well I would assume the tomlin was agreed with a debt purchaser and not the original creditor?

if so, they can't off set unless they buy the debt back?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

A Tomlin Order is only an agreement to halt/settle litigation on a court claim....you/they are bound by the terms of the schedule of the order.If either party breach the schedule then the other party has liberty to proceed with the pending litigation.

 

The debt becomes live again...so reading from the very little details you have provided...then yes they can off set against that debt

Hi Andy

 

OK i get it now

 

that is the queried answered. the OC with the tomlin order was a bank. the PPI claim is against the same bank, so any PPI award can and will be used to off set against the tomlin order debt even if the payment terms for the tomlin have not been breached.
