  1. I have received an attachment of earnings letter this morning from Global Arrow for an old debt however I attended court for questioning in regards to this case on the 9th October and provided details of all my income and outgoings including copies of bank statements etc. I proved to the courts that my expenditure was more than my income and have received this letter this morning. Can anyone offer advice on what to do next as I do not want my employers to find out as this would be detrimental to my position
  2. Hi all, first post so I apologise if this is not in the best location - please feel free to move it. I need some help with a financial issue; some history: I took out a loan with my partner which was secured on a property we owned back in 2004 (I think), everything was fine until we broke up and sold the property in 2006. We then continued to make payments at 50% each (to cover the monthly payment equally). My ex then stopped paying, and the loan company came to me for the balance of the payment, which I couldn't make, but I did continue to make my payments at 50%. At some point thereafter (and I am a bit cloudy on the dates), I stopped paying as I could no longer afford to make them. Some time passes, and in 2010 I receive a letter from the local court whom have enforced an attachment to earnings, after a hearing that I didn't know about. The current situation: The attachment to earnings has been going through fine since it was put there. I have reached a point in my life where I need to move on, and so want to find out exactly what the situation is. I spoke with my payroll department to check what details they have. The only paper work I have is the letter from the court advising how much money the attachment is for, and a couple of random statements from the lender, but the values do not tally at all, so I have written to the lender and made an SAR under the DPA, and a request under the Consumer Credit Act. The lender replied initially replied to the DPA request but I heard no more until I chased them, and then they asked for proof of identification. They asked for proof of identification from the off for the CCA request. There have been letters back and forth between myself and the lender with all the information I can give them, but they continue to advise they cannot identify me. I have spoken to the issuing Court, and they to have written to the lender, and to the best of my knowledge have not had a reply. I have been to the CAB, and the only advise they can give me is to go to the issuing court and get them to turnover their judgement. I have completed an N244 form and am about to send it to the court, but just want to find out if I have any other options. I am not a stupid person (barring getting in to this situation), however the whole legal thing baffles me and I don't want to go and stand in court and look stupid. Any help you can give would be great, and I'm sorry for the length of this post.
  3. Hi guys, I am here for some advise and help before I go completely insane... I have a number of CCJ's which are being enforced by AOE orders and also child support to pay out each month, however someone mentioned on the bus today about I should have protected earnings. Doing searches for the past hour and I cant find any solid answer to my question of what is my protected earnings rate, because to be fair, I think I am being deducted FAR too much money. To outline, my payslip reads as follows... (I get paid 4 weekly) (yearly salary £11631.89) Income:- Basic pay £892.31 Deductions:- Tax £32.80 N.I £29.05 Pension £58.00 Unison £7.44 Court order £54.08 Admin fee £1.00 Court order £35.92 Admin fee £1.00 Court order £41.00 Admin fee £1.00 Child Supp £225.30 Admin fee £1.00 NET PAY £404.72 That's a total of £360.30 paid out AFTER tax, NI, pension and Unison... £404.72 doesnt leave me enough to live on (Rent £360) so basically I have 44.72 or £11 a week to live on. What is my protected earnings and are they taking too much from me? Thanks in advance guys and girls. Jason M.
  4. Hi, despite me doing all the JCP asks of me in way of proving my earnings (B7 and supplying payslips on regular basis) JCP keeps sending an Earnings Enquiry form to my Employer. My Manager is extremely busy and is refusing to fill this in which I can understand as it is very in depth and takes time. Another member of staff doing the same work as me in the shop is working approximately the same amount of hours as me but my Manager does not receive a form for her. This form is complicating my life as JCP is refusing to pay my partner's JSA without the form being filled in. Why do some people have to prove their earnings in this way and some don't? Is the JCP correct in doing this? Can anybody give any suggestions about how to resolve this problem? I should add that my Manager is always very angry when she receives these letters and makes me feel uncomfortable at work.
  5. Hi, I have an old debt with mbna which they took out a ccj against me, i did not fight it. About 2 years ago they took out a charging order against my house and again i didnt fight it as i didnt think i could. On advice from friends i ignored all letters as i was told they would never try and make me sell the house as i am in poor health and care for someone who has learning problems. The debt is just over £5000. Last week i got an attachment of earnings order from the court with threats of arrest if i didnt fill it in and send back. I work full time but dont earn very much and have no money left over each month. I didnt think they would be able to force me to pay which is why i just blanked out the whole matter and it came as a shock they can get money taken from my wages each month. What do i do next? Do i fill out the order? do i include a note about my poor health and that i care for someone who is on dissialitby living aid?
