    • A local business has been parking on an off-street parking space in front of my garages (in a side street).  I wasn't using them for a while so didnt bother to do anything.  But now a second local business is also using the osp - taking it in turns with the 1st biz.  This has started to nark me.    The employees choose to drive to work.  There is no private parking in their business's street.  But there are some underground secure garages in their street - which cost apx £2.4k/y to rent - which works out apx £6.60/d. (I believe one of the biz owners already rent one for storage purposes).  If the employee had to park on a meter it would cost them £6.60/h - £66 for 10h and have to move every 4h.  They just don't want to pay for parking. I haven't confronted either of them.  Instead I just put 2 clear "no parking" signs in front of the garages. And a note on one of the cars specifically saying that as they don't live or rent in the street and it's private land could they stop parking.   They ignored that.  And just put notes on their dash with a # to call if one needs the car moved.  Theres a sign and they've been told in writing to stop parking. And they are just ignoring it.    I don't what a confrontation.   I don't want to go to the expense of bollards (other than maybe traffic plastic ones - but they'll probs just move them).  Council won't do zilch cos it's private land. And police won't get involved - unless I clamp/ tow the cars and then they'd be after me, not the drivers!   What's the best thing to do?
    • yes might be the best idea. you'd only at best get 8% flat interest and that unusual on a GOGW if this was what it was. simply contact the FOS and let them know its resolved. dx

    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real. Get a screenshot
    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thanks - as you say they apparently sent some T & C's - but the copy is so illegible it is not credible. They are the copy they sent me with the Mr Sample letter about the new card. Just trying to get my info in order as if I defend will need to be well informed etc. The Mayhew case is good reading as so similar to my own circumstances. Don't want to be a pest on the site but need as much info as possible

default notice dated 11/11/2008 - arrived on a Saturday 15/11/2008 - offering me fourteen days to remedy "from the date shown" there is no date shown just the date 11/11/2008 so short of the fourteen days and then not giving me a specific "date shown" - tried to upload scanned copy but system keeps saying it is the wrong size and I need to resize - can anyone advise on how to do this please. Checked SAR paperwork - just piles of sheets with figures on which I think is for their use all scribbled on in red pen. Only other document in SAR is copy application form again - no default, no letters, no termination notice.

Struggling to find anything with old charge card account number on - but have copy letter they sent in response to one of my requests - enclosing new T & C's for credit card but they are practically illegible. Got my paperwork together now today - The DN I am fairly confident is invalid. Also have letters from M & S saying "we will no longer correspond with you....only speak to you on the phone.....

Am I right in thinking the document supplied as the credit agreement was the application form for the original store charge card; and that store charge card was automatically swapped for a credit card without you ever applying for it.

If you reply to the summons saying you'll defend in full, this keeps your options open. This gives you the max possible time to consider how you want to proceed.

 

Request documents that you want from the bank's sol'rs using the CPR 31.14 request. This gives you the right to ask for sight of documents referred to in their POC's. See here - http://www.justice.gov.uk/courts/procedure-rules/civil/_old/part31#IDA4W0HC

will be sending my AoS off this week and will be preparing a defence document - will need guidance on this (not the facts of my case but how to word it etc) I understand i have 14 days from A oS deadline to submit a defence. How would I request an extension if response to my CPR request is not forthcoming please

this is some dx100uk info re this:

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN]

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

.

yes - the one they sent me originally but not in response to my CCA request last week. I posted a link to what they sent (scanned in on original receipt) so you will find that a few posts up . Just scanning in another letter re replacement of chargecard with credit card. managed to scan in default notice thanks

Ah, I think your problem could be that you are loading images rather than pdfs.. which would actually be much easier for you :)

 

Follow instructions below

 

Dx100 – Instructions on uploading pdfs

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

Judge Henrietta Mannerse held that where a store card had been upgraded to a Credit Card - and no separate agreement had been sent to the customer, that the requirements of the Consumer Credit Act had not been satisfied and the debt under the credit card was unenforceable.

Applies especially to Harrods cards, Debenham cards and Marks & Spencers - (all GE Money).

sorry about the images -

 

I have really struggled and thought better to upload something than nothing

- yes -

 

the only new "agreement" ever received are the copy letters posted up today in posts #64 #65 #66

which are copy letters sent to us by M & S after we challenged them for completely ignoring/disputing our "dispute" letters

and passing on our details to several DCA's which we fought off every time using template letters from this site.

 

They also terminated after sending the default letter I posted up on this thread today.

 

I don't think they have actual copies of these letters with our name and address on

- they are sample letters -

 

I sorted out all paperwork yesterday and it fills a plastic crate

- not counting all my responses which are stored on memory stick ready to print off if needed
