      Thank you very much for your letter in regard to the above mentioned shipment.  Due to the high volume of parcels coursing through the courier network each day, undergoing continuous processing and handling, certain packages may experience delays or even can get lost in the course of this journey. Please note that due to the time that has passed, this shipment has been declared as lost.  I have today processed the claim and made offers to the value of £75 as a goodwill gesture without prejudice. I do acknowledge that you have mentioned in your letter that the value was higher, however, you did not take out any protection to that amount. The protection for this shipment was £20 and we will not be increasing our goodwill offer any further.    Please log into your account online in order to accept our offer. Once accepted, our accounts department will process the claim accordingly. The claim payment will be processed and received within 7 working days.                                  In addition, a refund of the carriage fee will be processed as a separate payment and will be received within 3 working days.  If I can further assist, please feel free to contact me.   I have also just noticed that yesterday afternoon they sent me an email stating that "after my request" they have refunded the cost of shipping. I did not request the refund so will mention that in my letter as well.

      Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy? Red lots of different threads on here. And unsure what true and what isn’t.

As for the council and HMRC, fair enough and I thought Rayner was already in touch with them.       Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thank you TC and Lexis.

I have offered my late nephew's widow MY help due to I was widowed when my boys were very very young and her boys are so young too but she told me she has lots of help from her friends and family WHO as far as i know have not had the raw experience of being left alone at such a young age but she knows she can call me anytime and I'll help her as much as i can.......I just cant get Vincent out of my head and the sudden way he died while in the hospital.

Having to go back to the dentist to have a sliver of tooth removed from the side of my gum "that was overlooked last tuesday" when I had the tooth removed grrrrrrrrrrrr then driving to a tyre bay to have two tyres changed around on the rims then to be told it was ilegal to do that on a 4x4 and that I have to have two new tyres so thats another £146.00 up the ribs and then just now while at home I paid my virgin media account via auto payment and it took the payment then passed me through to some twonk who told me the payment had not gone through...but wait............oh yes ...yes it has...............ahhhhhhh grrrrrrrrrrr wanookas.....it better start to get better this day ffs

Our new kitchen was due to be delivered on the 22nd June for fitting that weekend. Phoned the supplier to chase for updates on delivery 4 or 5 times, and when we finally got hold of him we're told (with no apology) that it is now Monday due to supplier isses. Monday morning arrives and we've heard nothing, so again on the phone to chase. Now due on Thursday, again no apology. Phone Weds to check time for delivery, now it's Friday, which means I have to miss part of my sons last Sports Day at primary school in order to wait in for the delivery.

 

Delivery arrives two hours later than stated. I start building units ready for the re-arranged fitter the next day, only to find that there are integral carcasses missing. We'd agreed that the doors may not all be there (in fact none were), but said we had to have the carcasses - this was all fine according to supplier. I was too cross to phone so I tempered myself and emailed explaining the delays and the incorrect units. Finally received a phone call from supplier in the afternoon on Friday, blaming missing units on the warehouse. Missing units (no mention of doors/handles/plinths etc) should be with us Monday/Tues. Still no apology.

 

On Monday I call at 11ish as he's not got in touch. He thinks I'm another customer and starts making excuses as to why their kitchen is late. Huge alarm bells. Realises it's me and says units due on Weds/Thurs! I say that his message on Friday said they'd be here Mon/Tues - his response 'yeah, well'. Still no apology. Now I have several cakes due for delivery by the 20th July, so this is a big issue, which I tell him. He very begrudgingly says he's going to Crown later that day and will chase them to see what can be done, then phone back.

 

You guessed it - nothing. On Tues I phone again at 2.30ish and ask what's going on. Apparently he's going to call Crown in 10 mins and will find out what's going on (huh - you were meant to be there yesterday, why do you need to call them?). I was not happy and told him as such, ending the call with him assuring me he'd call back asap. At 6pm I phone and get his answerphone. Left a message stating that if we don't have the kitchen in full in 2 days I'll cancel the order and he can pick up what they've dropped off. So far still not heard from them.

 

I'm so fed up. We've had no kitchen for a month now as work was being done, the units are two weeks late and not looking like they're going to be arriving any time soon, and I'm trying to work out how the helll I'm going to make several novelty cakes and cupcakes with no kitchen.

