    • its not a 'payment limit'...i just want to know if theres any thing in comsumer law that says they can not take over 45 days to refund me. do you really think its fair they withold everyones refund and earn interest on the funds in their corperate account?   as i said before(after trying to sort it for a couple of months with HP not replying, not offering a solution etc) i emailed 3 different people from different departments every day for over a monthas they wouldnt tell me when the refund would be - they just keep stringing you along. they are a nightmare to deal with or get any results in a timely manner. i phoned various departments all of which took hours at a time as no one could tell me when i'd get my refund and why ive not got my refund so far. i had to wait 6 days for a parcelforce label because they sent emails for the return without the actual label to print out...so i had to keep emailing them saying 'theres no label' only to receive a pre-typed reply with 'here is your label' that didnt contain an attachement with the label. so i had to ring parcelforce and then they arranged a collection that didnt turn up (after waiting in all day) so then had to start emailing incompetant HP again...and the cycle continued. i even joined their forum in hopes that someone would sort it...so wasted time on there explaining everything to someone who said they would get it sorted...then after a few days of no reply i had to email them and they would reply with general bs like "yes its getting refunded now"...then i asked when and they wouldnt reply for days which prompted more emails etc etc etc i made 3 official complaints ....all of which just got marked as 'resolved' just because they answered me with "your refund will be processed"..so i emailed back questioning when it will be refunded ie a date and then receive another reply of "we are dealing with your request and investigating this"...leaving you in the lurch with no definite answer. there are other customers on their own forums saying the same thing - some have been waiting 60 days or longer.... but dont take my word for it...buy something from them and then see how bad they are when things go wrong and how much time will be consumed in your day just trying to get a simple answer like what day you will be receiving your refund...as they never told me. i just had to wait for over 45 days in the hopes that they actually would refund me sometime this year! aftter a month citizens advice told me to write letters and send recorded delivery in case they never did refund me. this took hours of my time and going to the post office or getting someone to do it is inconvenience as i have a mobility disability. its like banging your head against a brick wall with them...which is why all i want is  to be forearmed as i dont want to be going too and throw for another month establishing that they do have to compensate me for the time/ emails, lost interest of my money and postage for the recorded letters etc etc etc

    • threads merged for clarity. Looks like they've accepted F&F and you have proof of acceptance. See what they say on your credit report, it can take a couple of reports to update depending on when Barclaycard declares it as partially settled/satisfied. Best not to post up and go radio silent though. 
    • So you have your refund? If you have your refund what's the problem?? What money have you wasted in getting a refund/ how have you wasted money in getting a refund? You can't sue them because they took too long to refund. The emails I gave you earlier were because I thought you didn't get a refund yet. If you already have it im not sure what your expecting?
    • Octopus are very approachable so I would suggest you contact them, advise them paying the amount in one go is going to cause you hardship and ask if it could be paid off at an agreed rate of an additional £xx to the next few months bills. I'd be surprised if they didn't agree.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What is the debt for ? is there a chance you can CCA them ? might buy you some time and put the acccount in dispute ? Also, official harassment letter is good although afterwards keep logging the calls there are several great threads and a sticky on dealing with harassment, another tip, when sending stuff recorded/registered mark the envelope clearly "Payment Enclosed", that way there is more chance of them signing for it, obviously it isn't necessary to actually enclose a payment

Do you think that they don't actually sign for recorded delivery? Are they allowed to do that?

Companies seem to do what they like when it comes to mail. It would appear that the royal mail doesn't care either, as practices such as bulk signing, postmen signing and no signatures at all are rumoured to be commonplace :mad:

Sorry to be so thick, but what do you mean by CCAing them? I've just sent a letter asking for a copy of the agreement (is that the same thing) and what does that actually achieve? Do I actually not want them to send it? I'm not even at the dispute stage because they won't reply to any of my letters - so do I just hang on, in the meantime sending my offer of £1 per month using tear off slip of the Barclaycard statement. I'm not very good at understanding forums, so perhaps there is a link somewhere that can explain the procedure? They won't take my house away from me will they?

Mercers are B/Card in house debt collection agency....they would like you to think they aren't,but they sit at desks next to the usual B/Card androids who phone you up

 

you won't lose your house,no......

 

they will either not send you your CCA,or if they do,it will be unenforceable due to missing prescribed terms

 

if they do either of the above,you don't need to send them anything,as the "debt" has become unenforceable

 

they've been trying to nail me since February,but nothing will stick because they have not sent the 2 agreements requested.....

Please see post #1 of nearly 600 over many pages. This whole thing starts with Mercers.

 

Revisiting who they are and what they do does not help at this point in this thread.

 

So I'll ask again ... please take this stuff to separate threads (you have one of your own now and people will help) and don't post about basics here. All you're doing is confusing an already overly long thread.

I love this thread. I've a long-standing issue with Barclaycard and Mercers that's a carbon-copy of this. I can't get Mercers to commit anything in writing, and they're yet to reply to 4 letters dating back to July of this year. Unlike many on here, I answer the phone every time they call, and ask them where my replies are. They hate having demands thrown at them as soon as I answer the phone.

 

Today, I heard from a bunch called 'Power2Contact', who's letter boasts they have been contracted by Mercers to find me as they are 'a specialist customer contact company with many years experience in contacting hard to locate parties, to act on its behalf in relation to accounts such as yours where it has lost contact with cardholders’.

 

!?!?

 

Given their boast, I wrote back asking them if they could use their powers to find the elusive creature of someone at Mercers who'll actually write back to me. I don't expect a response. :D

 

I also took the opportunity to skin them alive with all the tricks I've learned on here.

Not very good on forums and think I've posted this before - but I wrote to the Chairman of Barclays asking him in desperation to please find someone to reply to my letters. Stone the crows - we got a letter from a very senior person, not based in Northampton, another part of the country, saying he'd been asked by the Chairman to investigate. Had a decent conversation with him and when we explained our circumstances said "I don't see any mileage in pursuing something that isn't there." He's asked us to phone him with the budget sheet prepared by the CCCS and we have to phone him next week with the bad news that there isn't a lot there. I keep wondering about his comment, no mileage etc., and keep dreaming that when we phone he's going to wipe the slate clean. I know it's a dream, but it was a rather interesting statement by him. Thank goodness I wrote to the Chairman (have a habit of that when I'm dis-satisfied with something and always, always get satisfaction). At least we got someone to actually read our letters and have some sort of dialogue with a senior person.

Hi all, I'm really sorry for all of you who are suffering at the hands of Mercers. I had a Monument card debt and they harassed me constantly phone calls galore. It got so bad I felt like crying every time the phone rang. Luckily a kind family member helped me pay the debt off. Mercers are nothing but a bunch of **** Barclaycard should be ashamed for causing so much misery.

 

I know we get ourselves into debt but unfortunately we can't always help changes in circumstances and if it's a choice between paying a credit card or feeding your Children well the Children naturally come first.

 

Life is getting tough for families, well just about anybody in the UK with all the costs of living going up, These ruthless companies need to be more understanding and stop the mental torture they put people through causing stress and depression . The Government needs to step in and do more to prevent this from ever happening and make these companies act more reasonably and show some compassion towards customers who are struggling.
