    • Thanks for that, Bazza. It sheds some more light on things but I’m still by no means sure of the OP’s father’s likelihood of successfully defending the charge. This in particular from the guidance stands out me: He does not meet all the s88 criteria. S88 is clear and unambiguous: It makes no provision for either the driver or a medical professional to make a judgement on his fitness to drive under s88. S92(4) and the June 2013 guidance you mention defines in what circumstances the SoS must issue a licence. It does no modify s88 in any way. However, delving further I have noticed that the DVLA provides a service where the driver can enter a relevant medical condition to obtain the correct documentation to apply for a licence: https://www.gov.uk/health-conditions-and-driving/find-condition-online I haven’t followed this through because I don’ have the answers that the OP’s father would give to the questions they will ask and in any case it requires the input of personal information and I don’t want to cause complications with my driving licence. It is possible, however, that the end result (apart from providing the necessary forms) is a “Yes/No” answer to whether the driver can continue to drive (courtesy of s88). With that in mind, I should think at  the very least the OP’s father should have completed that process but there is no mention that he has. But the significant thing which struck me is that it is only the least trivial version that does not require a driver to report his condition to the DVLA. But more significant than that is that the SA Trust makes no mention of continuing to drive once the condition has been reported. The danger here is that the court will simply deconstruct s88 and reach the same conclusion that I have. I accept, having looked at the DVLA guidance, that there may be (as far as they are concerned) scope for s88 to apply contrary to the conditions stated in the legislation. Firstly, we don’ know whether there is and secondly we don’t know whether the OP’s father would qualify to take advantage of it. Of course he could argue that he need no have reported his condition. The SA trust certainly emphasises that the condition should not be reported until a formal detailed diagnosis is obtained. But the fact is he did report it. As soon as he does that, as far as I can see,  s88 is no longer available to him. Certainly as it stands I maintain my opinion that he was not allowed to continue driving under s88. The only way I would change this is to see the end result of the DVLA exercise I mentioned above. If that said he could continue driving he would have a defence to the charge. Without it I am not confident.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

We placed an online order with a shop called 'Total Wargamer': http://www.totalwargamer.co.uk. The order was placed about nine days ago and we havereceived no goods.

 

We contacted them today, took several attempts as nobody will answer the phone, and one of the staff spouted stuff about having their credit halved etcetera. This concerned us as the order was for about £100 in Xmas presents for our sons. The staff member also stated that they do not hold card details on their system, that's why they took the money straight away on the day of order. My wife requested a refund and he stated that the mony will be refunded by Tuesday 27th November.

 

Phoned Consumer Direct and they advised us to get it in writing form them.

 

Following the call we realised that they can't refund the money as they don't have our bank details, see above. Tried about forty times to contact the shop and nobody is answering. Even emailed and no reply.

The refund will be issued by the same means payment was taken. I do not believe they do not keep card details for a period of time to allow for refunds.

 

How was the payment made? debit or credit card?

 

When calling dial 141 infront so they don't know its you calling. I don't normally reccomend ringing but looking at the place it would appear they are simply a one man band with a home phone.

 

However I would wait now that you have emailed until the end of tuesday 27th to see if a refund has been made. The date given does appear to be correct for a card refund to go through which is 3 to 4 working days.

Just checked the Web and these guys are just up the road from where I work in a local out of town shopping area

 

Address is

Cadbury Courtyard, Blackminster Business Park, Evesham, WR11 7RE

 

The shops in that area are legitimate shops, however, I can't guarantee this particular company is trustworthy, but knowing the shops there, I would be surprised if they weren't.

For future reference, should you have not received the refund you could have called your card company/bank and requested a charge-back.

We would like to apologise to TheLion for the issues that they had with their order - although we would have delivered within our delivery deadline (this expired yesterday) the customer simply worried once we mentioned about the issues we were having getting the items to them.

 

I am glad the refund went through fine - we are not having issues refunding (as you can see).

 

As I mentioned when we answered the email the customer sent to us we don't hold card details (as they mention in their first post). These are held by our card processor, so we just click a few buttons so that they return funds - I would assume this is the same for all/most online businesses.

 

Labrat mentions Maelstrom Games going out of business - it is this company going under that has caused suppliers in the industry to cap credit - mentioned by the original poster.

 

Total Wargamer has been affected by this (as all retailers in the industry have been) - I hope this clarifies the situation.

i can beleave maelstrom going downs affected a few people

 

from what ive heard they owed in excess of £90,000 to people, shame really its less than a mile from me - few more jobs gone

Looking at filed accounts for 2012,the value of the company nosedived from 2011.It was at its peak it 2010.

