    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No! once you've paid 1/3 it becomes protected. *if* they do decide to come and take the car back without a court order you would be entitled to claim back every penny you have paid in the agreement.

 

With regards to to the interest you're paying, you may want to consider a Time Order, that is if you wish to keep the vehicle.

a few other things.

 

1) if you have paid 50% of the agreement and you have not defaulted you can return the car as a voluntary termination, you will have to put this in writing and find out where to return the car!

 

2) it is well known that due to a bit of a contract mixup alot of the yes car credit agreements are TOTALLY unenforceable as they messed up on what they classed as charges/credit charges.

 

3) if they do try and repo the car without a court order, you are entitled to all your money back AND to keep the car

 

what a result that would be!

That's interesting. I still owe them £354 and am having trouble paying it at the mo - I got a letter from them today saying, pay back or else.

 

I'm not trying to get out of what I rightfully owe, but would love to find out how I can get something back.

 

I mean, £9000 for a car that was worth £3000 and is now worth £800, dammit!!

But then again, what do I know?

Read your thread with some interest as a friend of mine was in the same position, and not getting anywhere with the car credit company. She got into financial trouble after about 7 months and the car credit company was getting very heavy handed. Although the financial side in not in my scope, I did however find out the company she purchased it from was claiming to be respected members of various institutes that I am a member of, and that the car she purchased for £7000 with a 120 point safety check was in fact a £4000 car with on inspection 42 problems one of which could have been life threatening. After checking out their bogus institute claims I wrote to them on my friend’s behalf threatening them with legal action (Sale of Goods) and so on. In this instance my friend’s nightmare came to an end when the credit car company agreed to take back the vehicle and return ALL payments and fees as long as no further action was taken against them.

I know this does not help your situation but it may be worth looking at other aspects of the sale/purchase and so on to see if there are any other avenues you could explore. If you need a current value, a time line valuation or any other help, send me a PM, I HATE these types of cowboys and what they do to the industry I have worked in for 23.

I was done by these guys years ago too!

I bought a car through them, silly I know. And took out the warranty they offered. Well that appeared not to be worth the paper it was written on. As my car "blew up" about 4 months after I bought it. It over heated and everything melted. I know you guys are probably laughing like hell right now, but let me tell you, I wasn't.

 

It aspired after a thorough check over that it was leaking water (unbeknown to me) and should have been paid for. However, YCC and that warranty co. said it was down to neglect (me not topping water up) now I may be a woman, but I aren't stupid. I had a H reg banger for long enough before I got this car, and in 2 years, I topped the water up once!!! Now after apparantly having a 6m point check, I would assume the water and oil levels to be full or near as damn it before I took delivery (I have since worked in a garage selling volvo's, therefore a bit more clued up!) So... why after just 4 months did my car go Bang? And why did I have to fork out another £1500 for a new engine? (got one 2nd hand, wasn't paying Vauxhall's quote of £5000 for a new one, car not worth that much in the first place!)

 

IMO, ***DO NOT EVER SAY YES, TO YES CAR CREDIT***

thought you might be interested in my situation; sounds v.similar to yours.

 

In January, my bank balance was so low, my DD to DAF was not paid. I cancelled the payment the day before it was due, rather than take a £35 hit, and probably several more, from the bank. within a week, I'd paid them £50 (about a quarter of the regular payment.) all the regular payments from Feb. onwards have been paid as normal, and I've been catching up on the outstanding amount bit by bit.

 

They are still sending me weekly reminders, and charging £15 a time for them. They now seem to think I owe them about £380, when as far as i'm concerned it's about a quarter of that.

 

I'm quite interested to see how far they'll take it, because they have not taken any further action in 5 months, and I don't believe they will, either.

 

I fully intend to make a legal claim to have these charges cancelled, which is where this thread started. Are you still thinking of making a similar claim?

Yes Car Credit (arseholes inc.) issued a default notice against me in error. After much wrangling and debates via solicitors, my insurance payments were refunded in full. I am also sueing the comapany for gross negligence with reference to a default notice applied in error and will be seeking compensation and costs through the County Court. I have been offered a sum to settle out of court, however I have not accepted this and look forward to having my say in front of a judge. It should also be noted that i have a letter from Direct Auto Finance, saying that it was entirley their fault that the default was issued in error and that at no time was my account ever in arrears. I cant wait to goto court as I can honestly say that if you or I ran a company the way these idiots do, we would all be fired for idiocy and for gross misconduct.

I bought a ford escort with yes car credit nearly three and a half years ago. However I stopped paying in December as I just couldn't afford to pay £132.00 for another 8 months. The original cost of the complete agreement was £6372. However my car is now worth around £450 and I still have £1,100 to pay. I asked them about my gap insurance and my ppi and warranty. Lo and behold I am now told I never took out PPI when I know I did but I just can't find my contract. There is no way I would have agreed to a whooping £6372 for a ford escort which does not include other insurances, they are now apparently saying I only took out gap insurance and warranty which was £13.29 a month. What can I do?

ask them for a copy of your contract. if they say no there is a template letter to send as they cannot hide it from you - I think it is a CCA but not sure - can someone help here?

its a sar request you need to do

 

it will cost £10 and they have 40 days to comply

 

use a postel order and never sign, print your name

 

they will have to release all info they have on you

 

it will be a lot, so quite a lot of reading, but you will discover plenty of gems in the pack

 

when you have your sar come back to your thread for advice

How do you get in touch with ycc or direct auto finance..

I am being persued by go-debt...

And have just seen on the agreement they said they have off d.a.f...

and it clearly states my deposit was taken off the insurance not the car....

Only £60 like but were do i stand...

Hi all , well im one of the unlucking people that fell victim to yes car credit , after haveing serious accident at work , and paying this rip off ppi insurance, i still denied , the benifits of the said policy, its now 2010 and a company called DLC , who purchased the debt ,are still chasing for nearly six grand, has any one been succsesful in obtaining a return on the policy in the form of ppi refunds . i have looked at the various links within posts above but the site as listed does not appear to be active any more.

does any one know the insurance company that , yes car credit used for the ppi's as i cant claim without the information ,

 

any help would be great

Do you have any of the documentation that was signed from when you first 'purchased' the car? If you have it can be found there ( 3 are named on my documents but, at work so am unable to tell you which ones atm! ) If you havn't got any documentation follow the directions that postggj has given in regards to a SAR. It may also be a good idea to start your own thread up so as not to hijack someone else's.
