Good to know because Last minute is an awful OTA. It actually doesn't seem to be a big secret. If you click the link below (which is the main link from booking.com home page, and has lastminute written in it!) you will see the slogan "Booking.com Powered by Last minute" on 3 separate areas at least within the same page! Just a moment... BOOKING-DP.LASTMINUTE.COM Anyway, do let us know what exactly happened and we can try and see who you should be claiming from.

    • Hey there, as the plane went tech you are entitled to the £520 x2 compensation under EC261. This is a clear cut case. Just claim straight with Virgin. However you are not entitled to a full refund, since you were eventually flown to the final destination; of course that second flight should have been totally free of charge; if not you must bill Virgin for it. Your mum+sis are also entitled to full reimbursment of taxis to and from the hotel, as well as meals+refreshments that they had for the entire duration of the unexpected stop, including both at the hotel and airport. (Just stay reasonable: no claiming for 49 pina coladas at the beach bar) Was their luggage returned to them during the unexpected stop? If not they may also claim for any toiletries and clothing that they had to purchase during the night stop. I understand the hotel has already been paid for, just don't forget the rest. Hopefully they have kept the receipts. Otherwise bank statements should do the trick. You need to claim for this in addition of the £1040 Other than the above there is no statutory compensation due for missing out on 1.5days of holiday. You could however talk to someone at customer service and make a polite request to extend your stay by another couple days and see if they will do it for you free of charge (providing they have space). Or if not, you could possibly get some token gesture of money back or voucher off your next holiday. It's worth trying. That you paid £700 for a name change is unfortunate but it's completely unrelated to the situation at hand. Above all I hope they don't worry too much about this mishap, and make the most of their holiday. Compensation is practically guaranteedwhen they are back. Just tell them to save all receipts they have and don't worry about the rest until they're back!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

Just over a year ago we bought an iPad 2 for my husband (I'd already got an iPad1).

Earlier this year he tripped whilst walking down the steps and landed with his knee on the ipad, bending it and rendering it unusable.

 

He rang the claims no. and was told it would be covered under accidental damage, and send it to the claims centre which he did.

After two weeks he had heard nothing so rang the centre, only to be told that the claim was being denied due to the damage being excessive in relation to the reason for the damage.

 

They returned the very bent iPad to us.

We appealed, writing to the infamous Mr Perryment,

who said he had investigated the claim and agreed that the damage was excessive,

pointing us to the fine print which talks of non-accidental damage.

 

I was particularly impressed by Mr Perryment's abilities,

as we had the iPad during the entirety of his investigation.

 

We sent a letter before action, which was responded to with the same reason

- excessive damage in relation to reason for damage.

 

We have not seen any evidence of tests/reports from Currys which explain what damage isn't excessive when a 16 stone man falls and lands on an ipad.

 

 

So, we filed a claim and have now received a response which says that they intend to contest the claim and they require 28 days rather than 14 days to prepare the defence. Does anyone have any advice as to what we should do now?

I did wonder about an independent report, but have no idea where I would get one from - clearly not Currys!

 

I will flag your thread and see if other Site team might know.

 

It seems this "Whatever Happens" product is not all it should be. There have been other caggers mention they have had problems.

 

I am not sure that the Curry's Rep will be able to advise/help if this is now subject to litigation.

They clearly think we are trying to make a fraudulent claim,

but the only evidence they have provided is by saying that the damage is excessive in relation to the incident caused

and then referring us to the T&C highlighting the bit that refers to the insurance being void if the product is misused.

 

Surely if we were trying it on, we would have damaged the older iPad1 to get a newer replacement?

Clearly, 'whatever happens' is a misnomer.

Clearly you need more information, their decision doesn't stack up with regards to the info they have provided, which is what you've said in your initial post.

Now this is subject to litigation you can ask for this information by way of CPR..

or just do a DPA request and insist on the coverplan report being included

I doubt there will be sufficient time for SAR, labrat - they have 40 calendar days to comply and you can guarantee they would leave it right to the last moment :(

apple are sometimes very good and might well replace it free.

we see SO much of this gioig on with useless insurancs through them

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

your right on the too long for the SAR my mistake but definatly ask under CPR as it WILL be something they rely on

Just wanted to say thank you and update on the situation.

 

About a week ago we received a notification that they wanted 28 days to dispute the claim,

 

then today we received a letter informing us that they had reconsidered the case

and were prepared to accept the damage was caused accidentally

and included a voucher for the whole amount.

 

So, result!

 

But very frustrating that we had to go this long and this far to get them to acknowledge what should have been acknowledged straight away.

 

We went and got the new iPad today,

and the man behind the counter tried to sell us the extra cover again.

It was really difficult to be polite at that point...

 

Anyway, thanks for all the support and guidance it was much appreciated.

Very good news - yes, it is unacceptable that you were put to all the trouble in the first place - however, it is resolved now and hopefully you can put it down to a "one off" experience !!
