Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A couple of points.

 

1) FIFA rankings for the countries mean absolutely nothing. All countries who qualify for a world cup have good teams, who can beat any opponent on a given day. Spain are ranked No. 1 and England No.10, but if they were playing south American teams on a regular basis, they would suffer. There are large numbers of south American players who play for European club teams. Europe is where the money is in club football, with arguably English and Spanish leagues being the most competitive. Perhaps English and Spanish players are overrated, made to look good in teams, with quality foreign team mates.

 

2) If England want to do better, perhaps the FA will need to organise more friendly matches, with the cooperation of the Premier League. Before any major competition, it would be ideal if England had a settled team of players for atleast say 2 years. who had played/trained regularly throughout the period. I think England struggle to gain the release of players from PL teams, as much as the FA would want. England no longer have club sides where most of the players are drawn from and therefore they don't play regularly together.

A couple of points.

1) But Spanish players have not been overrated as they have been the best in the world for at least the past six years and won everything, an era that has only now seemingly come to an end.

 

Two Spanish clubs contested the Champs League final just a month ago containing largely Spanish players.

 

2) English players regularly played together for their clubs during the 70's, with very few other foreigners in their sides, and they were rubbish then too, even failing to qualify for 2 World Cups.

 

Added to that, it would have to be the same reverse principle for the foreigners, for eg, does a side containing many English players, like Liverpool, make Suarez look bad?

 

No, because he is class and even a half fit Suarez is better than any English forward in the game.

 

I've not seen many other English based foreigners suffer in this World Cup either. RVP looks on fire, Gary Medel of Chile doesn't look tired, neither does Aguero, Kompany, etc etc

And you know the saddest thing - they were undone by some little-known upstart from Uruguay. I think his name was Sanchez...no, sorry, Suarez, that was it. If only anyone in England had heard of him before. They could have developed a plan to deal with him.

It amused me all the wows, oohs and aahs about Luis Suarez and he's superb probably the best in the world and all that rubbish. If he's that good, how come Liverpool didn't finish top of the Premier.

 

One player, even an excellent one, wouldn't normally be enough to win a, what, 38 game EPL campaign. But this was only one game, and he was the difference between the two sides. This was predictable, and it was naive on England's part not to keep an eye on the guy.

 

Liverpool didn't win the EPL because of their defensive failings, I'd say. I don't like Suarez much, but when he's not too busy diving, it's hard to deny that the boy can play football.

I agree. I believe the main reason he is good is because he adapts to the type of football of the match in hand and doesn't stick to a same old style, 'that's how we play and that's how we will always play'. That attitude of players and managers gets you a flight home as we have seen time after time.

spot on.

he also nearly scored twice from corners each the same through our poor defending. blimey did our defence not learn from his first corner!

 

(though he did come close re the epl after coming back from suspension)

Yes, agreed. "We've got a gameplan" is one thing, and a good thing usually, but not if the team as a whole lacks versatility of thought. As you note, Suarez wasn't just playing football, he was playing football against England.

But the top players are playing in over 50 games a season, with training and all the other commitments they have. It must be a very tiring profession and with weekly pay at £100k+, they must have many sleepless nights thinking what to do with it.:smile:

I disagree with this simply because if a side defends the nil from the start of a game but scores then they win.

 

Liverpool conceeded 13 more goals than Man City last season and only scored one fewer, which indicates that their defence was the reason they failed to win the league.

 

Had Liverpool's defence not conceeded those 13 extra goals then they would have been champions.

 

However, had they scored even a 100+ more goals then there would have been no guarantee of the title.

 

It was their defence to blame.

 

Suarez & Sturridge did their jobs, as they fell just a fraction short of the champions but the defenders came up short by about 25% in comparison to City.

Nothing brings the world together like football, it is the most widely understood non spoken language in the world, anyone can play it etc. The only down side is the idiots at FIFA who run football.

jumpers for goal posts, street footy, and all that. agree. thing is now though, it seems all about the money etc, at the expense of joe bloggs?

eg, is funny, bigwig barristers talking about the arsenal or chelski on a monday. only cause it is the london in thing. doesnt quite fit. 'prawn sandwiches' brigade as keane once mentioned. :)

The scvmbags didn't even have the guts to come back to our major airport but decided to sneak back in via Manchester. This really does say it all.