  6. I am currently paying £200.00 a month on a CCJ which I am currently in arrears by £400.00. There is a suspended attachment of earnings order and I have been told by the company (Lightfoots) who are acting on behalf of Southern Pacific Mortgages that their client will not consider reducing the monthly payment. I have sent an income and expenditure form and have yet to recieve a reply to this. I am looking to submit a N245 to the county court to have the amount for the CCJ redetermined, I am being very reasonable and offering the sum of £100.00 per month which is more affordable. Once I submit the N245, will that prevent them from enforcing the Attachment of Earnings Order? Also, once a new amount has been set, will this just continue at the new rate without having to pay the outstanding arrears as I cannot afford the arrears at present. Desperately need some advice on this. Also is the fee for the N245 £40.00?
  7. Hi guys I don't know if this is right section please let me know if not. I really need some advice. I don't know if we have any chance of getting anything from Natwest but right now I'm really upset and stressed. My wife and I have a Natwest account although it has only been in her name it is our main account we use for paying rent, bills etc and receiving my wages. Last month May 2013 the debit card was expiring but we never received a new one. June 1st my wife called and spoke to someone at Natwest who apologised and said they ordered a new card for her. I was in the room during the call and she had the bloke confirm the address it was going to. We get a text off Natwest on June 4th saying it will be dispatched in 48 hours. Nothing arrived that week or the next, we were waiting each day for the post to arrive so we could use the card to pay bills and so my husband could get back to work but it never arrived. Finally on June 14th we went to our nearest branch to see what the problem was and when we could expect the new card just to be told it had not even been ordered (we were told 5-7 working days so the latest we thought it would arrive after the SMS was Thursday 13th). They apparently ordered another for us then and there but today another week has passed and still no sign, so again we travelled to the branch to be told once again, no card had been ordered! Again we have have requested that a new card be sent but now 3 weeks have passed and if it actually materializes it will be next week! We have had to borrow money to simply pay bills and buy groceries, I've lost a minimum of £150 a week due to this incompetence not to mention the knock on effects of irregular business and other earnings lost, realistically £300 a week. In our current situation we simply cannot afford this, my wife is at university and I travel to work via megabus which requires I book online or over the phone with a card. I hope that all makes sense I just don't know what to do at the moment or even if it would be worth our time doing so!
  8. Hi, I would like to hear from people that have experience of attachment of earnings. Specifically i would like to know that should i need to attend court: How does the court know who i am employed by? How do they know how much i earn? Are they reliant on me being honest? Do they directly contact anyone for information? I may find myself in a situation like this in the near future and i would like to put myself in as much of an informed and prepared state as possible so that i might fully consider the risk/reward on all of my options.

I have been ill with stress and signed off by the doctor for 2 weeks, I am going back soon and will be arguing to get the 3 days non payment refunded and if they put me on SSP the difference from that and full pay. In my return to work interview I will state the grounds of reasonable adjustments to help my return, these will simply be that I request they abide by employment and health and safety law. Their policy, depot not company is to stitch up the staff as much as possible and I have no doubt they will refuse to reimburse my losses, I will ensure they stick to my return to work requests, should they refuse to reimburse me for loses I will take them to court. What is the best way to take them to court? DIY or one of these No Win No Fee companies, if the latter are any better than others, if it goes to court I will go for compensation as well, they pushed me so far I broke down at work and it was very embarrassing. I will give them every chance to settle without court but I just want to know what I can do so I can make them aware of my intentions.
  10. I have had a letter which claims to be from the court saying that if i dont fill it in (N55) and send it back they will send me to prison for 12 days. Is this correct because i am sure the finance company cannot go for an attachment of earnings if you are self employed. Also on the n55 form there is no court stamp and the back of the form has not been filled in by the court. Any advice would be appreciated. Regards Santos
  11. Acolleague recently told me that he can now work/earn money of up to 15 hoursper week and £99 per week - and it will not effect his benefits ! This is despite him being in receipt ofIncome support, Incapacity benefit & DLA. I suggested that he checks things out thoroughly before doing anything. If one isable to work, shouldn't their benefits be re-assessed ? I have noidea what this system is called, so can't look into it. Any ideasplease ? Thanks forreading this.

There is a very small box on the application page to complete regarding the reasons as to why you are applying for suspension. Ideally I would like more space to highlight the few key reasons, can I enclose a small slip of paper with this on or won't it make any difference whatsoever? Thank you! Have a nice weekend.
  13. I have been served an attachment of earnings order for missing council tax payments. I find the letters sent to me rather confusing. It says I AM ORDERED by the council to make deductions from net earnings. That bit I understand but then it says. I AM ALSO ORDERED to pay each sum deducted to Rossendales Ltd within the period of 19 days beginning on the last day of the month in which the deduction was made. So does this mean I've got to pay them as well as the AOE. It would be impossible for me to do this as the AOE will make it difficult to live anyway regardless of anymore payments. Thanks.
