I don't live far from that address and in fact have to pop into the "West End" on Saturday . . Morning HANLEY I refer you back to my post 32 Google results for Harris and Trotter show them to be accountants NOT solicitors so you need to be sure beyond any doubt that what you are posting in this thread is 100% correct and even more watertight than a ducks bum If you do pay them a visit and/or start making allegations that aren't correct apart from making a fool of yourself you could well drop the CAG right in the soft and smelly stuff I can understand your annoyance/frustration but on behalf of everyone that uses this excellent site I ask that you check,recheck and then check some more before going off half cocked Regards R

I've just had another read of todays update at Post 7 Cap1 and Lowell are contradicting themselves so I wouldn't bother with such a detailed reply Just put the matter in dispute and state the basic facts as they have been presented to you . . You do not acknowledge the alleged debt You dispute the alleged payment and demand absolute proof As Cap1 have admitted in writing that they have no record of any account with your name you find Lowells claims to be bordering on deceptive/harassing Your SAR request still needs to be fulfilled Leave me alone until they have proper proof Complaints are going in the post accordingly No need for any great legalese just yet, this will let them know that you won't be pushed around and make them do a bit more work R ps . . Lowell are none too bright as a couple of weeks ago they set BCW on to me for a Stat Barred debt but never bothered to tell BCW

Hi Willowy Hope you had a good holiday If they cannot prove who you are/where you live(d) etc it's NOT up to you to send further details I'd be very tempted to write back and tell them that as they have no record of any account held by you they should go away and call off Lowell and leave you alone until such time they have they proof and that by the way your SAR request still stands regards R

Debt Collection & Default Guidelines In attempting to carry out collection in default of payment, members of the Association should: a) Not use oppressive or intrusive collection procedures. b) Not bring unreasonable pressure to bear on the debtor in default of payment. i) Not pressurise debtors to sell property or to raise funds by further borrowing. p) Take into consideration before determining whether to enforce repayment, all information supplied in relation to the reason for nonpayment, which may include The Common Financial Statement, or the debtor’s future ability to repay. If the debtor has disclosed multiple debt problems, inform them of the availability of accredited advisory services. Where available, provide in all relevant correspondence the name or designation of a specially trained member of staff who may be contacted regarding financial difficulties. As you can see very similar to the OFT Guidelines but the first part of 'P' is also relevant as they should look at all the facts presented to them Above all please remember that even in your situation you're still in control of your money not them Good luck R

  11. I have seen something re charges that's along the lines you've put but can't remember where . . . Pressurising debtors to pay is under section 2 of the OFT Guidelines (Physical/Phsycological Harassment) . . . Misleading debtors I covered on the first page . . . Nothing's going to happen over the weekend so take your time over getting things ready BUT remember to also take time for yourself . . . R

You've already made complaints so send that very threatening/misleading email in and escalate things . . . really push the harassment side . . . maybe take a copy to your local Police and report it on the grounds that you now fear that someone will turn up at your door, ask for a ref number . . . they want you to think that it's all over and they've won . . . WRONG . . . as I see it you've got this under control so just keep as calm as you can and keep pushing . . . Regards . . . R

That's more like it . . . not easy I know but don't let them bully you into submission . . . what they say re the CCJ is done to scare you and is not right . . . first they must go to Court and win the CCJ (Can be defended) . . . if they win the Judge sets the repayments . . . IF you default on that they then have to return to Court and get further action authorised . . . it's not a given thing as they put it . . . You have more power in this than they like and all they keep doing is making things easier for you by digging the hole deeper . . . the help and support is still here so have a cuppa and get the next part of your battle plan moving as more complaints are in order . . . sorry for the way I've had to write this . . .   17. This is from the FSA web site, I know it's re Off Setting but I've highlighted the important section . . . Why else would my bank take money out of my account? In certain circumstances, your bank can claim money from one account to pay off a separate debt in another account under its right to ‘set-off’. This could happen if you miss loan or credit card payments and you also have a current or savings account with the bank. If a bank wants to use set-off on your account, it should: estimate how much money needs to be left to meet your priority debts and essential living expenses like mortgage, rent and food bills; provide a refund, in most cases, if it becomes apparent to the bank that money taken in set-off was intended for those priority debts or costs; and not use set-off on money it knows or should know is intended for certain purposes, such as where the NHS provided it for healthcare or a third party is entitled to the money. You are also protected under industry guidelines, which say that banks should: try to contact you to discuss your options before set-off is used, and to explain when and how set-off can be used; and tell you when set-off has been used for the first time.
