    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.
    • I'm not sure that I fully agree with my site team colleague above.  My understanding is that there is nothing to stop you recording but it is strictly for your own personal use.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

I hope that someone here will be able to offer some advice.

 

I recently bought a MK5 Golf from a private seller on Ebay. The car was described as excellent condition etc and the seller is a mechanic and stated that all repairs / modifications had been carried out by him.

 

Got the car checked over by VW as a couple of Engine lights came on, and they have come back with a list of about 15 things wrong with the car, some of which are major parts that will cost a lot of money to fix.

 

I know I don't have many rights as I bought the car from a private seller and I am fully aware that I might have to suck it up and get rid of the car. :(

 

However I was just wondering if the fact that the seller stated that he was a mechanic and carried out all repairs himself (after saying that the car was in excellent condition) would give me any sort of right to complain that the car is falling apart a couple of weeks after I purchased it? If he did the work himself could it be his fault that the car is broken and do you think I could prove that he knew about the faults before selling it to me?

Hi did you have a look at his feedback to see if has sold many cars. If he has then you MAY be able to treat him as a trader or complain to ebay that he is saying he is private seller and you think he is a trader.

If the car has been described as in exellent condition and it has been proved not to be the case you can first ask the seller to rectify the faults. If he refuses you can open a dispute with ebay. "Not significantly as described"

Because he was a private seller does not mean you have no rights under soga. You just have less rights, ie title and description rather than title, description and quality for a trader. If the item was sold with a description of in excellent condition and it was not then it was misrepresented.

Butr ebay will take the buyers view of what is excellent and if the buyer disputes they normally refund the money and chase the seller.

 

Err.... where did you get that from? E bay wil tell you that they are merely an advertising medium and take no responsibility for any vehicle description. Obviously if you got 10 bad reports on you in a row as a seller they would ban yuo for a while, but DEFINITELY no refunds I'm afraid.

 

there is no pay pal protection on cars by the way....

Errr it happened to me I had a great eBay account and I sold something which was in great condition I even had the pics to prove it. Buyer decided they didn't want it raised a dispute with eBay who did not look at any of my evidence. They refunded the buyer and chased me for payment. My eBay account had over 90 stars and 100% positive feedback.

Any description on Second hand items applies to at point of sale.

A second hand car can develop all sorts of problems at any point in its lifespan, as any car owner will vouch for.

If at the point of sale the vehicle was as described, which by paying you formulate a contract then that is usually the end of the sellers Liability in a private sale.

If it were not, at what point would you cease to hold the seller liable for repairs to what is now your car ?.

Six months ? Twelve ? for life ?

The term is Caveat Emptorasin buyer beware.

However if ebay have some redress then this may be an option.

That's the key, but we don't know because the OP hasn't answered the question posed in post #2. If it turns out that the seller is in fact a trader, the situation changes dramatically.