  14. Hi all, I am suffering from stress and depression, am currently under medication and due to be referred to a psychiatrist in the new year. I am just about holding onto my job, but I am taking more and more days off - which is a worry in itself. Last year my council issued an attachment of earnings order for outstanding tax arrears because they didn't accept my proposal to repay. My local MP managed to get it withdrawn (thankfully), but I still had the embarrassment of my workplace being made aware. I told the council about my mental health then, and offered to provide proof, but they didn't want it. The same council have now served another one for arrears going further back. I am owed deposit money from a previous landlord who failed to return it (in the same period as sthe council's claim) and that money was earmarked to pay off my council tax. I'll now have to borrow the money to take him to court. I'm also claiming back PPI which will help pay these arrears and some others. All I need is some more time to get these owed monies and they will be paid in full. So far, the council show no interest in helping me or understanding my situation. They want their money now and that's that. My question is this, should the council pursue me so agressively if I have mental health issues? Very grateful for your advice, am finding it hard to cope.   15. Hi I have council tax arrears going back about 2 years. I was in employment with an agency and the sherriff officers charles anderson arrested my wages. My employer paid the full amount requested. However charles anderson contacted my employer again, with a rude letter stating that they did not receive the payment, and that my employer had a responsibility to pay and that they would be liable for payment if they didnt deduct it from my wages. I contacted charles anderson again and explained that my employer had already made payment and later I received a letter from charles anderson saying that they had found the payment in their unallocated file. Dont ask me why my payment was in an unallocated file and why they had misplaced it because I had all reference numbers etc correct. I lost my job with my employment because they could not be bothered with the harrasment from charles anderson. To my disbelief a couple of months later (todays date)I received another arrestment order which is sent to same previous employer who I am now not with, this was for the other years arrears ( they had applied to the court for both years at the same time) I am in receipt of job seekers allowance and have a council tax rebate so why on earth have they applied to my previous employer if they know that I am in receipt of benefits and not working now. They have totally ruined me for ever getting a job with my previous employer again. Please help. They have pushed me into unemployent and are still ruining my chances.
  16. I do apologise if this is the wrong place. I'll try to be brief as possible - I had a my council tax bill for 2013/14 yesterday and it noted I have an attachment of earns for last year worth £1200 - which is more than my yearly council tax. I hold my hands up that last year I missed a payment due a very difficult pregnancy for my partner- she had a lot of problems- everything kinda went out the window and I miss one months payment. My local council refered the remainder of the balance (about £300) to Bristow and Suitor - on they day they contacted me via phone, I told them I wasn't going to deal with them. They sent one letter after that threatening collecting and that's the last I heard from them. Any time I went in to the local council office to pay the balance - I was turned away being advised it was now in the hands of B&S. I find it hard to believe that 1 letter and phone call is worth £900. We had no visits - my partner was in all the time due to the aforementioned problems. IS there anyway I can cotnest the bulk of these charges? Ive already asked for a break down but nothing back yet

Hi all I posted a thread recently regarding a bailiffs visit for three council tax liability orders (original thread Since then I have made a payment to the council as agreed and have ignored the bailiffs letters etc. The council have agreed to take the payment on the accounts they currently hold but are still insisting that I negotiate with Rossendales for the 3 liability orders that they hold. My plan was simply to ignore Rossendales and just continue to make my payments to the council and just wait for the accounts to be returned. All going great until on Saturday I received a letter on Rossendale headed paper. The letter is as follows:- PLEASE DO NOT IGNORE RE: attachment of earnings order Please find enclosed a copy of the Attachment of Earnings Order that we have served on your employer in order to recover an outstanding debt on behalf of Wakefield District council. Please read the enclosed regulations so that you fully understand your role as failure to comply with the requirements may render you liable for a fine. Yours Sincerely, Wakefield District Council I am confused. The letter is from Rossendales yet signed by the council????? It also says on the reverse on the "to your employer" part that payment is to be made to Rossendales. What should I do?
  18. Our house is due to be repossessed after we both lost our jobs. Whilst we are no overly concerned at having to move out as we have been struggling to pay for utilities etc. for the last 5 years and to be honest it will be a relief. We are currently not in debt to any of our utility companies. My concern is that as the house now has negative equity will the mortgage company be able to apply for an attachment of earnings against our pensions when the house is sold. My husband has a small private pension and we will both qualify for our state pension later this year other than that we have not other income or savings. As we will have to rent a house I am worried that we will not be able to afford to live if the mortgage company can take our pensions.
