge of such a respected & ethical firm like Cattles;) ..............or would it be best to say "birds of a feather stick together"
