    • Hey people, I've been browsing this amazing forum for the past year and recieved a letter today which has made me require some help. Received a claim form from Cabot in the Civil National Business Centre in regards to an Aqua Credit Card taken out in 2018. I failed to make payments due to financial hardship and have not taken out any credit or uses any forms of credit since. Received a lot of letters from Cabot and their solicitors Mortimer Clarke which I've ignored    By an agreement between New Day Ltd RE Aqua& the Defendant on or around 26/03/2018 ('ths Agreement) New Day Ltd RE Aqua agreed to issue Defendant with a credit card. The Defendant failed to make the minimum payments due. The Agreement was terminated following the service of a default notice. The Agreement was assigned to the named Claimant. Cabot Credit Management Group Limited, acting as servicing agent of the named Claimant through its Appointed Representative (Cabot Financial (Europe) Limited), has arranged for these proceedings to be issued in the name of the Claimant. The named Claimant may be entitled to claim interest under the Agreement but does not seek such interest and instead claims interest under Section 69(1) of the County Courts Act 1984 at 8% p.a.from03/03/2023 until date of issue only, or alternatively such interest as the Court thinks fit THE NAMED CLAIMANT THEREFORE CLAIMS 1. 3800.82 2. INTEREST OF 379.84 3. Costs How would I go about this and what could happen? I don't remember much details about the card either.
    • cause like you said in post one, 99% of people think these are FINES (it now reads charge). and wet themselves and cough up. they are not, they are speculative invoices because the driver supposedly broke some imaginary contract by driving onto privately owned land which said owner may or may not have signed some 99% fake contract with a private parking co years ago, thats already expired or has not been renewed or annually paid to employ them dx
    • My car DVLA details are 100% correct and up to date, guaranteed.  I lived at my address longer than I have owned the car and made sure the details were correct when we transferred ownership of the car, so it's not that.  It must be their second-hand eBay cameras.  I've emailed the CEO with evidence and laid it on.  I will keep this post updated with the outcome.  Thanks again FTMDave .  I appreciate the guidance. I hate these predatory parking cowboys.  How are they even legal?
    • there isn't one use that default dx
    • upto you, if you have no assets like a home in the UK, there is absolutely nothing they can do even if they do get a judgement. i see you state last payment was 2021, so i will guess your notification to lloyds of a change of address was sent within the last 6yrs so they should have record of it on their system. why not give them a ring and ask what address they have for you? you could do AOS and defend the claim stating you are and have been resident in xyz since date, here is proof.  you could also send that to PRA demanding they discontinue the claim immediately. see what you can find out. you've till atleast the 19th (aos date) . dx

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, seems to be down, don't know about the licence being revoked, no announcement from the OFT. Toothfairy is still up, with Microcredit as one of the names on it.

It should always be one licence per trading name for this shark like industry - stop the abuse of punters happening.

Also the shared platform with other lenders is seriously disturbing, especially as it only seems to exist to allow THEM to get money from people's bank accounts.

Glad I got out of this cycle about four years ago now!

True, but i think one investigation and credit license revocation should have really been enough toi get them shut down permanently, not this oh look they made a new company, lets investigate again thing that seems to be current practice.

Same problem really applies to TF / Speedcreit / NDR / MHB which are all officially separate companies, but in reality one and the same, one investigation should be enough to take out the whole lot and not one by one.

Well it is good news that speedcredit web site is closed, but how long will it be shut. Also what will happen to our payday debt ? Will they state is been sold to a third party. Ie sold to themsleves and just increase the outstanding amount.

If they claim they have sold the debt what could we all do to stop this company

Just done a search on T/F bank account number and this company has appeared. The site is live,as I entered my old Speed Credit loan details into it and it was directed to the T/F site.

http://www.digitalfinancialservices.co.uk/

There is hardly any details regarding this company on the internet. The site gives a CCL 634032,which belongs to Cash It Up,who are according to their site, not trading.(no loans )

DFS did have a compulsary striking off cancelled in January of this year.Accounts were filed in February of this year.

Any info please.

Regards,John.

They lost their licence but appealed against it. As per appeal rules, they get to keep the licence until the outcome of they appeal hearing.

The downside is that the appeal hearing could take months or even longer to happen.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Anthony Agnelo Paul De Nazareth

Tuomo Kari Kustaa Mäki

These are the people supposedly running the business at Digital Services, http://www2.crw.gov.uk/pr/default.aspx, not seen those names in any speedcredt / tf / mhb / ndr registrations.

The company registration itself appears legitimate though, http://wck2.companieshouse.gov.uk/fb4488e01570251e0208d16180898374/compdetails

One of the two people running it (Maki, the finnish guy) used to be the director of mco capital, mco should ring a very big alarm bell, see here, http://www.independent.co.uk/news/business/news/payday-lender-fined-more-than-half-a-million-pounds-after-being-duped-by-id-fraud-8026569.html

edit:

http://popcredit.co.uk that is MCO Capital still trading despite not having a license any more.

No doubt they will add a lot of fantasy charges, most of which won't be enforceable, but that won't stop them from trying to scare you into paying ever increasing amounts, there are people who have posted on other threads here about TF / SC trying to charge in excess of 19000£ for a loan of 100£.

All you owe is original loan amount plus 1 month interest (unless it was for 14 days only, then you owe just he two weeks interest obviously) plus initial default fee (however that fee depending on the amount could still be subject to challenge) minus any payment already made.

How are we even sposed to pay loans off if they want us to? What a disgusting company.

Their Bank account details are as below:

Barclays Bank

Account Number: 93462382

Sort code: 20-50-94

Reference: Use your mobile number 447xxxxxxxx as a reference

Some more intel on the finnish connection, Tuomo Kari Kustaa Mäki was also involved with the finnish company TEC Trust Equity Capital Oy, which was acquired by you never guess... a company that makes gambling software http://www.mgscorporation.com/news_updates/49.html based at an EBS BOX address, of course I dug up the real address anyway, 27/28 Eastcastle Street London W1W 8DH United Kingdom.

Now if you where to ask what does that have to do with payday loans? well, turns out one of the Directors of MGS happens to also be director of:

UKCASHADVANCE ltd

FASTLOANFORYOU ltd

LEAD INVESTMENT ltd

OK INVESTMENT ltd

FIX CAPITAL ltd

STATEMENT CAPITAL ltd

QUICK INVESTMENT ltd

NEXTCREDIT ltd

CREDIT ON DEMAND ltd

all of them registered at one and the same address:

WISTERIA CAVENDISH HOUSE

369 BURNT OAK BROADWAY

EDGWARE, MIDDLESEX

HA8 5AW

GB

Now if we look up HA8 5AW at the credit license register we find something surprising...

It is the exact same address as where the Credit license for lending Stream is registered, among several others,

Long list incoming:

Lending Stream ltd (license status: currrent) with trading names:

Check2Cash

Direct Loan Shop

Flexbuy

FlexCash

Flex-Cash

InstantPounds