 

On top of that, our tumble dryer blew up (literally) on Monday, then yesterday our dishwasher did the same. We have no sink at the moment so that means going upstairs to wash everything, and I (with great difficulty due to my workspace being the top of a fridge) made a full roast yesterday so I've got tons of bloody dishes from that, plus the ones that were halfway through a wash when the washer packed up!

 

And I've got a headache:(

 

Sorry for the long rant, but I needed to get it off my chest!

I wish I were closer lexis I am still able to do lighter type work like kitchen fitting.................I installed my own some years ago it's not rocket science but kitchen fitters seem to think it is for some reason.

My kitchen came flat packed and there are 27 units in it and took me three "not whole days" to make up the carcases "on my own" and 3 days to install it "on my own" except for the gas supply ..............not every builder has a concience but I have and that is why I stayed a poor builder not a rich one....................mail me where you live and tell them to walk away in jerky movements and i'll nip over there and bliddy do it.................GITS

 

 

ps thats a BIG rant....how big is your chest:!:

Thanks burly:) Luckily the fitter isn't a problem, just the supplier. Our next door neighbours' son installs kitchens into Wickes showrooms and does normal fitting too, and he's doing us a favour at about 1/3 price we were quoted by 3 other people. If only we had a kitchen for him to fit :rolleyes:

 

ps - today it's like Jordans. Tomorrow (when I'm less peeved), not so much :madgrin:

Belfast City Council euthanising Lennox, after keeping him at a secret location for over 2 years. His family were not allowed to say goodbye to him; they are not allowed to have his body for burial, and the council MAY send "some of his ashes" back to his family by post.........BSL does NOT work, when will the government realise this?

Our dishwasher blew up on Tues, and seeing as we have no kitchen sink at the moment it was a bit desperate that we got one. Found one from a company who said they had it in stock at £470 (one of the cheapest prices we'd seen, others went up to over £700!) and could deliver next day, so we ordered it yesterday morning. Yesterday afternoon I get a call saying they can't honour the order as although they ordered four from Siemens, and had only sold 3, the last one was nowhere to be found. He sounded very genuine and was very apologetic - and baffled - but there wasn't anything much I or he could do.

 

I obviously had to keep looking for another stockist, and I've just had a quick look on their site again out of interest. It's now up for £599, in stock for immediate delivery. My guess is they realised it was a good price, had had a few enquiries and decided not to sell lower than they needed to.

 

The other place I went to who are brilliant with their customer service (appliances online, it's worth checking there if you need something!) offer a price match. I found a machine for £450 which they wouldn't match as it didn't meet their terms (fair enough), but they had 6 in stock in the morning so I went and had another look around. Found the next cheapest (the place that let me down), phoned them back to match it but they couldn't as they'd sold out!

 

I think I'm going to be washing dishes in the bath forever :rolleyes:

My NHS dentist is rubbish, missed a huge hole where a filling had dropped out at my last checkup so I had to have emergency treatment elsewhere. In any case I can't afford to go because it costs me £25.00 in travelling each time and I simply can't afford it.

 

Anyone got any pliers?

GP surgery last week... Only now calming down enough to post... F'ed up my prescription three times, had to ask consultants to fax 'scripts and then got called everything under the bloomin' sun by a receptionist! Had a narky letter from the practice manager telling me off and saying that if I step out of line again i can go look elsewhere!!!

OH has to work today:( And his ba**ard boss doesn't even consider paying or giving days in lieu, it's just expected as the company contracts all say that employees must work above and beyond if required. He works a good 1/2 hour overtime every day unpaid, often misses lunches, and no-one gets any recognition from the boss. I also found out yesterday that he's got to be away for four days at the end of the month, and again there's no mention of compensation in any form.

 

What's worse is that in every other dept. the managers/directors realise that working over your normal hours should be rewarded in some way, it's just the IT director who is a complete to**er. And he's the MD's brother in law so thinks he's untouchable (he's actually said that to people). No-one will go up against him formally as they are worried about their jobs, or if they don't get fired their working environment. Complaining informally to HR does sod all - they have a huge file of complaints against him (he's been noted as proudly saying he has the biggest file), but nothing is done:mad:
