    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone else had to log a complaint with the FOS as Welcome arent playing ball ? With me they are ' witholding ' part of my PPI refund, and so I had to take matters into my own hands and log it with the FOS. Silly me though as they have a HUGE backlog, and now wish I would have taken it down the court route - however I was afraid to do that, as I dont really know that much about it, and I have got two small children to deal with and am also nearly 5 months pregnant, and have been back and forth to hospital - so I thought the FOS would be the easiest route for me to take.

 

I have spoken to the FOS to check on my cases progress, as even though I know it will take forever for them to sort it, I wanted to see what Welcome were doing ' behind the scenes '. The FOS advised that they had written to them twice, but they had failed to respond - Charming ! :mad:

 

So, being in the frame of mind that I am, I rang the compliance dept to see what they were playing at etc....now awaiting a call from someone to advise me whats happening ( which I am highly unlikely to receive ).

 

Cant just understand why they dont just settle up !! Granted there are maybe people out there who after the initial ' we dont agree with you letter, and we arent going to refund you ' , will simply just stop with their claim and think whats the point, but Welcome know they have a huge fight on their hands with the masses of us who are planning to take them all the way - just be done with it and give us our money back !!

 

They arent very sensible in this respect are they ?? :lol:

 

They really are a miserable excuse for a company and very incompetent cows... exactly how hard is it to respond to your customers... every step of the way in fighting them.. i get even more p'd off... Hang in there, don't let them reap you off... i sure am taking it to the end... filing court docs. next wed.. dragging my 7mths preg tummy there, even if it takes every energy in my body...

Am not surprised really, the initial enquiry email spent nearly 2 weeks floating about in cyberspace (have all the, read receipts to proove it) It then got sent to Simon Brunt at DG, He took a week and two email replys to advise i needed to refer back to NU....

 

 

 

Dont tell me Andi, is it in another 10 days when they are all redundant in the warren ??

Out of interest who is this Simon Brunt I keep hearing about - what is his position? Other than that of doing naff all I mean?

Funny the Director of compliance at DG has shut down on me to - I think they're under instruction to shut up - too late though I already got all the information I needed - if anyone else is interested in the direct email for the director of DG let me know - since they're no use to me anymore I might as well pass on the knowledge :)

The backlog has to be down to us ......:lol:

 

I sent my complaint to the FOS about 3 weeks ago and rec'd a response just over a week ago confirming they had my complaint, but that it may take a while to resolve due to their backlog.

 

I only received this letter from WFS this morning, so I wasn't sure if they had to place it on hold, or if they were playing games again.

 

Do you know how to email compliance?

Funny the Director of compliance at DG has shut down on me to - I think they're under instruction to shut up - too late though I already got all the information I needed - if anyone else is interested in the direct email for the director of DG let me know - since they're no use to me anymore I might as well pass on the knowledge :)

why are they going on about mechanical break down insurance etc,

who passed those details on,

we are talking gap etc, nothing to do with nu

 

why do i still get this nagging feeling that ime talking to welcome all the time even though it has norwich union headed paper.

 

i have a day off on thursday and ime going to drive direct to norwich union and speak to this so called dept 33 and sue dewey

 

ill be sending you a pm later andie