Liabilities and assets from 2009 shows like for like with both figures on par and climbs of both figures.

It is remarkable how they now show as zero cash at bank.

But the company still shows as trading.

Perhaps there was a cash flow problem ?

Maelstrom Games were apparently being naughty. They knew they were losing money and close to going bust yet kept taking orders and purchasing a new building. Apparently them going bust in that going bankrupt way would of been bad for the industry, so Wayland Games stepped in, bought Maelstrom's debt and forced them to pay it sooner rather than later. Obviously Maelstrom couldn't pay it, forcing them into official admin. Which apparently was better for the industry than them going outright bust.

And regarding Total Wargamer, they can be trusted but don't ever expect to get your goods on time, they are very poor on that. Used them many times, always late and always an excuse why they were late, yet I'm still forced to pay the full p&p.

I placed an order with totalwargamer over two weeks ago, it's not dispatched yet.

 

I tried contacting them through their online support ticket system on Friday, no response yet. Emailed directly yesterday, just got another ticket number. So of course no response there.

 

Tried to call 3 times yesterday, so far 3 times today. No answer. It rings for a bit then beep, line goes dead.

 

Not impressed. I've ordered from them before and while there have been some delays in delivery (compared to their advertised timescales), the products have at least been sent out.

 

Anybody have a suggestion on how I can get them to refund my money?

I placed 2 orders on 13th Jan 2013 and am still waiting. I have tried phoning them from 3 different numbers 20-30 times but it just rings 5 times then cuts off. I have also tried going through their support section to be told they will chase up the warehouse.

 

I have ordered from them before and they have never managed to deliver within the 5-10 business days. I only ordered this time because it was 30% off and I thought I should give them another chance.

 

I don't want a refund, I want what I ordered for the price I paid within the time period they claim!!!

I've had enough. After phone calls over multiple days, emails, online support, their blog and even twitter, I've had no response.

 

So have contacted my credit card provider re recovering the money.

 

Have had issues before with them re delivery timescales, but it's now 3 weeks since placing the order and it's not even dispatched yet.

Wish I had seen this earlier. I placed an order last week and when phoning the phone rings then line goes dead. Have tried emailing and their online support system but no joy.

 

Edit:- Communication received from them. If you order from them be aware of postage times and if there is an issue contact them via facebook.

Ive had issues with them in the past, and up until recently just tended to accept that they would be slow (same as maelstrom etc), so if i wanted it quickly, then i had to get it direct from gamesworkshop, or wait.

 

Are there any other companies out there offering quicker dispatch?

Giftsforgeeks has always been my primary site for online purchases outside of the official GW site (and they actually answer the phone).

 

Waylandgames has been referenced quite a bit but again their feedback is heavily conflicted interms of slow deliveries and a poor stock display info.

 

Totalwargamer unfortunately has been slated on every major GW related forum im part of for their abysmal delivery times and non existant customer services. They NEVER answer the phone and the fabled support ticket system may get you a response in a week,Facebook seems to be one of the only ways to get a reply out of yhem.

 

In summary i would recommend going elsewhere for your hobby needs as it doesnt matter if your order is worth £20 or £200 the horrible delivery times and lack of customer service remains the same

I've also had terrible service from Total Wargamer. Made my first order in early February. After two weeks I emailed and they replied that they were receiving a delivery within 48 hours and I would receive shipment within days. Nothing since, and no response to any of my follow-up emails. They don't answer their phone either. This seems to be their standard response - a generic email excuse for non delivery, followed by silence.

 

I see that they've now set up another company - MYTHREAL. It's operating from exactly the same address, offering the same products. It's just a re-skinned website. I'd strongly suggest everyone avoids Mythreal as well, unless you want the same non-delivery and same lack of response to enquiries.

I preordered the x-wing wave 2 from them. Had no response and tried calling several times to cancel. Then out of the blue a week after everyone else ships the items, I get a note saying dispatched.

 

Would not be using again and will ensure people know not to use.

Over four weeks now since my order with them and goods outstanding of £200 in value. I can't get through on the phone, they've ignored my two Facebook messages. I've emailed them and set up multiple support tickets asking for my money back.

 

Do not trust this company. Or its sister company, MYTHREAL. Bunch of jokers.

 

Like the poster above, I tell everyone I meet not to use them and then explain why.
