    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No probs, I have the whole thing saved and busy editing it to be more truthful, and instead of making peeps angry, it will make you laugh. Will take time to finish, as I'm doing two other video projects at the same time.

I'm not like mainstream tv. To me quality is more important that quantity. That's why I haven't made a reality tv show, and never will.

What the hell was that guy from first credit on about when he said to the woman over the phone that the section papers don't prove mental illness?!

 

Section papers firstly are a legal document, secondly for anyone to be sectioned under the mental health act is absolute proof of mental incapacity, you can only be sectioned if you are completely mentally incapable! That is the reason the law and sections under the law exists, in order to force mentally ill patients into treatment if they are mentally incapable of admitting themselves and their illness could cause harm onto themselves or others.

 

what a complete idiot, I've never met a person yet who thinks someone who has been sectioned is mentally capable. Prat. That's not poor training, that's complete ignorance and idiocy.

Welcome to the forums and for posting that information. Typical 1st credit I am afraid. I have been with them, battling it out for four years and they are not only ruthless but they take absolutely, no notice of anyone, Trading Standards included. In mental Health, you have access to an Advocate and they usually know who to contact. Have they been helpful?

hey peeps, i am the other woman that appeared on the panorama show. like maccas mum some info was not put in and other parts were just wrong. like ignoring their calls so they took me to court - never happened but on the phone they were un moving with the monthly payments. also attempted to get case moved to my local court - this was refused by the courts so i couldnt represent myself.

 

there was also a post on here saying the situations shown werent of real people - because my dad eventually paid the debt for me - on his credit card, which he is still paying back (i pay him for him to do so), i can assure you my situation was vey real. My father who paid the debt was diagnosed with cancer at about the same time and had a laregectomy (voice box removed) and now doesnt work so it is a huge strain on him to have my debt round his neck. when i was in the situation a couple of years ago i went down loads of held avenues such as national debt line etc and all advised action did nothing - the court was unswerving as were grrenhalghs.

Do you have a thread running on your situation bergebabe? I assume the escalation of the debt was true in which case the charges added to the debt can certainly be claimed back.

yes i started a thread about an unrelated matter involving cabot which has just reared its ugly head after three years of being paid every month.

 

i mentioned the panorama thing and a suggestion was a SARS which i now need to look into and try to gain some understanding of. i really wasnt thinking of dragging this up again as have put it behind me - i did the show to stop others getting involved in similar situations - but if there is a possiblity of claiming back money i will have to look at it - maybe finally be able to clear the debt in my dads name!

 

this site really is great - people are really supportive and helpful, however, it is a lot to take in and there are so many posts to read through!

If you haven't already, start by reading the FAQ's here. The principles are the same for reclaiming penalty charges whether they are on an HP agreement or a bank account or credit card.

i suppose the real question is whether i would actually be entitles to anything - you see the original credit agreement detailed a total to be repayed of £4300 ish. as i ended up paying £4700 a lot of the court fees etc that had been added to the debt and solicitors fees had been effectively written off. the sum of £1700 was the cost of the sofa if i had paid it in full within the years interest free period, but once the year was over they backdate the interest for that year as well. incidentally i had attempted to pay the debt in full about a week after the first year was over - i had miscalculaed the date and they dont write to remind you strangely enough. they wouldnt accept the payment.

I'm not sure if this has already been mentioned on this thread, but many people don't seem to be aware that First Credit is owned by Bridgepoint, although they have been trying to ditch it for some time.

They will get away with their bad business time and time again. Why?? well just take a look at the list of people behind Bridgepoint and see if a name jumps out at you.

They are some of the same people who stand in the Commons (and the Lords) raging against DCA's, Purchasers and the like because of the way they treat people in difficulties. They make all the right noises in public and tell you what to want to hear, while all the time they are raking in the profits from the very same companies they 'chastise' for causing misery and sometimes suicide amongst ordinary people.

 

It's pity this fact wasn't broadcast - but then it's no great surprise.

Correct - no surprise on either count!

 

What dos surprise me is that CAGers are able to come up with these valuable snippets of information with the limited resources to which most have access & yet BBC researchers with their infinite access to news archives etc. can only produce the Rankines & Greenhalghs to include in a so called responsible factual documentary!