  19. Hello, I am desperate to find some help with an issue that started by a car I had on a personal lease being stolen. The Insurance company refused to pay and then RCI FINANCIAL l in conjunction with MATTHEW, ARNOLD AND BALDWYN SOLICITORS somehow managed to get a CCJ against me. The next I heard was that I had to go to court for them to make an order on our property for £1700 which they claim that I owed. This was made up of repossession charges (Car found by police) and also storage charges plus the outstanding payments up to the end of the lease. I attended court and was told I could have applied to have this set aside - I would have tried this had I known because the solicitor never wrote to me until I had to attend the court for the property order. I write a letter explaining I was on a Debt management programme and had been for some years but the court just treated me as a formality and granted the order on my property which is also owned by my wife. This happened in MAY 2012 and charges of £250 were added to the debt. I was told by the solicitor in court that as long as RCI know they have the order on our property they will not pursue this matter or can they force us to sell our home. We have 4 children under the age of 11 so we need to protect them but this is a real struggle - we barely manage to feed them and ourselves and often do not heat the house as we cannot afford both. We think we had been mislead by the solicitor in as much as they have the property order they will get their money if and when we sell the house, this is because we showed them we could not afford to pay anything. Now I have received an attachment of earnings order which to me seems sheer bloody spiteful and all I know what I can do is ask here for some advise and to also make the debt management plan CCCS aware. They have also added another £100 to the debt. If they are allowed to take money from my wages our home and and the other debts will not be possible to pay and I will be out of a job and we will be homeless.. I just feel so desperate that I am prepared to tell them to send me to prison and the solicitor has again not written to us and proceeded straight to another court action. I would be ever so grateful for any advice please.
  20. All, Has anybody had success in an offer for voluntary payment. I have received an order after missing 2 monthly payments, on £5598.61 debt. My order monthly payments were agreed at £39.50 via CCJ order. I can make this payments but in all honesty forget to re set up standing order on-line after they were accidentally deleted. I'm in a very sensitive work siltation and an attachment request via the courts would put my job in major jeopardy, I really cannot let this go via my employer. I have contact Optima to request that I pay arrears and continue to pay monthly payments without fail via direct debit. However I haven't heard back from them, I need to reply to the court by this Wednesday. I have a feeling Optima legal will state I need to go direct via the court process of sending in voluntarily request. If a voluntary request is rejected do the courts go ahead with earnings order via employer?
  21. Just received notification of earnings arrestment through the post for council tax. Is there any way to appeal this. By my calculations, thats around £250 quid a month out of my wages, money I can't afford. We are a family of four and this will cripple our household budget.
  22. Hi I was wondering if anyone had come across this situation before. Can I claim Sickness Benefit without it affecting my Reduced Earnings Allowance, payable through my Industrial Injuries Benefit ? I've tried looking all over the web for info but come up blank. I know I could claim this new EAS benefit but can't find anything about it affecting Sickness Benefit. For that past few years I've been told I can't claim either being self-employed,but now my condition has increased to the stage I may now have to give up Self Employment all together.
  23. I owe £1800 in council tax arrears but I'm up to date with my current years council tax. While on benefits, bristow & sutor would take £21 from my benefit towards this. Now I am working in a permanent job, I am still only able to afford £30 per month towards the arrears but bristow and sutor consider this too low and they have now written to my employer to put an attachment of earnings in place which I cannot afford. Initially, I was trying to make payments to the Council as overpayments on my council tax but my council refused to put these over payments towards my council tax arrears and instead they just went towards my current year's bill. After that I spoke to Bristow & Sutor and told them what I could afford to pay which they said was unacceptab;e (I have paid them anyway) but now I have received an attachement of earnings order which I cannot afford. I've been to the CAB and received a signed copy of my income/expenditure and I've sent it to both the council and bailiffs a number of times but they claim to not have received it or to not care. I've begged the council to take back this debt but they say the can't and I've also called Bristow and Sutor who refuse to discuss this any further. Is there any way I can get this into a court room? I dispute the fact that I owe all of it but I do owe about £1400. I am willing to pay it but can only currently afford £40 per month. I need help - please help me - my outgoings are the bare minimum. I have Gas/Electricity meters, I have a pay a you go mobile that I never use to make calls. I've pared back my expenses as much as possible and now don't know what to do. No leeway on my mortgage owing to a suspended possession order so please please help

  25. Hi , my wife has been sent a form 30 earnings arrestment schedule (intimation to debtor) form. I presume this means they have or about to contact her employer. The only problem is that they have put the wrong employer on the form. Does this mean they are going to disclose confidential information to someone she doesnt work for? I'm not sure what to do? I presume this form is real and not a threat. Its from scott and co. thanks
